Review the current status of agricultural and forestry company land

In recent times, when some units have been converted into joint stock companies following the pilot policy of equitizing orchards, planted forests, and livestock herds associated with the equitization of processing facilities, many localities and units have strictly managed and effectively used land (reviewing the current status, making plans and land use plans, completing procedures to be granted land use right certificates and switching to land lease).

However, after equitization, some localities and units have not strictly managed and effectively used the allocated land, have not reviewed, planned and completed procedures to transfer land from state-owned enterprises to joint stock companies, so land management has been lax, and the situation of encroachment and illegal transfer has become complicated.

To overcome the above situation, the Prime Minister requested the People's Committees of provinces and centrally run cities to preside over and coordinate with the Ministry of Natural Resources and Environment and the Ministry of Agriculture and Rural Development to urgently review and inventory the current status of land and develop a land use planning plan for the land area that has not been handed over to joint stock companies or handed over to local management after the reorganization and equitization of state-owned enterprises (companies, state-owned forestry farms).

In addition, report on the current status and evaluate the effectiveness of land management and use since the handover of the land area handed over to local management.

Review the area handed over to the joint stock company to clearly determine the land area that the joint stock company still needs to use and the land area that is no longer needed to produce raw materials for the processing facility.

On that basis, approve land use planning, issue land use right certificates and sign land lease contracts according to current regulations for the land area that the joint stock company still needs to use for the production of raw materials for the processing facility. Or request the joint stock company to complete procedures to hand over to the locality the land area that is no longer needed for the production of raw materials for the processing facility for planning and management according to current regulations.

People's Committees of provinces and centrally run cities urgently deploy and complete the above tasks, prepare reports and send them to the Ministry of Natural Resources and Environment and the Ministry of Agriculture and Rural Development before November 30, 2012.

The Ministry of Natural Resources and Environment shall preside over and coordinate with the Ministry of Agriculture and Rural Development to inspect and urge the People's Committees of provinces and centrally-run cities to implement, ensure progress and synthesize, propose and report to the Prime Minister before December 31, 2012.

State-owned agricultural and forestry farms that have been equitized immediately carry out a review of the current land status.

At the same time, the Prime Minister also requested the Ministry of Agriculture and Rural Development to direct the equitized agricultural and forestry companies (state-owned farms and forestry farms) belonging to the Vietnam Tea Corporation, Vietnam Livestock Corporation, and the Fruit and Vegetable - Agricultural Products Corporation to work with the Department of Natural Resources and Environment of provinces and cities to receive guidance and immediately implement the review of the current land status and establish land use planning according to the provisions of Decree No.170/2004/ND-CPSeptember 22, 2004, Decree No.200/2004/ND-CPdated December 3, 2004 of the Government and the Land Law, submitted to the People's Committee of the province or centrally-run city for approval, and at the same time carried out procedures for granting land use right certificates and transferring to land lease for the assigned area that the company is continuing to manage and use to produce raw materials for the company's processing facilities.

The Ministry of Agriculture and Rural Development must inspect and urge relevant units to complete the above work and report the implementation results to the Prime Minister before November 30, 2012.
