New regulations on preferential treatment for people with revolutionary contributions
The Government has just issued Decree 31/2013/ND-CP detailing and guiding the implementation of a number of articles of the Ordinance on Preferential Treatment for People with Revolutionary Contributions. Accordingly, people who participated in revolutionary activities before the August Revolution in 1945 are entitled to monthly allowances and subsidies; when they die, their relatives will receive funeral expenses and one-time allowances; biological fathers, biological mothers, wives or husbands, children under 18 years old, children over 18 years old but still in school or with severe disabilities or especially severe disabilities who have reduced working capacity will be entitled to monthly death benefits.
Relatives of a martyr are entitled to a monthly pension equal to one standard rate. Similarly, relatives of two martyrs are entitled to receive two standard rates and those of three or more martyrs are entitled to receive three standard rates. If a martyr's spouse marries another person, he or she is entitled to a monthly pension equal to one standard rate. Relatives of martyrs entitled to a monthly pension include biological fathers, biological mothers, people who have raised the martyr, children under 18 years old, children over 18 years old but still in school or with severe disabilities, with a working capacity reduction of 61% or more and a monthly income lower than 0.6 times the standard rate, a martyr's spouse who marries another person but raises the martyr's children to adulthood or takes care of the martyr's parents while they are still alive. In cases where there is no one left to receive a monthly pension, the person who worships the martyr is entitled to a one-time annual pension of 500,000 VND.
Heroic Vietnamese mothers are entitled to a one-time allowance and a monthly allowance, and those living with their families are entitled to a service allowance. When a Heroic Vietnamese Mother dies, the person organizing the funeral will receive funeral expenses, and the family representative will receive a one-time allowance equal to 3 months of allowance and preferential allowance. The monthly service allowance for a Heroic Vietnamese Mother is equal to one standard amount.
Heroes of the People's Armed Forces and Heroes of Labor during the resistance war are entitled to monthly allowances. When they die, the person organizing the funeral will receive burial expenses and a one-time allowance equal to three months of preferential allowances. If a Hero of the People's Armed Forces or Heroes of Labor during the resistance war dies without receiving preferential treatment or posthumous awards, their relatives will be entitled to a one-time allowance.
War invalids (sick soldiers) whose ability to work is reduced due to injury (illness) of 81% or more are entitled to monthly allowances or special allowances when they have particularly serious injuries. If they live with their families, they are entitled to additional allowances for caregivers. Injured people whose ability to work is reduced due to injury of 5% to less than 21% are entitled to a one-time allowance. When a war invalid or sick soldier dies, the funeral organizer is entitled to receive funeral expenses, and the family representative is entitled to a one-time allowance equal to three months of allowance or preferential allowance. When a war invalid or sick soldier whose ability to work is reduced due to injury (illness) of 61% or more dies, the family is entitled to a monthly survivor's allowance.
Resistance fighters infected with Agent Orange are entitled to monthly allowances ranging from 0.76 to 2.28 times the standard level, depending on the severity of the injury. If a resistance fighter infected with toxic chemicals has a working capacity reduction of 81% or more due to illness, he or she will receive the same benefits as a sick soldier with the same rate of reduced working capacity. When a resistance fighter infected with toxic chemicals dies, the benefits will be calculated as for a sick soldier. Children of resistance fighters infected with Agent Orange are entitled to monthly allowances ranging from 0.6 to one time the standard level, depending on the severity of reduced working capacity.
Revolutionary or resistance activists who are captured or imprisoned by the enemy are entitled to a monthly allowance equal to 0.6 times the standard rate. Upon death, the person organizing the funeral is entitled to receive funeral expenses, and the family representative is entitled to a one-time allowance equal to 3 months of preferential allowance or equal to 1.5 times the standard rate if they have not previously enjoyed preferential treatment.
People who participated in the resistance war to liberate the nation, protect the Fatherland and perform international duties are entitled to a one-time allowance based on the time they participated in the resistance war. When they die, the person who organizes the funeral is entitled to receive funeral expenses.
People who have contributed to the revolution and are awarded the Resistance Medal are entitled to a monthly allowance; when they die, the person who organizes the funeral will receive burial expenses, and relatives will receive a one-time allowance equal to 3 months of preferential allowance. People who have contributed to the revolution and are awarded the Resistance Medal are entitled to a one-time allowance; when they die, the person who organizes the funeral will receive burial expenses.
In addition, the Decree also specifies the conditions and time for receiving subsidies as well as other forms of subsidies. The Decree takes effect from June 1, 2013.
