


The project of commercial service area, office for rent, housing and high-rise apartment of Vietnam - Laos Economic Cooperation Corporation is implemented on a land area of 4,054m2.2in Hung Dung ward (Vinh city). This is a prime land with high profit value because the East side borders the residential planning road, the South side borders Nhu Ngoc Company Limited (now Toan Thang Hotel - PV), the North side borders Honda car dealership, especially, the West side borders Le Nin Avenue with a length of up to approximately 100m.
Going back in time, in 2006, the Nghe An Development Support Fund Branch (later Nghe An Development Bank Branch) was allowed by the Provincial People's Committee to survey and plan the construction of an office building with a minimum height of 9 floors on this land. However, due to problems in compensation and resettlement for a household, it was not until the end of September 2009 that the site clearance work for the project of the Nghe An Development Bank Branch was completed. Then, only a short time later, in December 2009, the 4,054m2 land2Lenin Avenue was "transferred" to the Vietnam-Laos Economic Cooperation Corporation.

One of the documents showing the "transfer" is Decision No. 6938/QD-UBND.DC dated December 25, 2009 of the Provincial People's Committee on granting the Certificate to the Vietnam-Laos Economic Cooperation Corporation. Article 1 of Decision No. 6938/QD-UBND.DC states: "Granting the certificate with code BA 834104 to the Vietnam-Laos Economic Cooperation Corporation; the total area of land use right certificate is 4054.0m22; purpose of use is land for production and business facilities; land use term until December 16, 2059".
What is special about the project of Vietnam-Laos Economic Cooperation Corporation to be implemented on the "golden" land of 4,054m2?2clinging to Lenin Avenue? The answer is in Decision 1810/QD-UBND.CN of the Provincial People's Committee issued on May 6, 2010 on approving the detailed construction planning of the project of Commercial Service Area, Office for Lease, Housing and High-rise Apartment, invested by Vietnam-Laos Economic Cooperation Corporation. Accordingly, the project includes 2 areas A and B. Area A has an area of 2,605.74m2, 22-storey building layout (excluding basement) with commercial service functions, office for rent and high-rise apartment building, construction area 1,122m2Area B has an area of 1,448.26m22, then only arrange 2 lots of 4-storey villas. In which lot B1 has an area of 726.22m2Lot B2 area 722.04m2, the construction density in these 2 plots of land is maximum 40%.

Comparing the project of Nghe An Development Support Fund Branch, which is an office building with a minimum height of 9 floors, it is clear that the project including a 22-storey apartment building and 2 villas of the Vietnam-Laos Economic Cooperation Corporation has nothing special. But for the Vietnam-Laos Economic Cooperation Corporation to implement the project, on August 10, 2010, in Decision No. 260/QD-UBND.DC, the Provincial People's Committee allowed this unit to change the purpose of 4,054m2from land for production and business to the purpose of commercial service area, office for rent, villas and high-rise apartments (urban residential land); long-term stable land use period. At the same time, assign the Department of Natural Resources and Environment to revoke the Land Use Right Certificate with code BA 834104 dated December 25, 2009 issued to the Vietnam-Laos Economic Cooperation Corporation to reissue the Land Use Right Certificate.


Regarding the responsibility of the Vietnam-Laos Economic Cooperation Corporation in implementing the project, it is clearly stipulated in Decision 1810/QD.UBND-CN dated May 6, 2010. Specifically: "The investor is responsible for completing other related procedures as prescribed to start construction of the project within 12 months and completing the construction and putting the project into use within 36 months from the date of commencement of construction. In case the above progress is not ensured, the planning approved in this decision will be cancelled and the investor will not be compensated".
However, until April 2022, very few people knew about the 4,054m2 land2On Le Nin Avenue, next to Toan Thang Hotel is the land that since 2010, the Vietnam-Laos Economic Cooperation Corporation has been assigned to carry out the project of commercial service area, office for rent, high-rise apartment building. Because of the fact that for quite a long time, a part of the land area has the Beer Ngon restaurant on it; the remaining area has a few households selling flowers and ornamental plants.

