On February 3, 1930, a historical event marked a great turning point in the Vietnamese revolution. That was the founding of our Party, the Indochinese Communist Party, renamed the Vietnam Workers' Party in 1951, and today the Communist Party of Vietnam, the glorious party founded, educated and trained by President Ho Chi Minh, the great leader of the working class and the nation.

The Party and basic issues of Party building
On February 3, 1930, a historical event marked a great turning point in the Vietnamese revolution. That was the founding of our Party, the Indochinese Communist Party, renamed the Vietnam Workers' Party in 1951, and today the Communist Party of Vietnam, the glorious party founded, educated and trained by President Ho Chi Minh, the great leader of the working class and the nation.
Since then, over more than half a century, the Party has led the people of the whole country to unite in fighting, overcome countless challenges and hardships, and lead the Vietnamese revolution from one victory to another.
The successful August Revolution established the Democratic Republic of Vietnam, the first people's democratic state in Southeast Asia.
The victory of the resistance war against French colonialism, culminating in the glorious Dien Bien Phu victory, liberated half of the country, brought the North to socialism and inaugurated the collapse of old colonialism.
The complete victory of the resistance war against the US, to save the country, with the General Offensive and Uprising in the Spring of 1975, ending with the historic Ho Chi Minh Campaign, completely liberated the country, established the Socialist Republic of Vietnam, and brought the country into the era of independence, unity and socialism. That great victory had a great influence on the world revolutionary movement, elevated the Vietnamese people to the rank of pioneers in the struggle for the noble ideals of mankind and signaled the inevitable collapse of neo-colonialism led by US imperialism.
The victories of great historical significance of our people in the two wars to defend the Fatherland at the southwestern and northern borders have added new glorious feats to our country's revolutionary history...
The above victories of international significance and epochal character prove that our Party is truly a strong Marxist-Leninist party, a resilient force of the international communist movement.
The COMMUNIST PARTY OF VIETNAM is the party of the Vietnamese working class, the vanguard, the most organized and highest-level combat staff of the Vietnamese working class. The Party faithfully represents the interests of the working class, the working people and the entire nation; at the same time, the Party fulfills its obligations to the international communist movement.
The Party consists of the most outstanding, communist-conscious, exemplary, courageous and self-sacrificing people from the working class, the collective peasantry, the socialist intelligentsia and other working classes, who voluntarily join the Party's ranks to strive for the Party's goals and ideals.
The Party's aim is to implement socialism and communism in Vietnam.
The COMMUNIST PARTY of Vietnam takes Marxism-Leninism as its ideological foundation and compass for its actions. The Party creatively applies Marxism-Leninism to the specific conditions of the Vietnamese revolution, attaches importance to summarizing the revolutionary struggle experiences of the Party and the nation, absorbs the good experiences of fraternal parties and the intellectual quintessence of the times, and independently and autonomously sets out guidelines and policies to lead the Vietnamese revolution to victory.
The Party strives to educate cadres, party members and people about Marxism-Leninism and the Party's guidelines and policies, making Marxism-Leninism dominate the spiritual life of society and become the ideology of the entire people.
The Party constantly improves theoretical and practical levels, and fosters scientific, technical and management knowledge for cadres and Party members.
The Party defends the purity of Marxism-Leninism, opposes all rightist and "leftist" opportunism, and overcomes all manifestations of empiricism, dogmatism, and one-sided subjectivism.
The COMMUNIST PARTY OF VIETNAM is the nucleus leading the proletarian dictatorship in our country. The Party has the task of unifying the leadership of all activities of the State and society, concentrating the efforts of the entire people, successfully building socialism throughout the country, and protecting the independence and eternal unity of the Fatherland.
Our entire Party, people and army must strengthen solidarity and strive to build a socialist Vietnam with modern industry, agriculture, strong national defense, advanced culture and science, and a civilized and happy life.
To achieve that goal, we must firmly grasp the proletarian dictatorship, promote the collective mastery of the working people, and simultaneously carry out three revolutions: the revolution in production relations, the scientific and technological revolution, and the ideological and cultural revolution, in which the scientific and technological revolution is the key; promoting socialist industrialization is the central task of the entire transition period to socialism; building a socialist collective mastery regime, building large-scale socialist production, building a new culture, building new socialist people; eliminating the regime of man exploiting man, eliminating poverty and backwardness; constantly raising vigilance, regularly strengthening national defense, maintaining political security and social order; successfully building a peaceful, independent, unified and socialist Vietnam; actively contributing to the struggle of the world's people for peace, national independence, democracy and socialism.
The COMMUNIST PARTY of Vietnam correctly combines genuine patriotism with proletarian internationalism, opposing all manifestations of bourgeois and petty bourgeois nationalism.
The Party constantly takes care to strengthen the solidarity and comprehensive cooperation between our Party, State and people with the Parties, State and people of the Soviet Union, Laos, Cambodia and other countries in the socialist community on the basis of Marxism-Leninism and proletarian internationalism, considering it a principle in the foreign policy of our Party and State; does its utmost to contribute to strengthening solidarity and unity among communist and workers' parties in the world; strives to support the national liberation movement and the struggle for equal rights among nations against imperialist invaders, against old and new colonialism, racism, apartheid, Zionism; strives to support the just cause of the working class and working people of capitalist countries; builds friendly and cooperative relations between our country and other countries on the basis of respect for independence, national sovereignty, equality and mutual benefit.
The COMMUNIST PARTY OF VIETNAM takes care to build a socialist collective mastery regime, build close ties with the masses, promote all creative abilities of the working class and laboring people, promote the combined strength of the proletarian dictatorship system according to the principle of "Party leadership, laboring people collective mastery, State management".
The Party's guidelines and policies must reflect the will and legitimate aspirations of the people. The Party and each Party member must respect and promote the people's right to collective mastery, care for the people's lives, go deep and stay close to the masses, propagate, educate, and mobilize the masses to fulfill their obligations to the socialist Fatherland. The Party resolutely fights against bureaucracy, commandism, authoritarianism, arbitrariness, and being detached from reality and the masses.
The Party attaches importance to organizing the masses to contribute opinions on the Party's guidelines and policies, actively participate in political activities and State management, contribute to inspecting the activities of Party and State organizations, and inspect the qualifications of cadres and Party members. The Party encourages and welcomes the masses to criticize the work of the Party and the State, criticize cadres and Party members, and sincerely accepts the masses' correct criticism.
The Party takes care of building and consolidating the government, effectively promoting the management function of the proletarian dictatorship State, a State that is truly of the people, by the people, and for the people, demonstrating the people's right to mastery, and through the government, implementing the Party's leadership over society.
The Party takes care to build and consolidate the Youth Union, Trade Union, Women's Union and other revolutionary organizations of the masses, build a united national front on the basis of the worker-peasant alliance; strives to promote the positivity and proactiveness of organizations and the Front in educating, mobilizing and organizing the masses to implement the Party's guidelines, actively participate in State management, economic management, and solve practical problems related to the lives of the masses.
The COMMUNIST PARTY OF VIETNAM is a unified bloc in will and action, organized according to the principle of democratic centralism, taking self-criticism and criticism as a law of development and having strict discipline.
Democratic Centralismis the basic organizational principle of the Party. On the one hand, this principle ensures the promotion of the positivity and creativity of all Party organizations and Party members in participating in building and implementing the Party's guidelines and policies; on the other hand, it ensures the unity of will and action of the Party.
The Party always upholds collective leadership as the highest leadership principle of the Party, while closely combining collective leadership with individual responsibility, promoting the sense of individual responsibility. Democracy and discipline within the Party must be built into a strict regime. The Party opposes all manifestations of bureaucratic centralism, authoritarianism, formal collective democracy, as well as all manifestations of fragmentation, localism, favoritism, localism, undisciplined freedom, and factionalism.
Party organizations from the Central to the grassroots level and all Party members must strictly followself-criticism and criticism; superiors must self-criticize before subordinates and organize criticism well from bottom to top. Self-criticism and criticism must be honest, straightforward, and aimed at completing tasks, building the organization, and helping each other to progress. The Party strictly prohibits acts of suppressing criticism and oppressing individuals, and has a strict attitude towards any cadre, party member, or organization that commits such shortcomings.
