Solution: Within 3 months from June 2, 2017, Thanh Tam Hospital Joint Stock Company is required to submit a report explaining the delay in completion progress and project activities not in accordance with investment objectives; Prepare a dossier requesting adjustment of planning, project adjustment (if any) and commitment to project completion progress, and send it to the Provincial People's Committee for consideration. If by September 1, 2017, the Investor does not have a dossier or report explaining to the Provincial People's Committee, the Department of Natural Resources and Environment shall advise the Provincial People's Committee to revoke the Land Use Right Certificate and handle it according to the provisions of law.

In recent days, after accessing a number of files and documents related to the Thanh Tam Traditional Medicine Hospital project, Nghe An Newspaper reporters noticed unusual signs in investment activities in this project.

Specifically, the Inspection Minutes made by the Interdisciplinary Inspection Team at 3:00 p.m. on April 13, 2017 showed that at this time, Thanh Tam Hospital Joint Stock Company had transferred shares, changed shareholders and legal representatives. As for the Thanh Tam Traditional Medicine Hospital project, it was only a nominal name, but in essence, the land area for the project was 2,900.6m2 wide.2The Xo Viet Nghe Tinh Avenue has been used as a base for the 115 Emergency Transport Team, belonging to the 115 Hospital Joint Stock Company with 25 ambulances and 60 officers and employees. The interdisciplinary inspection team commented: "Currently, the enterprise has built a gate, surrounding fence, a 3.5-storey operating house and is using it as a base for the 115 Emergency Transport Team. The project enjoys investment incentives, but the investor is behind schedule compared to regulations, violating land use purposes...".

Participating in the 2017 Interdisciplinary Inspection Team were representatives of the Department of Planning and Investment, Finance, Construction, Natural Resources and Environment, Vinh City People's Committee, and Nghi Phu Commune People's Committee. Looking at the opinions of the members of the team, the opinions of the representatives of the departments basically agreed with the above comments. However, exactly 8 months later, although the project land still only had a gate, surrounding fence, garage, and 3.5-storey management building, in the Submission No. 10/TTr-Cty dated December 13, 2017, Director of Thanh Tam Hospital Joint Stock Company Pham Thi Kim Diep reported to the Provincial People's Committee that the total investment capital implemented at the Thanh Tam Traditional Medicine Hospital project was 12,225 billion VND!

Some key shareholders of Hospital 115 Joint Stock Company have bought back shares of Thanh Tam Hospital Joint Stock Company. The shareholders of the Company have requested to invest in the approved project but need to adjust the construction planning and usage functions to suit the needs and actual situation. Therefore, the investment and construction of the project is behind schedule according to the approval document". To propose: "Allow the investor to continue investing in the construction of the approved project, Thanh Tam Traditional Medicine Hospital, and adjust the construction planning and usage functions of the project".

On September 17, 2018, the wish of Thanh Tam Hospital Joint Stock Company was fulfilled. The Thanh Tam Traditional Medicine Hospital project has been adjusted to a detailed construction plan at a scale of 1/500 by Decision No. 4161/QD-UBND of the Provincial People's Committee. Within the scope of this article, we do not mention the adjusted contents, only mention the requirements of the Provincial People's Committee (in Article 2, Decision No. 4161/QD-UBND) for the investor and related departments, branches and Vinh City People's Committee, Nghi Phu Commune People's Committee as follows:“1. Organize the implementation of the project in accordance with the construction planning approved by the competent authority, on schedule as committed, ensuring quality; fully comply with legal regulations during the project implementation process... 2. The Departments: Planning and Investment, Finance, Construction, Natural Resources and Environment, Tax Department; Vinh City People's Committee, Nghi Phu Commune People's Committee are responsible for guiding and supervising the implementation of the planning, fulfilling obligations to the State, investing in construction, using land and operating in accordance with regulations".

However, from September 2018 until now, the Thanh Tam Traditional Medicine Hospital project, through the field inspection of the 2022 Interdisciplinary Inspection Team, was that "at the time of inspection, the project had built a gate, fence, garage, 3.5-storey operating house"; and the land for implementing the project was still "used as a base for the Emergency Transport Team...". These things have shown that, if the previous investor "draws" a project to lease land with the goal of transferring for profit, the later investor is inconsistent, disrespectful to the government and functional agencies, and disregards the law. At the same time, it is also necessary to be frank that, over many years of project delays, land use for the wrong purpose..., there are signs of lax management from some state agencies!
