Ministry of Transport requests to withdraw the decision of appointment in violation of regulations

Minister Dinh La Thang has just issued a document requesting the Southern Maritime Safety Corporation to withdraw the decision to appoint a Deputy General Director in violation of regulations.

Accordingly, on February 19, 2014, Southern Maritime Safety Corporation (VMS - South) issued Decision No. 209/QD-TCTBĐATHMN on appointing Mr. Pham Tuan Anh - Head of Maritime Safety Department, to hold the position of Deputy General Director of the Corporation.

However, according to the Ministry of Transport, this decision is beyond its authority and contrary to current regulations on procedures for appointing officials.

According to the provisions of Clause 2 and Clause 4, Article 1 of Decision No. 80/2004/QD-TTg dated May 12, 2004 of the Prime Minister regulating the number of Deputy General Directors and Deputy Directors of state-owned enterprises: State-owned corporations not classified as special; state-owned enterprises converted into parent companies are arranged with a maximum of 4 Deputy General Directors. In case a state-owned enterprise needs more Deputy General Directors and Deputy Directors, it must submit to the head of the agency that issued the establishment decision for approval.

However, before the appointment of Mr. Pham Tuan Anh as Deputy General Director, the Corporation already had 4 Deputy General Directors, so it had enough Deputy General Directors according to regulations.

However, VMS - South still carried out the process of appointing Mr. Pham Tuan Anh to the position of Deputy General Director without consulting the Ministry of Transport according to the above regulations.

Therefore, the Ministry of Transport requests the Southern Maritime Safety Corporation to withdraw the decision to appoint Mr. Pham Tuan Anh as Deputy General Director, and at the same time be responsible for arranging work for Mr. Pham Tuan Anh in accordance with his capacity, qualifications and the requirements of the Corporation's tasks.

Southern Maritime Safety Corporation must report the results to the Ministry of Transport before June 30, 2014.