The Party considers the preservationunitywithin the Party on the basis of the political line and the principle of democratic centralism as the life of the Party, and resolutely fight against individualism, against all manifestations of division and factionalism within the Party. Between cadres and Party members, we must build deep comradely love. "Solidarity is an extremely precious tradition of the Party and of our people. Comrades from the Central Committee to the Party cells must preserve the unity and unanimity of the Party as if preserving the apple of their eye."1).
The Communist Party of Vietnam considers the continuous building and consolidation of the Party and the strengthening of the Party's leadership as a decisive task for the Party's revolutionary cause. We must strive to build a strong Party in all three aspects: politics, ideology and organization. Ideological and organizational work must be closely combined; must originate from the political line and tasks, while ensuring that the Party's political line and tasks are correctly defined, thoroughly understood and fully implemented. We must carry out Party building work and organize the masses to participate in Party building through the revolutionary movement of the masses and through the establishment of a regime of collective mastery of the masses. We must attach importance to perfecting the organization; we must link Party building with perfecting the organization, improving the capacity and effectiveness of State management, and with the building and consolidation of mass organizations and labor collectives. We must attach importance to building a contingent of cadres and Party members in terms of both quality and capacity; Arrange and use cadres according to the requirements of political tasks, manage cadres well, closely combine improving the quality of cadres and party members with improving the quality of grassroots party cells and party committees, with strengthening the leadership and perfecting the organizational apparatus at each level and each sector. In the work of developing the Party, it is necessary to attach importance to quality, fight against the tendency to simply pursue quantity; developing the Party always goes hand in hand with consolidating the Party; on the one hand, admitting excellent and qualified people; on the other hand, promptly removing from the Party degenerate and corrupt elements and those who are not qualified to be party members. Be vigilant to prevent opportunistic and reactionary elements from infiltrating the Party.
The Communist Party of Vietnam clearly recognizes its extremely heavy and glorious mission. Loyal to the interests of the working class and the nation, to proletarian internationalism, the Party is deeply loved and trusted by the working class and people of the whole country, and wholeheartedly supported by the working class and people of the world. Cadres and party members must not be complacent because of this; on the contrary, they must be extremely modest, strive to cultivate their qualities, revolutionary ethics and improve their capacity to truly "be worthy of being leaders, truly loyal servants of the people". 2).
The entire Party must make the Party steadfast in the face of all challenges, through all generations, forever a true Marxist-Leninist Party, worthy of Comrade Ho Chi Minh, the genius leader of the Party, of the working class and our people, the great national hero, the outstanding soldier of the international communist movement.
Chapter I
Party member
Article 1:
Vietnamese citizens aged eighteen years or older, who are working, not exploited, acknowledge and actively strive to implement the Party's political line and Statutes, are willing to work in a grassroots Party organization, obey Party discipline, are ready to accept all tasks assigned by the Party and pay Party dues as prescribed, can all be considered for recognition as Party members.
A person recognized as a Party member must be someone who has undergone training in the revolutionary movement and has proven to be the most outstanding person among the masses, and who meets the following criteria: has an awareness of communist ideals, has the right motivation to join the Party; is loyal to the Fatherland and to socialism; is exemplary and has a positive impact in labor, production, work, combat and study; has close ties with the masses and is trusted by the masses.
Article 2:
Party members have the following duties:
1.Sacrificed his whole life to fight for the independence and freedom of the Fatherland, for socialism and communism; strictly followed the Party's guidelines and policies.
We must strive with revolutionary enthusiasm and the highest sense of responsibility to effectively carry out Party resolutions and all tasks assigned by the Party.
Must be exemplary in production labor, reform and perfect socialist production relations, exemplary in work, combat and study; take the lead in absorbing and applying scientific and technical advances; find every way to increase labor productivity, work efficiency and combat effectiveness; actively protect the property of the State, the collective and the people, and fight against irresponsibility, waste and embezzlement.
2.Continuously study and practice to improve political awareness, revolutionary qualities and working capacity.
Each party member must strive to study Marxism-Leninism, the Party's guidelines and policies, culture, science, technology, and professional skills, and summarize work experience; constantly improve the capacity to organize and manage the economy and society.
We must constantly train ourselves in all aspects, practice diligence, thrift, integrity, impartiality, promptly correct shortcomings in work and revolutionary qualities; fight against individualism, degeneration, and all negative manifestations in lifestyle.
3.Always strengthen ties with the masses, promote the collective mastery of the masses, wholeheartedly serve the masses, put the interests of the Party and the people above personal interests.
We must respect and promote the collective mastery of the masses, care for the lives of the masses, unite with the masses, learn from the masses, understand their aspirations and listen to their opinions to honestly reflect them to the Party and promptly and appropriately resolve them.
Must support initiatives, research and application of creative experiences of the masses.
We must regularly carry out propaganda work, mobilize families and the masses to implement the Party and State's policies and guidelines, develop the Party's influence among the masses, and resolutely fight against bureaucracy, commandism, arbitrariness, authoritarianism, and being out of touch with reality and the masses.
We must strive to build the government, build the people's armed forces and mass organizations, strictly abide by the Constitution, the laws of the State, and the discipline of the revolutionary organizations we participate in.
4.Take care to build a strong Party in terms of politics, ideology and organization; strictly obey Party discipline.
All Party members must regularly participate in Party cell activities, actively contribute to building the Party's guidelines, policies and guidelines, protect and strengthen the Party's solidarity and unity; and resolutely fight against opportunism and factionalism.
Must unconditionally comply with the resolutions and assignments of the Party.
We must find really good people to cultivate their ideology, raise their awareness of the Party, and introduce them to the Party cell for help and consideration of admission into the Party.
We must self-criticize and criticize, resolutely fight against all thoughts and actions that are harmful to the interests of the Party and the revolution.
We must take care to protect the Party, protect its guidelines and policies, protect its organization and prestige, preserve Party and State secrets, and be vigilant against all enemy sabotage plots.
Must be honest with the Party, not conceal or report false information, and also not tolerate anyone concealing or reporting false information to the Party.
5.Upholding the spirit of proletarian internationalism, contributing to fulfilling the Party's international obligations.
Party members must strictly follow the Party's international line. They must demonstrate the spirit of proletarian internationalism in striving to fulfill their regular responsibilities to contribute to the fulfillment of the Party's international obligations.
All official and probationary party members must perform the above tasks.
Article 3:
Official party members have the right to:
1. Democratically and frankly discuss issues related to the Party's guidelines, policies, theories and practical work at Party conferences.
2. Vote on Party work; elect, run for election or be nominated to Party leadership bodies at all levels.
3. Criticize and question the work of cadres, party members and party organizations within the scope of the organization. For issues deemed necessary, they can report, express opinions or make complaints to the Party's leadership bodies and request a response.
4. For Party resolutions, one must comply unconditionally, but if one disagrees with any of them, one can still express one's opinion to the Party's leadership bodies up to the National Congress of Delegates.
5. To express opinions when the Party organization decides to discipline him or her or to make comments to make decisions about his or her activities or ethics.
Probationary party members enjoy the above rights, except the right to vote and the right to elect and run for election to the Party's leadership bodies.
Article 4:
Admission of people into the Party must be carried out one by one according to the following procedures:
1. People applying to join the Party must do so voluntarily, must submit an application to join the Party and must clearly and accurately report their personal history to the Party cell for consideration.
2. Must be guaranteed by two official Party members who have at least two years of Party membership and have worked together for one year or more to meet the criteria for Party membership. A member of the Ho Chi Minh Communist Youth Union, if discussed and judged by the Youth Union branch to meet the criteria for Party membership and guaranteed by the Executive Committee of the Youth Union at the grassroots level (enterprise, commune, ward, agency, school, etc.), only needs one official Party member who meets the above conditions to guarantee.
In special circumstances, the condition of working together for one year or more is exempted according to a specific regulation of the Central Executive Committee.
In places where there is a Ho Chi Minh Communist Youth Union branch, young people must be members to be admitted to the Party.
