Receive and revise the Law on employment, emulation and rewards

Continuing the 6th plenary session, on the afternoon of September 23, the National Assembly's Committee on Social Affairs listened to reports on the reception and revision of the draft Law on Employment; the draft Law on amending and supplementing a number of articles of the Law on Emulation and Commendation; gave opinions on the draft report on the Committee's activities between the two sessions of the National Assembly and the planned work in 2014; integrated gender equality in a number of draft laws and gave opinions on draft laws submitted to the 6th session.

Improve the efficiency of organization and operation of employment services


In response to the opinions of National Assembly deputies, the draft Law on Employment was revised in the direction of concretizing Chapter II from 6 articles to 14 articles divided into policy groups; focusing on 3 policy groups on preferential credit, job creation, policies to support job transition for workers in rural areas and public employment policies.

At the same time, the draft Law also amends the regulations on employment service centers to be consistent with the Labor Code; expands the subjects participating in unemployment insurance in accordance with practice and provides specific regulations on unemployment insurance policies. Compared to the regulations submitted to the National Assembly at the 5th session, the draft Law after revision has 7 chapters and 63 articles; of which the contents related to active labor market policies include 32 articles (employment support policies, labor market information, assessment, granting of vocational skills certificates; organization and operation of employment services), and the regulations related to passive labor market policies include 19 articles (unemployment insurance).

Regarding the organization and operation of employment services, according to Deputy Minister of Labor, War Invalids and Social Affairs Nguyen Thanh Hoa, there are currently 3 types: 64 employment service centers established by the People's Committees of provinces and cities/63 provinces and cities (Hanoi has two centers); job introduction systems established by political and social organizations and centers established by ministries. With the view of socializing these centers, the Ministry proposes to gradually eliminate the existence of employment service centers established by ministries.

Regarding this issue, members of the National Assembly's Committee on Social Affairs said that the Government needs to report and clarify the planning and organizational model of these types of centers so that the National Assembly has a basis for decision, ensuring the goal of centralized and unified management, improving the efficiency of organization and operation of employment services. These centers are revenue-generating public service units, which need to be classified into types such as fully financially autonomous, partially supported by the State, and fully supported by the State. The establishment of employment service centers needs the written consent of the Minister of Labor, War Invalids and Social Affairs to be consistent with the Government's general planning, improving the quality of employment service activities...

Timely overcome difficulties in emulation and reward work

Members of the National Assembly's Committee on Social Affairs agreed with the viewpoint of amending and supplementing a number of necessary articles of the Law on Emulation and Commendation to promptly overcome practical difficulties, partially institutionalize the Party's policy on innovation in emulation and commendation work, in accordance with the National Assembly's resolution on the law and ordinance building program, and serve as a basis for comprehensive amendment of the Law when conditions are met.

After studying, absorbing and editing, the draft Law amends 46 articles and adds 1 article. The amendments are mainly in chapters II, III and IV, focusing on the goals of improving the standards of emulation titles and forms of commendation; clearly defining the responsibilities and authorities of agencies and organizations in emulation and commendation work; amending the process, procedures, records for consideration, proposal, consultation, and decision on emulation titles and forms of commendation; ensuring publicity and democracy in the process of evaluation and honoring, along with the responsibility of applying information technology and modernizing the management of emulation and commendation work of State management agencies to overcome widespread and overlapping commendation, and directing more commendation to direct workers...

The National Assembly's Committee on Social Affairs agrees with the drafting agency's viewpoint, uniformly stipulating in the draft Law on forms of State rewards and forms of rewards from other organizations in the political system in the direction that all organizations and individuals have the right to equality in recognition and honoring of merits and achievements in different forms and levels of rewards, if they meet the conditions and standards prescribed by law.

In addition to the regulations on the authority to issue forms of State rewards, for forms of rewards of political organizations, socio-political organizations... the draft Law is amended in the direction of being regulated by the Central agencies of these organizations, but must have the consent of the State management agency on emulation and rewards...

Also in the afternoon session, members of the National Assembly's Committee on Social Affairs gave their opinions on the draft report on the Committee's activities between the two National Assembly sessions and the planned work in 2014; integrated gender equality into a number of draft laws and gave their opinions on draft laws to be submitted to the 6th session./.