The incident only became apparent after April 1, 2022, when the Provincial People's Council's Thematic Supervision Delegation "visited" the project of the Commercial Service Area, Office for Lease, and High-rise Apartment Building of the Vietnam-Laos Economic Cooperation Corporation. Information about the "visit" of the Provincial People's Council's Thematic Supervision Delegation was later conveyed by a number of press agencies, showing that this project had been inspected three times by provincial-level interdisciplinary inspection teams (in 2013, 2016, and 2021). Most noteworthy is the information about the 4,054m2 land plot2This Lenin Avenue has been "chopped up" into 3 projects with 3 different investors!
Looking for the answer to how the project of the Vietnam-Laos Economic Cooperation Corporation was "chopped up"? It is known that in 2010, the project of the Commercial Service Area, Office for Lease, High-rise Apartment Building was granted by the Provincial People's Committee the land use right certificates No. BA845213, BA845214 (Area B); BA845215 (Area A). On December 25, 2017, the Department of Natural Resources and Environment revoked the certificate No. BA845215 to reissue 2 land use right certificates No. CH537442 (plot 342, map sheet 12; area 1,106.2m2Commercial and service land; long-term use) and number CH537440 (plot 341, map sheet 12; area 1,500m2commercial and service land; long-term use).
On January 15, 2018, Vietnam-Laos Economic Cooperation Corporation transferred land use rights to An Binh Commercial Joint Stock Bank. Land use rights certificate No. CH537440 (plot 341, map sheet 12; area 1,500m2commercial and service land; long-term use). Next, on January 4, 2019, Vietnam-Laos Economic Cooperation Corporation signed a land use rights transfer contract No. CH537442 (plot 342, map sheet 12; area 1,106.2m2commercial and service land; long-term use period) for Hoa Sen Development Joint Stock Company; on September 24, 2019, the Department of Natural Resources and Environment issued Land Use Rights Certificate No. CP894880 to Hoa Sen Development Joint Stock Company.

And with 2 villa plots with area of 1,448.26m2belonging to area B of the project, from October 23, 2017, Vietnam-Laos Economic Cooperation Corporation transferred to Ms. Ho Thi Dung. The transfer was commented by the Department of Natural Resources and Environment in Document No. 5534/STNMT-QLDD dated October 10, 2017 as: "02 residential land lots (plot 22, plot 26, map sheet 12) are eligible for the investor to transfer land use rights to the transferee according to regulations".

As stated above, the project is on a 4,054m2 land area.2The project on Lenin Avenue of the Vietnam-Laos Economic Cooperation Corporation will be "comprehensively inspected" by the Interdisciplinary Team chaired by the Provincial Inspectorate. Specifically, on August 15, 2023, the Provincial Inspectorate issued Decision No. 234/QD-TTr to inspect the compliance with the law at the Project of Commercial Services Area, Office for Lease, Villa Housing (name from here on of the Project of Commercial Services Area, Office for Lease, High-rise Apartment Housing, according to Investment Certificate No. 27111000025 adjusted by the Provincial People's Committee on July 26, 2011) in Hung Dung Ward, Vinh City. The Inspection Team is led by Mr. Le The An - Head of Department of Professional Affairs 3, Provincial Inspectorate; in addition to officials of the Provincial Inspectorate, the team members also include department-level leaders of the Departments of Construction, Finance, Natural Resources and Environment, Planning and Investment, Tax Department and Vinh City People's Committee. Inspection period is 45 days from the date of announcement of the inspection decision.
The project of Commercial Service Area, Office for Lease, Villa Housing has been identified as a project behind schedule, and has been "chopped up" into 3 projects. Regarding the reason for the wrong or right, we will have to wait until the day the Interdisciplinary Inspection Team has a conclusion. However, it is necessary to inform that up to now, the number of inspections at the project of the Vietnam-Laos Economic Cooperation Corporation is not only 3 times as the Provincial People's Council's Thematic Supervision Team informed, but has increased to 4 times. The most recent inspection, conducted by the Interdisciplinary Inspection Team established under Decision No. 2673/QD-UBND dated September 7, 2022 of the Provincial People's Committee, chaired by the Department of Natural Resources and Environment, has ended.

At the same time, we also need more information, although the Project of Commercial Service Area, Office for rent, Villa Housing, invested by Vietnam - Laos Economic Cooperation Corporation, is located in Hung Dung Ward, but the responsible people in this locality do not know much. When asked, they said that, so far, the ward only knows that on the 4,054m2 land2There are 3 land users; a part of the area has Beer Ngon restaurant, the remaining area used to be for flower and ornamental plant business, but now it is completely covered with corrugated iron; and the project planning of Vietnam-Laos Economic Cooperation Corporation has not been implemented for more than 13 years!
An official of Hung Dung ward said bitterly: “People are assigned land, leased land to carry out projects. When transferring land use rights, people do not go through the ward, nor do they notify the ward, but only through relevant departments and branches. Perhaps, only when there is a dispute over land use rights, or a petition or complaint occurs, do people go through the ward…”. “People” here can be understood as the Vietnam-Laos Economic Cooperation Corporation!