The guarantor must report to the Party about the background, qualities, and abilities of the person he/she is guarantoring and is responsible to the Party for his/her guarantees. If there are any unclear points, they must be reported to the Party organization for investigation and consideration.
People joining the Party must not violate the regulations of the Central Committee regarding political history.
3. Must be considered and decided by the Party cell conference to admit each person into the Party, with the consent of at least two-thirds of the official Party members of the cell.
Before the Party cell considers and decides to admit a new Party member, the Party cell and Party committee must carefully examine the background, level of enlightenment, qualities, abilities and motivations of the person applying to join the Party, to ensure that the person meets the criteria to join the Party.
It is necessary to organize to collect public opinions on people who want to join the Party, re-examine the propaganda work specifically for people applying to join the Party and ensure that those people have been thoroughly explained about the Party's Charter and have been thoroughly propagandized and educated about the Party's guidelines and policies.
After the Party cell decides to admit someone into the Party, it must announce it to the masses, except in special cases where confidentiality is required.
4. The resolution of the Party cell on admitting Party members must be agreed by the grassroots Party Committee (if any) and ratified by the immediate superior Party Committee of the grassroots organization (town Party Committee, district Party Committee, etc.).
Approval of party membership admission must be carried out on a case-by-case basis after carefully reviewing the conclusions of the party cell, public opinion, and compliance with party membership admission procedures.
5. A person admitted to the Party must undergo a probationary period. Recognition as an official Party member must be approved by at least two-thirds of the official Party members of the Party cell.
Some special procedures:
- In places where there is no grassroots party organization, the Party's higher-level leadership agency can directly admit party members, but must still follow the correct procedures: Those who want to join the Party must request and apply to join the Party, have two official party members with at least two years of party membership as guarantors, and be thoroughly re-examined by the responsible Party Committee before deciding to admit them into the Party and decide to recognize them as official party members. The guarantor can be a party member sent by the Party Committee for examination, propaganda, and education before proposing admission.
In places where there is a grassroots party organization but no official party member with two years of party membership, the guarantor can be a party member with two years of party membership assigned by the higher-level Party Committee to help the Party cell examine and consider applicants for Party membership if the Party cell agrees to admit them into the Party.
- For party members of other parties, the Central Executive Committee will decide on whether or not to admit them into the Party, depending on the circumstances. In case of admission, the Central Executive Committee will prescribe separate procedures.
Article 5:
The preparatory period is stipulated as follows:
1. The probationary period is twelve months.
2. The probationary period is calculated from the date the Party cell announces admission to the Party.
3. During the probationary period, the Party cell needs to continue educating, training, and testing the probationary Party member so that he or she is qualified to be recognized as an official Party member. The probationary Party member must be further trained in the necessary knowledge of Marxist-Leninist theory and the Party's guidelines and policies, the Party's organizational and operational principles, the relationship between Party members and the masses, the Party member's mass mobilization work, etc. The Party cell needs to assign prestigious and capable Party members to help that Party member progress.
Article 6:
At the end of the probationary period, probationary party members must be promptly considered for recognition as official party members. This must be proposed by probationary party members, discussed by the Party cell conference to consider each person individually and vote as when considering admission. If they are found to be unqualified to be recognized as official party members or if they are found to be unqualified for party membership before the end of the probationary period, their names will be removed from the list of probationary party members.
The resolution of the Party cell on recognition as an official Party member and removal of the name from the list of probationary Party members must be approved by the Party Committee with the authority to approve the admission of the person into the Party.
Party age of a party member is calculated from the date the party cell decides to recognize him/her as an official party member.
Article 7:
The issuance and revocation of party cards and the management of party members' party documents are regulated by the Central Executive Committee. Party members who move to another place must be introduced by the party committee in accordance with the procedures regulated by the Central Executive Committee to join the party organization of the new place.
Article 8:
If a party member makes a mistake or has shortcomings, the party organization must promptly educate or enforce party discipline. Those who are deemed unqualified to be party members must be promptly removed from the party in accordance with party procedures.
If a party member requests to leave the Party, the Party cell will decide to allow him to leave the Party and report to the higher level up to the level that approves the admission of the party member for re-examination.
Article 9:
Any party member who misses party cell activities or does not pay party dues for three consecutive months without a valid reason will have their name removed from the party member list and reported to the higher-level party committee up to the level that approved the admission of party members for re-inspection.
Chapter II
The principle of democratic centralism and the Party's organizational system
Article 10:
The Communist Party of Vietnam is organized according to the principle of democratic centralism. The fundamentals of that principle are:
1. The Party's leadership bodies at all levels are established through democratic elections.
2. The highest leadership body of the Party is the National Congress of Delegates, of Party committees at all levels is the Congress of Delegates at all levels, of grassroots Party organizations is the Congress of Delegates or Congress of Party members. Between two Congresses, the leadership body at each level is the executive committee elected by the Congress of the same level.
Executive committees must report and be responsible to their own congresses, to higher-level leadership bodies and lower-level party committees.
3. Party leadership bodies at all levels must properly implement the principle of collective leadership. Collective leadership must go hand in hand with individual responsibility, promoting the spirit of personal responsibility.
4. All Party work must be resolved by competent Party agencies, depending on the importance of each issue.
Issues regarding the Party's basic guidelines and policies, and issues of general importance to the whole country, must be decided by the Party's national leadership body (National Congress, Central Executive Committee). Issues under the responsibility and authority of localities must be proactively resolved by responsible local Party organizations within the scope of not contradicting the Party's guidelines and policies and decisions of higher levels.
5. Resolutions of Party conferences must be voted on by majority vote. Before voting, all Party members must present their opinions.
6. Party resolutions must be unconditionally implemented. Individual Party members must submit to the Party's organization and discipline, the minority must submit to the majority, lower-level organizations must submit to the competent organization at a higher level; Party organizations nationwide must submit to the National Congress of Delegates and the Central Executive Committee. Within the Party, there must be absolutely no factions.
Article 11:
The Party organization is established according to administrative units, production units or work units. Establishing a new Party Committee or abolishing an existing Party Committee must be decided by the immediate superior and reported to the next superior for information.
In special cases, party organizations in units under ministries and departments that operate mobile and dispersed within many localities, or have special circumstances that require confidentiality and cannot be handed over to the local party committee, can be placed under the direction of a committee appointed by the Central Executive Committee or the provincial or municipal party committee, or organized together with the grassroots party organization in the agency into a party committee of the ministry or department directly led by the party committee of the ministry or department. In cases where there are few party members in such units, they can be merged into the grassroots party organization of the ministry or department... to operate.
The Central Executive Committee shall strictly regulate the conditions for establishment, tasks, powers and dependent relationships of the above-mentioned Party organizations, and regulate the relationship between those organizations and local Party committees.
The system of directing grassroots Party organizations in central agencies and provincial and municipal agencies will be prescribed by the Central Executive Committee.
In areas or units of special economic, political, etc. importance, the Central Executive Committee may establish special Party organizations and prescribe the tasks, powers, and organization of those organizations.
In special and very limited cases, if decided by the Central Executive Committee, the Party organization can be established according to the vertical industry system.
Article 12:
The election of Party leadership bodies at all levels must ensure full democracy and must be carefully prepared so that the selection of members is accurate. It must ensure innovation and ensure succession and continuity in the executive committee.
The list of candidates and nominees must be discussed by voters. Voters have the right to comment and question necessary issues about the candidates, to vote or not to vote for each candidate. No agency or party member can force them. The list of candidates and nominees must be approved by the Congress.
The election shall be conducted by secret ballot. The Presidium of the Congress shall organize and direct the election in accordance with the principles and procedures.
Article 13:
Delegates attending congresses at all levels must be elected from bottom up.
The appointment of a number of delegates to attend the Congress is only carried out for a number of Party Committees operating under special conditions where it is not possible to hold a Congress of delegates to organize elections, according to specific regulations of the Central Executive Committee.
The list of delegates attending the Congress must be examined and decided by the Congress; the Party Committee cannot reject the qualifications of delegates nominated by lower levels. In cases where the nomination does not comply with the election principles prescribed by the Central Committee, a re-election must be held.
