Violation of industrial property, fine up to 500 million VND

This is a provision stated in the Decree regulating administrative sanctions for violations in the field of industrial property recently issued by the Government.

According to the Decree regulating administrative sanctions for violations in the field of industrial property recently issued by the Government, the maximum fine for individuals is 250 million VND, and for organizations is 500 million VND.

For the same administrative violation, the fine for an organization is twice the fine for an individual.

Deliberately giving false appraisal conclusions will be fined up to 20 million VND.

According to the Decree, a warning or a fine of VND 500,000 to VND 1 million shall be imposed for one of the following acts: Violating regulations on procedures, appraisal procedures, and time limits for industrial property appraisal; failing to appear upon summons from the appraisal requesting agency without a valid reason; failing to explain appraisal conclusions upon request of the appraisal requesting agency.

Fines from 2 to 5 million VND for acts of modifying or falsifying the content of appraiser cards or certificates of organizations qualified to conduct industrial property appraisal activities.

For one of the following acts: Taking advantage of appraisal qualifications and appraisal activities for personal gain; intentionally giving false appraisal conclusions; arbitrarily correcting, erasing or otherwise distorting appraisal documents... will be fined from 10 to 20 million VND.

Severe penalties for trademark infringement

The Decree also stipulates a warning or a fine of VND 500,000 to VND 2 million for the act of selling; offering for sale; transporting, including transiting; storing; displaying for sale goods and services (for business purposes) that infringe upon the rights to trademarks, trade names, geographical indications, and industrial designs, in cases where the value of the infringing goods and services is up to VND 3 million.

Fines from 2-250 million VND for the above violations in cases where the value of infringing goods and services is from over 3 million to over 500 million VND./.
