Forcing children to beg will be fined 15 million VND

The Prime Minister has just issued Decree No. 144/2013/ND-CP on regulations on administrative sanctions for violations in social protection, relief, and child protection and care.

Accordingly, the act of putting images of children in cultural, information and communication products with pornographic, violent and horror content will be subject to the highest fine of 40-50 million VND, along with the administrative penalty of forcing the destruction of these products.

Regarding penalties for child protection and care, this decree stipulates administrative penalties for acts of child abuse, exploitation, enticing children to commit illegal acts, failing to provide medical examination and treatment for children, abandoning children, violating child care, etc.

The Decree stipulates that the acts of organizing or forcing children to beg; renting or borrowing children or using children to beg will be fined from 5-15 million VND. The act of forcing children to wander around to make a living will also be fined from 5-10 million VND.

Acts of insulting, cursing, scolding and forcing children to do things that offend their honor and dignity will be fined from 5 to 10 million VND.

Regarding medical examination and treatment for children, the act of refusing to examine and treat children according to regulations or in emergency cases will be fined from 10-15 million VND and have the license or practice certificate revoked for 3-6 months.

Failure to identify congenital defects in newborns will also be subject to a fine of 3-5 million VND.

Violations of regulations on the operation of child care facilities and facilities for raising disabled children will also be fined from 5 to 20 million VND.

Establishments that produce and trade toxic products within the scope of children's care, education, and entertainment facilities will be fined 20-25 million VND, have their operating licenses revoked for 3-6 months, and must change or dismantle the construction.

Unsafe behaviors in production, business, and transportation that lead to accidents and injuries to children, such as: Not placing signs or barriers to promptly indicate dangerous areas... will be fined from 10 to 20 million VND.

Decree No. 144 also stipulates specific penalties for acts of falsifying policy beneficiary records, fraud, appropriation of relief money and goods, mistreatment of policy beneficiaries, people with disabilities, the elderly, etc.

Fraudulent acts and falsification of documents to enjoy policies for people with disabilities and social protection beneficiaries will be fined from 10 to 15 million VND.

Violations of regulations on education, labor, employment, and transportation policies for the elderly and people with disabilities will also be fined from 5-20 million VND.

Regarding the management of relief money and goods, if there is loss, damage or misuse, the fine will be from 5-10 million VND and the illegal profits will be returned.

This Decree takes effect from December 15, 2013 and is assigned to the Minister of Labor, War Invalids and Social Affairs to guide its implementation./.