The Congress of Delegates must be attended by more than two-thirds of the officially summoned delegates, representing more than two-thirds of the Party members and more than two-thirds of the affiliated Party Committees, for it to be valid.
Article 14:
The National Congress and Congresses at all levels must be convened on time. Between two Congresses, in special cases, when it is necessary to decide on important issues or to add some members to the Executive Committee, the Central Executive Committee and the Executive Committees at all levels may convene a Conference of Delegates (National Conference of Delegates, Conference of Delegates of Provinces, Central-affiliated cities, cities, towns, districts, and counties). The Conference of Delegates includes members of the Party Committee at the convening level and delegates appointed by the Party Committee at lower levels according to the general regulations of the Central Executive Committee.
The resolution of the Delegates' Conference must be implemented by the Party Committee that convened the conference and by the lower-level Party Committees. If the Party Committee that convened the Delegates' Conference disagrees with the resolution on the work of the Delegates' Conference, it must seek the decision of the higher level. The resolution of the National Delegates' Conference must be approved by the Central Executive Committee. The members elected to fill the positions of the local Party Committees must be approved directly by the higher-level Party Committee.
Article 15:
The executive committees at district and above levels and the executive committees of grassroots party organizations with more than 500 party members include a number of official members and a number of alternate members. The executive committees of other grassroots organizations (party committees of enterprises, communes, agencies, schools, hospitals, etc.) may also have alternate members if deemed necessary and approved by the provincial and municipal party committees. Alternate members may attend and discuss at the executive committee meetings, but do not have voting rights.
When an official member of the executive committee at any level is lacking, the executive committee shall select from among the alternate members to replace him/her. If there are no more alternate members but there is still a vacancy, the Delegates' Conference shall elect a supplementary member or the higher-level executive committee shall appoint one.
The lower level executive committee must be directly approved by the higher level committee.
The higher-level executive committee, if absolutely necessary, may transfer or appoint a number of members of the lower-level executive committee. The number of these members shall not exceed one-third of the number of members elected by the lower-level congress.
For newly established party committees, if the Congress cannot be held immediately, the executive committee at a higher level shall temporarily appoint a provisional executive committee for those party committees and set a time within six months at the latest to hold a Congress to elect an official executive committee.
Article 16:
Party leadership bodies and superior leaders must regularly listen to the opinions of subordinate organizations and Party members, absorb their initiatives and experiences; must report and self-criticize to subordinates, and organize for subordinates and Party members to criticize and inspect their work.
Lower-level leadership agencies and cadres and party members must respect the centralized and unified leadership of superiors; must strictly, unconditionally and thoroughly comply with resolutions and directives of superiors and the collective; if there are different opinions, they must be presented to the competent authority of the same level or the higher level for consideration and decision, but at the same time must still absolutely comply. When encountering issues within the decision-making authority of superiors and the collective, they must propose opinions and promptly report and request instructions. At the same time, they must maximize their positivity and creativity to solve issues within their responsibilities.
Each organization and Party member must strictly implement internal democracy, properly exercise democratic rights within the Party, fight against all manifestations of democracy violations, authoritarianism, patriarchy, and frankly criticize and contribute opinions to the organization and Party leaders. Must firmly grasp the principle: the part must obey the whole, must not be partial, localist, or localist; localities, sectors, and organizations must promote the spirit of socialist cooperation and help each other in work.
Article 17:
Party organizations and Party members must speak and act according to Party resolutions, must not misinterpret them according to their own viewpoints, and must not propagate their own opinions on issues of guidelines, policies, and guidelines under the decision-making authority of the superior leadership agency and their own level.
The Party's press must propagate the Party's guidelines and policies, the resolutions of the Party Central Committee, of higher-level organizations and of its own level.
In mass conferences and in the press, cadres and party members, when expressing their opinions, must follow the Party's guidelines, policies and resolutions.
Article 18:
The Party Executive Committees at all levels, depending on the need, establish supporting agencies (Committees, Sub-committees, Executive Committees). The composition, tasks, powers and working methods of these agencies are decided by the Party Committees that establish them based on the general regulations of the Central Executive Committee.
In case of special matters, the Party Committees can set up special committees and then disband them once the work is done.
Party committees must build and make good use of committees, making them truly effective advisory bodies.
Chapter III
The highest leadership body of the Party
Article 19:
The National Congress is the highest leading body of the Party, convened by the Central Executive Committee, usually once every five years. In special circumstances, the Central Executive Committee may convene the Congress earlier or delay it for a period of time, not exceeding one year. In case of delay, the Central Executive Committee shall discuss collectively and clearly inform the Party committees at all levels of the reason.
If deemed necessary, or if more than half of the subordinate Party Committees request it, the Central Executive Committee shall convene an extraordinary National Congress of Delegates.
The number of official delegates and alternate delegates attending the National Congress and the method of candidacy and election are all decided by the Central Executive Committee based on the general political situation, the number of Party members and the importance of each subordinate Party Committee.
Before the National Congress, the Central Executive Committee raised issues to be discussed at the Congress for discussion by party committees at all levels.
Article 20:
The tasks of the National Congress of Delegates are: to review and approve the reports of the Central Executive Committee, to determine the Party's domestic and foreign policies and the most fundamental issues regarding the Party's situation and tasks in each period; to decide on supplements or amendments to the Party Charter; and to elect the Party Central Executive Committee.
Article 21:
Between two National Congresses, the Central Executive Committee is the highest leadership body of the Party. The term of the Central Executive Committee of the Party is 5 years.
The number of official members and alternate members of the Central Executive Committee is decided by the National Congress of Delegates.
Article 22:
The tasks of the Central Executive Committee are: to lead all work of the Party during the period between two National Congresses; to implement the resolutions of the National Congresses and the Party's Charter; to decide on important issues regarding the state plan and the Party's domestic and foreign policies; to represent the Party in contacting fraternal parties around the world; to establish specialized agencies, Party executive committees, and Party delegations in elected bodies of the State apparatus and of people's organizations of a national nature, and to lead the activities of such agencies and Party delegations; to manage and distribute cadres; to determine Party dues, and to manage and distribute Party finances.
The Central Executive Committee normally meets once every six months and every six months reports on the general situation and work done to its subordinates, and at the same time raises necessary issues for its subordinates to discuss and contribute opinions to the Central Committee.
Article 23:
The Central Executive Committee holds a plenary meeting to elect the Politburo and the Secretariat, and at the same time elects the General Secretary of the Central Executive Committee. The number of Politburo members and the number of Secretaries are decided by the plenary meeting of the Central Executive Committee. In addition to the official members, the Politburo has a number of alternate members.
The Politburo, on behalf of the Central Executive Committee, leads the Party's work between two Central Executive Committee plenary sessions on the basis of resolutions of the National Congress of Delegates and of the Central Executive Committee.
The Politburo, periodically and at the request of the Central Executive Committee, reports on its work to the Central Executive Committee.
The Secretariat leads the daily work of the Party, especially personnel work, Party member work and inspects the implementation of Party resolutions.
Chapter IV
Party organizations at the provincial, centrally-run city, city, town, district and county levels
Article 24:
The congresses of delegates of provinces and centrally-run cities (hereinafter referred to as directly-run cities) are convened by the executive committees of provincial and centrally-run cities (hereinafter referred to as provincial party committees and directly-run city party committees) every five years. The congresses of delegates of provincial cities (hereinafter referred to as cities), towns, districts and counties are convened by the executive committees at those levels (hereinafter referred to as city party committees, town party committees, district party committees and district party committees) every five years under the guidance of the Central Executive Committee. In special circumstances, the plenary conference of the executive committees at the above levels may be convened earlier or delayed for a period of time, not exceeding six months, but the reasons must be clearly notified to the lower-level party committees so that they can present their opinions and must be approved by the higher-level party committees. If more than half of the directly-run party committees still consider it necessary and possible to hold a congress of delegates, the plenary conference of the executive committee must discuss and decide to convene a congress of delegates.
