


Due to the importance and urgency of the National Highway 7 Renovation and Upgrade Project, on the last day of 2023, the Provincial People's Committee issued Document 11226/UBND-CN on "resolving all existing problems and difficulties related to compensation and site clearance for the National Highway 7 Renovation and Upgrade Project, section km0+km36 and handling landslides caused by storms and floods in the Khe Thoi - Nam Can section" to the Departments of Natural Resources and Environment, Finance, Construction; People's Committees of Dien Chau, Yen Thanh, Do Luong districts; and Project Management Board 4 - Vietnam Road Administration.
In Document 11226/UBND-CN, there is a specific content for the "bottleneck" area of about 300m long through Luu Dien hamlet, Luu Son commune, where the Luu Son commune gas station still exists, and 15 households with problems refusing to hand over the site. Specifically, the Provincial People's Committee directed: "For 15 households in Luu Son commune: Direct relevant departments and offices to review the order and procedures of the documents to carry out the next steps according to regulations. For the Luu Son commune gas station: Urge, coordinate, and support the investor to soon complete the procedures, deploy construction at the proposed location, and work with Project Management Board 4 and the investor to agree on the time to hand over the construction site for the project".

Regarding the settlement of petitions and petitions of a number of households in Luu Dien hamlet, Luu Son commune, Do Luong district, Nghe An Newspaper reported on December 28, 2023 in the article "Resolute measures are needed so that the project to renovate National Highway 7 through Do Luong is not reduced in scale". In particular, information about the "bottleneck" section of National Highway 7 due to problems in site clearance and construction delays has caused people in the area to suffer from dust and dirt; people and vehicles participating in traffic are facing great difficulties; At the same time, it reflects the reality that there are many constructions and architectural objects such as fences, yards, kiosks, etc. built for many years that violate the planning of the traffic corridor of National Highway 7. Regarding the contents of the proposal to consider compensation and support for the land area that has not been allocated by the State, and to recognize the land use rights of related households, it also reflects that Do Luong district and related departments, branches as well as competent authorities have considered and resolved many times, affirming that there is no basis for resolution. Specifically, it is summarized in Notice No. 423/TB-UBND dated December 15, 2023 of the People's Committee of Do Luong district after a dialogue on the same day with related households and individuals.
That is, regarding the request for compensation and support for the land area located within the National Highway 7 corridor, the People's Committee of Do Luong district issued Document No. 1469/UBND.QLDA dated July 10, 2023, Notice No. 329/TB-UBND dated October 10, 2023 in response to households and individuals, affirming: "The land area belonging to the National Highway 7 protection corridor, belonging to the planned land fund for the purpose of expanding traffic routes as prescribed in Articles 61 and 62 of the 2013 Land Law, so when the State recovers it, there will be no compensation or support for land".

Regarding the request for compensation and support for constructions, houses, and architectural objects illegally built by households after July 1, 2004 on the National Highway 7 corridor (at the time of construction, there was no record of violation by the competent authority), the District People's Committee issued Document No. 1709/UBND dated August 10, 2023 to the Provincial People's Committee and departments and branches requesting consideration and permission to apply other support measures with a support level equal to 50% of the compensation value. The Department of Finance then issued Document No. 4009/STC-QLG&CS dated August 30, 2023 requesting not to consider applying other support policies to the houses and architectural objects of 17 households and individuals in Luu Son commune that were built on the National Highway 7 traffic corridor after July 1, 2004.
The Provincial People's Committee also issued Document No. 9285/UBND-CN dated October 31, 2023 on resolving difficulties in compensation and support for site clearance to implement the project to renovate and upgrade National Highway 7, section Km0-Km36, and handle landslides caused by storms and floods in Khe Thoi - Nam Can. According to Document No. 9285/UBND-CN of the Provincial People's Committee, the People's Committee of Do Luong district has no basis to direct the District Compensation and Support Council to prepare support documents for works and structures illegally built by households and individuals on land along National Highway 7 after July 1, 2004.


Talking to Nghe An Newspaper reporter on January 2, 2024, Secretary of the Party Committee of Luu Son commune, Mr. Dao Van Tai said that recently, the Party Committee, the government, the Fatherland Front and the socio-political organizations of the commune as well as of Luu Dien hamlet have continued to propagate and mobilize related households. However, up to now, only a few households have taken action to clean up and dismantle their belongings but have not yet received compensation and support. And recently, the People's Committee of Do Luong district held a conference to listen to and give opinions on the draft plan to protect the construction of the section of National Highway 7 that still has this problem.
Inquiring at the People's Committee of Do Luong district, it was learned that the conference to give opinions on the draft construction protection plan was held on December 29, 2023 with the participation of representatives of the entire political system of Do Luong district and Luu Son commune and representatives of the leadership of Project Management Board 4, Vietnam Road Administration. Thereby, the time frame for organizing construction protection of the project was determined at 7:30 a.m. on January 15, 2024.

To ensure the construction protection work, the People's Committee of Do Luong district has assigned the responsibility to the People's Committee of Luu Son commune to fully absorb the comments at the conference to complete the construction protection plan, ensuring absolute safety for people and vehicles participating in construction protection and construction forces and vehicles implementing the project. In addition, continue to coordinate with the Vietnam Fatherland Front Committee and socio-political organizations of the commune to propagate and mobilize related households to comply with the State's policies on land recovery, compensation, support and handover of project implementation sites...
At the same time, direct departments, offices and functional units to perform tasks related to construction protection work. In particular, the Department of Natural Resources and Environment coordinates with the District Land Registration Office Branch, the project investor and the People's Committee of Luu Son commune to determine the scope and boundary of construction protection in the field, to hand over to the People's Committee of Luu Son commune before January 15, 2024 as a basis for implementing construction protection.

The District Land Registration Office Branch, based on the measurement and correction of the cadastral map of the land plot and related documents, coordinates with the Department of Natural Resources and Environment, the People's Committee of Luu Son commune and the investor to determine the area that has been allocated land by the State, grants land use right certificates, the area and scope of construction protection in the field (completion time before January 15, 2024). The District Police directs the Luu Son Commune Police to advise the Luu Son Commune People's Committee to develop plans to ensure absolute safety for the people and forces participating in protection and construction; supports the Luu Son Commune Police to ensure absolute safety for the people and forces participating in protection and construction; directs the District Traffic Police - Order Team to coordinate with the Traffic Inspectorate to regulate traffic, not allowing traffic congestion to occur, affecting the protection and construction work...