Party committees at all levels must not delay convening a Congress of delegates due to normal difficulties. If deemed necessary, or if more than half of the subordinate Party committees request it and the higher-level executive committee agrees, the Party committee shall convene an extraordinary Congress of delegates. Before holding the Congress, the executive committee must present the issues to be discussed at the Congress for discussion by Party committees at all levels.
Article 25:
The tasks of the Congress of Delegates at all levels mentioned above are: to review and approve the reports of the Executive Committee; to discuss and decide on tasks and important work policies within the local scope; to discuss issues raised by the Central Executive Committee or higher levels, if any; to elect the Executive Committee and send delegates to attend the National Congress of Delegates or higher levels, if any. The number of official members and alternate members of the Executive Committee is determined by the Congress of Delegates based on the general regulations of the Central Executive Committee.
Article 26:
The term of office of the provincial and municipal Party Committees is 5 years. In the middle of the term, the Party Committees convene a conference of delegates with the tasks and powers specified in Article 14. At the district, county, provincial and municipal levels, there are two terms every 5 years according to the specific time guided by the Central Executive Committee.
The plenary meeting of the executive committee of a province or city directly under the province is convened by the standing committee every three months. The plenary meeting of the executive committee of a city directly under the province, town, district, or county directly under the province is convened twice every three months. In case of necessity, extraordinary meetings may be convened.
Article 27:
The tasks of the executive committee are: to strictly implement the Party's guidelines, policies and guidelines, the resolutions of the Party Congress, the resolutions and directives of higher levels, to lead local organizations to complete and over-fulfill the state plan and all local political tasks; to constantly care for building, consolidating the organization and promoting the role of the government and mass organizations, ensuring the people's right to collective mastery; to regularly care for building the Party in all aspects: politics, ideology and organization, improving the leadership quality and fighting strength of local Party organizations; to establish committees and executive committees of local Party committees and Party delegations and lead their activities; to care for building the local cadre team; to manage and distribute cadres, manage and distribute Party finances based on the regime prescribed by the Central Committee; to participate in building and concretizing the Party's guidelines and policies.
The executive committees must report on their general situation and work to the Central Executive Committee or the higher-level Party Committee within the time limit prescribed by the Central Committee and the higher-level Party Committee; and every three months, report on the general situation and work done to the lower-level Party organization; from time to time, at least once every six months, raise necessary issues for the lower-level to discuss in order to express opinions and criticize the leadership of the higher-level.
Article 28:
The plenary conference of the provincial Party Committee, the municipal Party Committee, the city Party Committee, the district Party Committee, and the county Party Committee elects the standing committee, secretary, and deputy secretaries.
The number of members in the Standing Committee and the number of deputy secretaries are decided by the plenary meeting of the Executive Committee based on a general regulation of the Central Executive Committee.
The Secretary of a provincial or municipal Party Committee must have at least 10 years of Party membership and must be approved by the Central Executive Committee. The Secretary of a municipal, town, district, or county Party Committee must have at least 5 years of Party membership and must be approved by the immediate superior Party Committee.
The Standing Committee is the body that represents the Executive Committee in leading all work of the Party Committee between two terms of the Executive Committee's plenary conference. It must report the general situation and work done to the Executive Committee periodically, at regular meetings of the Executive Committee and when deemed necessary.
The Secretary and Deputy Secretaries, based on the resolutions of the Executive Committee, the Standing Committee, and directives of higher levels, handle the daily work of the Party and organize inspections of the implementation of those resolutions and directives. The Secretary and Deputy Secretaries have a collective working regime based on the general regulations of the Central Executive Committee.
Chapter V
Grassroots Party Organization
Article 29:
Grassroots party organizations form the foundation of the Party, connecting the Party and its higher-level leadership bodies with the masses of workers, farmers, intellectuals and other working people. They are the places to educate, train, recruit and screen party members, train cadres for the Party, and are the starting point for electing Party leadership bodies at all levels, and the places to directly introduce the Party's guidelines and policies to the masses and organize the implementation of those guidelines and policies.
In each basic unit (enterprise, shop, cooperative, hospital, school, basic unit in the people's army, commune, ward, joint enterprise, scientific research institute, or company identified as basic unit, etc.) if there are three or more official party members, a basic party cell or party committee is established, commonly called a basic party organization.
If there are not enough three official party members, those comrades will be assigned to a nearby grassroots organization to participate in activities or a reserve party cell will be established if there are enough three official and reserve party members. The reserve party cell will discuss measures to implement the Party's policies and guidelines, and the resolutions and directives of higher levels in its unit. The reserve party cell will not decide to discipline party members or admit new party members, but will only present opinions on such work to the higher-level Party Committee.
In case a part of a joint enterprise (or scientific research institute, etc.) is located far from the location of the unit, the party organization in that part can be placed under the local Party Committee where that part operates. The Party Committee of the joint enterprise... is allowed to establish relations with the party organization in that part and with the local Party Committee to coordinate activities and exchange experiences.
Grassroots party organizations in communes, wards and towns include party organizations operating within the scope of a commune, ward or town.
Article 30:
The organizational form of the grassroots party organization, based on the requirements of leadership work and the number of party members, is stipulated as follows:
a) A grassroots party organization may consist of one or more party cells. A party cell is the basic cell organization of the Party, the nucleus of the Party's leadership and combat among the masses, the school that educates and trains all party members, the place where party members are admitted and disciplined, and the work of party members is assigned and inspected.
b) A grassroots party organization with thirty or fewer party members, after being decided by the immediate superior party committee, will establish a party cell and hold a party congress to elect a party cell executive committee (abbreviated as the party cell committee). The party cell can be divided into many party cells.
c) A grassroots party organization with more than thirty party members, after being decided by the immediate superior party committee, can hold a congress of delegates or a party member congress to elect the executive committee of the grassroots party organization (abbreviated as the grassroots party committee: party committee of an enterprise, commune, agency, etc.). Below the grassroots party committee, a number of party cells are established based on the production unit, work unit or place of residence. The party cell holds a party member congress to elect the branch committee.
In special cases, if a grassroots party organization does not have thirty party members, but due to the characteristics of production, work or location, it is considered necessary to divide into many party cells, it must be approved by the provincial or municipal party committee. Conversely, if a grassroots party organization has more than thirty party members up to fifty party members, it is not considered necessary to establish a grassroots party committee. If approved by the immediate superior party committee, it may consist of only one party cell.
d) In large grassroots units where an organizational part of that unit (such as a workshop in an enterprise, a department in a school, a bureau in a ministry, a cooperative in a commune with many cooperatives, etc.) has more than thirty party members, if the grassroots party committee deems it necessary and is approved by the immediate superior, the party organization in that part (such as the party organization in a workshop, department, bureau, cooperative, etc.) is divided into many party cells; the party organization in the part holds a party member congress or a congress of delegates to elect the executive committee of the party organization in the part (abbreviated as the party committee of the part such as: party committee of a workshop, department, cooperative, etc.).
Article 31:
The congress of delegates or the congress of party members of the grassroots party organization that has established a grassroots party committee is convened twice every five years, coinciding with the time of convening the congress of delegates of the party committees of the cities directly under the province, towns, districts, and counties. Between two congress terms, the grassroots party committee annually holds a conference of delegates, including delegates elected by the party cells and the party committees of the departments (if any), to decide on the tasks of the party organization and elect additional grassroots party committees if necessary. The congresses of party organizations in departments and of regular party cells meet once a year. In case of necessity, with the consent of the direct superior or at the request of more than half of the subordinate party committees, the grassroots party committee and the department party committee convene an extraordinary congress. Regular party cells meet once a month.
Article 32:
The congress of delegates or the congress of party members of the grassroots party organization, of the party organization in a department or of a party cell, reviews and approves the reports of the grassroots party committee, of the department party committee or of the branch party committee; discusses and decides on important work policies in its unit; discusses issues raised by superiors, if any; at the appointed time, elects the grassroots party committee, the department party committee or the branch party committee and elects delegates to attend the congress of delegates at a higher level, if any.
Article 33:
The term of office of the Party Committee and the Party Cell at the grassroots level (enterprise, commune, etc.) is regulated as for the term of office of the Party Committee at the district, county, city level under the province, town; the term of office of the Party Committee of the department and the Party Cell directly under the Party Committee at the grassroots level or directly under the Party Committee of the department is one year. The number of members will be decided by the Congress of Delegates or the Congress of Party members, based on the general regulations of the Central Executive Committee and the guidance of the higher level.
The grassroots party committee, the party committee of a unit within a grassroots unit, and the party cell elects the secretary and deputy secretary. Grassroots party committees with nine or more official members are elected to the standing committee. Before electing party committees, party cells, and grassroots party organizations, it is necessary to seek the opinions of the masses on those whom the masses consider worthy of being elected to the party committee.
A party cell with less than seven official party members only elects one secretary, and if necessary, a deputy secretary.
The secretary of the grassroots party committee and the secretary of the department party committee must have at least three years of party membership; the secretary of the grassroots party committee, the secretary of the department party committee, and the secretary of the party cell must be approved by the immediate superior party committee.
Article 34:
The basic tasks of the grassroots party organizations are:
1. According to one's leadership responsibilities, ensure that the Party's guidelines and policies, resolutions and directives of superiors, and the State's policies and laws are implemented at the grassroots level.
Grassroots party organizations in general must focus their leadership on completing and over-fulfilling the state plan, constantly consolidating and perfecting socialist production relations, carrying out socialist transformation (where it has not yet been carried out), strengthening management work, consolidating labor discipline, improving material and technical facilities and improving techniques, promoting ideological and cultural revolution, in order to increase labor productivity, work efficiency, combat effectiveness, and gradually improve the material and spiritual life of the masses.
2. Ensure the collective mastery of the masses, strengthen the connection between the Party and the masses, promote the positivity and creativity of the masses. Grassroots party organizations must take care to consolidate the organization and promote the role of the government and mass organizations, build and firmly grasp the people's armed forces and people's security forces of localities and units; constantly improve the awareness and level of all aspects of the masses, propagate and mobilize the masses to implement the policies and guidelines of the Party and the State, and comply with the laws of the State.
3. Regularly take care of building the Party organization in all aspects: politics, ideology and organization, strive to build Party committees and Party cells to truly become the political leadership nucleus of the Party at the grassroots level.
Regularly educate Party members about the qualities of a communist, take measures to raise the vigilance, revolutionary enthusiasm and all-round level of Party members; strengthen internal solidarity, carry out self-criticism and criticism; assign and inspect the work of Party members, strictly manage Party members, admit new Party members, and strictly enforce Party discipline.
4. Strive to build and work with superiors to build a team of grassroots cadres with good qualities, capacity, cultural knowledge, expertise, techniques, and profession, and to manage that team of cadres well.
5. Discuss and contribute opinions to decisions on issues related to the Party's general guidelines and policies; gather opinions and creative experiences of cadres, party members and the masses to reflect to superiors.
Grassroots party organizations must follow the regime, report the general situation and work done to superiors, collect party fees and submit finances to superiors according to regulations.
Article 35:
In production and business units, research institutes, hospitals, schools, etc., implementing the chief system, while carrying out the five common tasks of the grassroots party organization, the party organization must fully promote the chief system.
The grassroots party organization is responsible for inspecting the activities of the management agency and the leader, ensuring that the Party's guidelines, policies, resolutions, and the State's laws are thoroughly understood and strictly implemented. Through inspection, it is necessary to point out the advantages and disadvantages in the unit's work, raise issues considered necessary to help the leader study to promote or supplement, and fight against negative aspects, correct actions that are contrary to the Party's resolutions and the State's laws, create conditions to promote the unit's overall strength and improve the management effectiveness of the leader.
The unit's socio-economic (or professional or technical) plan is researched by the leader to propose to the superior. The Party organization must follow the Party's guidelines and viewpoints to lead and educate Party members and the masses to participate in developing the plan. The leader is responsible for reporting the plan project so that the Party Committee can give opinions and propose issues deemed necessary to the superior before the superior has the authority to decide.
The Party organization does not decide on specific targets of the plan and economic, technical, professional and operational measures under the management responsibility of the head. The head must direct the daily implementation of the plan according to the unit's organizational and management system.
The grassroots party organization must lead the party organizations and unions in the unit and mobilize and educate party members and the masses to fulfill their responsibilities to ensure that the unit's plans and the leader's orders are fully implemented.
Must lead the mass movement to compete in implementing the state plan on the basis of ensuring the unity between the interests of the state, the interests of the collective and the interests of the workers. Must lead the masses to fulfill their civic duties and responsibilities towards the unit, promote the creative experience of the masses, mobilize the masses to promote initiatives, discover and make good use of the potential of labor and available materials of the unit, apply scientific and technical achievements and advanced experiences in production, improve product quality, practice thrift, protect public and collective property, and fight waste and embezzlement.
The authority of the grassroots party committee in selecting and promoting cadres is prescribed by the Central Executive Committee.
Party organization at the agencydoes not decide on the tasks, policies, and professional measures of the agency, but is responsible for inspecting the agency in implementing the policies, resolutions of the Party, and State laws within the agency, promptly setting good examples, and preventing violations of policies and laws within the agency. Must inspect the situation of Party members in the agency, including Party members who are leaders, implementing the Party's guidelines, policies, resolutions, and State laws, promptly giving opinions to the leader on shortcomings in the agency's work, and reporting necessary issues to the responsible superior agency of the Party.
It is necessary to strengthen work discipline, participate and motivate cadres and employees to participate in improving the work of the agency, actively fight against bureaucracy, and do a good job of political and ideological education for party members and the masses. The Party Committee and Party Cell of the agency participate in giving opinions on the selection and promotion of cadres in the agency according to the regulations of the Central Executive Committee.
Article 36:
The grassroots party committees, department party committees, and party cells are responsible for representing the organizations that have elected them to unify the leadership of all aspects of work in the unit according to the functions prescribed for each type of grassroots party organization; implementing the resolutions of the Congress of Delegates, Congresses and Conferences of Party members in their units and the resolutions and directives of higher levels; leading the activities of subordinate party organizations; based on the regime prescribed by higher levels, managing the organization, cadres, party members and finances of the party organization; reporting to higher levels on behalf of grassroots party organizations according to regulations.
The Party Committee of grassroots Party organizations with 500 or more Party members, if approved by the provincial or municipal Party Committee, shall have the same rights as the district Party Committee in approving the admission of Party members and disciplining Party members. Other special cases must be stipulated by the Central Committee.
Chapter VI
Organizing the Party's leadership in the people's armed forces
Article 37:
The Vietnam People's Army and the Vietnam People's Public Security are under the direct, centralized, and unified leadership of the Party in all aspects according to strict regulations prescribed by the Central Executive Committee.
Party organizations in the Vietnam People's Army and the Vietnam People's Public Security operate according to the Party Charter and resolutions and directives of the Party Central Committee. We must constantly take care to enhance the working class nature of the People's Army and the People's Public Security, build armed forces that are infinitely loyal to the Fatherland and socialism, absolutely obey the leadership of the Party, closely unite around the Party Central Committee, closely associate with the working people, strictly abide by the Constitution and laws of the State, promote self-discipline, maintain internal solidarity, be ready to fight and fight to victory, firmly defend the socialist Fatherland, enthusiastically work to build the country and fulfill international obligations.
Article 38:
The Party organization in the Vietnam People's Army is organized vertically from the grassroots to the entire army, according to the regulations of the Central Executive Committee. The Central Executive Committee appoints the Central Military Party Committee. The Central Military Party Committee consists of a number of Central Executive Committee members working in and outside the army to lead all aspects of work for the entire army and assist the Central Committee in researching and proposing issues on military policies and tasks, building and strengthening national defense... according to the specific authorization and regulations of the Central Executive Committee. The Central Military Party Committee is under the leadership of the Central Executive Committee, which is often the Politburo and the Secretariat.
Party executive committees at all levels are democratically elected and approved by higher-level party committees. In special cases, according to regulations of the Central Executive Committee, they are appointed by higher-level party committees.
Party committees at all levels are responsible for leading all aspects of units under their authority within the scope of functions and contents prescribed for each level. Military region party committees also have the task of directing the building of all-people national defense in the military region. Provincial, municipal, and special zone party committee secretaries in the military region participate in the military region party committee.
The leading bodies of the Party organization must strictly adhere to the principles of democratic centralism, collective leadership coupled with individual assignment of responsibilities, ensuring strict implementation of the Party Committee's resolutions, orders and directives of the superior command body. On the basis of ensuring the collective leadership of the Party organization, the one-person command system is implemented at all levels in the army.
Party organizations and commanders in people's army units stationed in localities must respect and maintain close relationships with local party committees and authorities according to regulations of the Central Executive Committee.
At each level, there are political agencies and political cadres in charge of the Party's ideological and organizational work in the army, under the direct leadership of the Party Committee at their level and the direction of the political agency at a higher level. The General Political Department is the political agency of the entire army, operating under the leadership of the Secretariat and the regular leadership of the Central Military Party Committee.
The Central Organizing Committee, the Central Propaganda Committee and the Central Inspection Committee guide and inspect Party building and political work in the army.
Article 39:
Party organizations in local military agencies and local army units are established according to regulations of the Central Executive Committee. Party organizations in local military agencies and local army units are under the direct leadership in all aspects of the local Party Committee, and at the same time are subject to the direction of the higher-level military Party Committee and the guidance of the higher-level political agency according to regulations of the Central Executive Committee.
Article 40:
The Party's leadership in the security and police systems is organized, and the organization of the security system is prescribed by the Central Executive Committee.
Chapter VII
Inspection committees at all levels
Article 41:
The plenary conference of the Central Executive Committee, provinces, centrally-run cities, cities, towns, districts, counties and equivalent levels elects the Inspection Committee of its level, consisting of a number of members of the Executive Committee and a number of members outside the Executive Committee. In grassroots party organizations, the grassroots party committee elects the Inspection Committee.
The list of the lower-level Inspection Committee must be approved by the higher-level Party Committee.
Article 42:
The tasks of the Inspection Committees at all levels are: to inspect Party members (including members of the same-level Party Committee) in compliance with the Party Charter, aiming at compliance with the principles of Party organization and activities, compliance with Party discipline and State laws, and Party member qualifications; to inspect the implementation of discipline by lower-level Party organizations; to inspect Party finances; to resolve denunciations against Party members on issues related to the above-mentioned work and complaints about the implementation of Party discipline; to decide, approve, change or remove discipline against Party members based on the authority prescribed in Chapter X. The Inspection Committees of grassroots Party organizations (where they are permitted to be established) are not authorized to approve or remove discipline against Party members, but only inspect and consider to propose opinions on such work to the grassroots Party Committee and the Inspection Committee at higher levels.
Article 43:
Inspection Committees at all levels work under the leadership of Party committees.
The Inspection Committee at a higher level has the right to inspect the work of the Inspection Committee at a lower level, and to approve, change or annul the decisions of the Inspection Committee and of the Party organizations at a lower level on disciplinary cases against Party members according to the provisions of Chapter X of the Party Statute.
Chapter VIII
Party leadership over state organizations and mass organizations
Article 44:
The Party leads the State comprehensively through the Party's guidelines and policies, through the Party's resolutions and directives on the main goals, policies and measures in all areas of State and social activities, and on the most important issues in organizational and personnel work. The Party's guidelines and policies must be reflected in the Constitution and laws of the State. The Party inspects the operation of the State apparatus, educates and mobilizes the masses, enthusiastically builds the government, complies with the Constitution and laws, and implements the State plan. The Party requires Party organizations and Party members to respect the authority, responsibilities and regimes of State agencies, strictly comply with the laws and decisions of the State, and consider them Party discipline.
Article 45:
The Party constantly consolidates and strengthens its leadership over mass organizations and unions by making the Party's guidelines, policies and resolutions, and the State's laws thoroughly understood and transformed into voluntary actions of the masses, through the work of education, propaganda, mobilization and persuasion of cadres and Party members in those organizations. The Party regularly points out to mass organizations the requirements, tasks and important tasks that need to be mobilized for the masses to carry out in each period; constantly makes Party and State organizations respect and promote the positivity, proactiveness and creativity of mass organizations; organizes the masses to participate in Party building, government building and economic and State management.
Article 46:
In the leadership bodies of the State and of elected mass organizations (such as the National Assembly, People's Councils at all levels, executive committees of mass organizations, except the Ho Chi Minh Communist Youth Union), the Party establishes party groups consisting of party members or a number of party members operating in the above-mentioned organizations.
The task of the Party delegation is to persuade and mobilize the masses to implement the Party's guidelines, policies and resolutions, to increase the Party's influence, to strengthen solidarity and close ties between cadres, Party members and non-Party members in the organizations in which it operates, to conduct research to propose to the Party Committee to decide on the direction and policies of work for that organization and to manage cadres according to the regulations of the Central Committee.
The Party delegation has a secretary and, if necessary, a deputy secretary; the secretary and deputy secretary of the Party delegation are appointed by the Party Committee. The Party delegation is subject to the leadership of the Party Committee, collectively makes decisions and is responsible to the Party Committee.
Through the introduction of Party committees at all levels, the upper-level Party committees and the lower-level Party committees can contact each other to exchange opinions and work experiences.
The organization, powers and specific tasks of the Party delegation will be prescribed by the Central Executive Committee.
Chapter IX
Party to Ho Chi Minh Communist Youth Union
Article 47:
The Ho Chi Minh Communist Youth Union is the right-hand man and reliable reserve force of the Party, and the communist school of the youth.
The Youth Union has the task of organizing the youth into a vanguard force leading in all new, difficult and complicated areas of revolutionary activities, actively contributing to propaganda, inspection and struggle to properly and effectively implement the Party's guidelines, policies and resolutions. While implementing the Party's policies and guidelines, the Youth Union's organization needs to pay attention to presenting its opinions and experiences to the Party organization.
The Youth Union must educate Marxism-Leninism, the Party's guidelines and policies, educate about the Party for union members and the young generation, nurture outstanding union members to become party members and train the core members of the Youth Union to become cadres to provide for the Party and the requirements of the revolutionary cause.
Article 48:
The Ho Chi Minh Communist Youth Union operates under the direct leadership of the Party.
The Central Executive Committee and all levels of the Youth Union are under the direct leadership of the Central Executive Committee and the Party Committee at the same level. The Youth Union organizations must report their general situation and work to the Party Committee at the same level.
Article 49:
The Party's organizations at all levels have the task of leading the Youth Union's organizations at all levels in all aspects: in educating members about Marxism-Leninism and the Party's guidelines and policies, in maintaining close ties between the Youth Union and the majority of young people, in building and consolidating the organization, improving the form and methods of the Youth Union's activities, in training, selecting and promoting the core leaders of the Youth Union...
In its leadership work, the Party organization must firmly grasp the nature, position, role and function of the Youth Union, and pay full attention to the characteristics of the youth masses. It must actively promote the collective mastery of the youth and the initiative and creativity of the Youth Union organization.
Article 50:
After a member of the Ho Chi Minh Communist Youth Union is admitted to the Party and recognized as an official Party member, if he/she does not perform leadership or professional work in the organization of the Union and if deemed necessary, the Party cell will resolve the matter for the Party member to leave the organization of the Union.
Chapter X
Party discipline enforcement
Article 51:
Party discipline is to maintain the unity of the Party's will and action and to strengthen the Party's fighting strength. The enforcement of discipline is to ensure strict Party discipline, and at the same time to educate Party members and Party organizations that have made mistakes, to educate other Party members and cadres, and to educate the masses. Any manifestation of laxity in Party discipline weakens the Party, destroys the Party's organizational cohesion and unity, and weakens the relationship between the Party and the masses and the effectiveness of the proletarian dictatorship system. Party organizations and Party members must firmly grasp the motto of fairness, accuracy, and timeliness and fight against any deviation in the enforcement of Party discipline.
Article 52:
Depending on the specific situation, level and nature of the mistakes of the Party members and the Party organization, the competent Party organization will apply the following disciplinary measures:
For party members: reprimand, warning, dismissal, expulsion from the Party.
For Party organizations: reprimand, warning, dissolution.
Article 53:
On disciplinary authority:
1.For each party member:
- Discipline for party members must be discussed and decided by the Party cell conference. If the form of expulsion from the Party is used, it must be approved by at least two-thirds of the total number of official party members and approved by the competent Party Committee for admission. The Inspection Committee of the district Party Committee and the equivalent Party Committee can approve, change or abolish the implementation of discipline by the grassroots Party organization for party members; the form of expulsion from the Party must be approved by the Party Committee.
- Disciplinary action against party members who are cadres managed by higher-level Party committees, but are not members or alternate members of Party executive committees at all levels, must be resolved by the Party cell or competent authority depending on the scope of the mistake (according to regulations of the Central Committee).
In cases within the scope of disciplinary enforcement of the Party cell, the Party cell has the right to decide on forms of reprimand and warning. As for disciplinary measures such as dismissal from office, expulsion from the Party or in cases of mistakes not within the scope of disciplinary enforcement of the Party cell, the Party cell or the Party organization (committee, Party delegation, Party committee) where the cadre works shall propose to the Party Committee managing the cadre or to the Inspection Committee of that Party Committee. The Inspection Committee shall decide on forms of reprimand and warning based on the disciplinary enforcement proposals of the above-mentioned Party organizations.
- Disciplinary action against members and alternate members of the executive committees at all levels (including members of the Party Central Committee) in the forms of reprimand, warning and removal from positions under the decision of the executive committee must be decided by the plenary meeting of the executive committee. If the action is in the form of removal from office of official members or alternate members, expulsion from the Party, it must be decided by the Congress of delegates or the Congress of Party members. Between two congresses, it must be decided by the plenary meeting of the executive committee, with the consent of at least two-thirds of the official members and must be approved by the immediate superior committee; at the nearest congress, the committee must report to the congress.
For members or alternate members of the Party Executive Committee at all levels, if the disciplinary violation is within the scope of the Party cell, the Party cell has the right to decide on the form of reprimand or warning and report to the Party Committee of which the member is a member for approval; as for other forms of discipline, the Party cell has the right to propose.
Disciplinary action against a branch committee member must be decided by the Party cell conference, but in the case of dismissal from office of a branch committee member, it must be approved by the higher-level Party committee; if expelling from the Party, it must be approved by the Party committee with the authority to approve the expulsion of the Party member.
- In case it is deemed necessary, after requesting a lower-level Party cell or Party Committee to consider and decide on disciplinary action against a Party member (including a Party Committee member) whose Party cell or Party Committee has not properly enforced discipline or has not enforced discipline, the higher-level Party Committee, after careful consideration, may decide to raise the level of discipline or enforce discipline against the Party member, and, according to the regulations of the Central Committee, report to the higher-level Party Committee or Inspection Committee for approval for forms of discipline under the approval authority of the higher-level.
- In addition to the above provisions, the Central Executive Committee will specify the scope of authority of the Inspection Committees at all levels in approving, changing or abolishing decisions of lower-level Party organizations on disciplinary actions against Party members.
2.For the Party organization:
Disciplinary action against a Party organization must be decided by the superior leadership of that organization after listening to the organization's self-criticism and presentation of its opinions on its strengths and weaknesses.
The dissolution of a Party cell or a grassroots Party organization must be considered and approved by the plenary meeting of the Executive Committee of a province or centrally-run city based on the proposal of the municipal Party Committee, district Party Committee, county Party Committee or the superior Party Committee of the grassroots organization after direct and careful inspection and consideration. That decision must be reported to the Central Executive Committee.
The implementation of disciplinary measures to dissolve a Party Committee must be decided by the plenary meeting of the Executive Committee at the next higher level, with the consent of at least two-thirds of the official members of the Executive Committee and approved by the higher level of the Party Committee that decided on the dissolution; for provincial Party Committees, municipal Party Committees and Party Committees directly under the Central Committee, it must be decided by the Central Executive Committee.
A party organization shall only be dissolved in the following cases: two-thirds or more of its members or official committee members have committed mistakes to the extent that disciplinary action of expulsion from the Party is required; the organization has acted consciously against the Party's line, or there is sufficient evidence that it is no longer politically trustworthy.
Party members who have no shortcomings or have not made mistakes to the extent of being expelled from the Party in dissolved Party cells or organizations will be allowed by the competent Party Committee to re-register in the newly established organization, if any, or be introduced to participate in activities in another Party cell.
Article 54:
The enforcement of Party discipline must be strictly and promptly ensured. However, when deciding to discipline Party members and Party organizations, especially when deciding to expel them from the Party or dissolve the organization, which are the highest forms of Party discipline, responsible Party organizations must be extremely cautious; must investigate and research thoroughly, delve into the nature, avoid looking only at the phenomenon, and must base it on authentic evidence. Before deciding to discipline, the competent organization must listen to the disciplinary offender or the representative of the organization being disciplined to present their opinions.
After the disciplinary measure has been officially decided or approved, the reason for the action must be explained to the person or organization subject to the disciplinary measure; if the person or organization subject to the disciplinary measure does not agree, within six months, it has the right to request the organization that decided or approved the disciplinary measure to reconsider and may appeal to the Party Committee or the Inspection Committee at a higher level of that organization. After that, if deemed necessary, it may appeal to the Central Executive Committee of the Party.
Party agencies, when receiving complaints requesting resolution or requesting to be forwarded to higher levels, must promptly resolve or forward them, and must not ignore them. Upon receiving a complaint, the responsible agency must notify the sender, and at the latest within one month must organize an investigation and study for consideration. Lower-level Party committees must periodically report to higher-level Party committees every three months the number and status of the settlement of complaints about discipline of Party members and Party organizations; higher-level Party committees must organize inspections of the settlement of such complaints by lower-level Party committees.
Article 55:
When a resolution to expel a Party member from the Party or to dissolve a Party organization has not been approved by a competent Party Committee, that Party member is still allowed to participate in Party activities and that organization is still allowed to operate. The temporary suspension of a Party member's Party activities, the temporary suspension of a Party Committee member's Party Committee activities, or the temporary suspension of a Party organization's activities may only be applied in extremely special cases and must be approved by a competent Party Committee as prescribed by the Central Committee.
Article 56:
Party members who violate State laws must be subject to strict discipline by the Party and State; no one is allowed to condone or cover up.
In the event that a Party member is prosecuted in court, the competent Party organization will promptly consider the implementation of Party discipline and their crimes will be tried by state administrative or judicial agencies. If the Party member is sentenced to prison, the Party organization must expel him from the Party.
In the event that a party member is arrested or wrongly prosecuted, after there is sufficient evidence to conclude that he or she has been wrongly prosecuted, the party organization or government organization must clear the name and restore all legitimate rights that have been deprived.
Article 57:
No later than one year after a Party member is disciplined, the Party organization that decided to discipline or the Party cell where the Party member is active must listen to the Party member's report on the situation of correcting shortcomings in order to reach a conclusion on such correction; if it is determined that the Party member has truly corrected and made progress, it will decide or propose to the higher level that decided to discipline to recognize the Party member's correction of shortcomings. The Party organization has no prejudice in using or promoting such Party members.
Chapter XI
Party Finance
Article 58:
The Party's finances include party dues paid by party members and other party income as prescribed by the Central Executive Committee.
Article 59:
The Central Executive Committee decides on the regime of collecting party dues according to the ratio of each type of basic income of party members.
Article 60:
The Party's finances must be unified. The Central Executive Committee shall establish a Party financial agency and strictly regulate the principles of revenue, expenditure and financial management of the Party. The financial agency shall have the right to inspect the financial operations of Party organizations at the same level and of lower-level Party organizations, and shall be subject to financial inspection by the Inspection Committee at a higher level or the Inspection Committee at the same level.
Party committees at all levels must submit their financial revenues to higher levels at the rate prescribed by the Central Executive Committee and must strictly comply with the Party's financial principles and regulations.
Chapter XII
Comply with the Party's regulations
Article 61:
Every Party member and Party organization must carefully study and strictly comply with the Party Charter and promptly combat all violations of the Party Charter.
Article 62:
Only the National Congress has the right to amend this Charter.
