Strengthening the Party's leadership in anti-corruption work
On September 9, 2014, the Provincial Party Committee issued Directive 22-CT/TU on strengthening the Party's leadership and direction in the work of preventing and combating corruption. Accordingly, the Provincial Party Committee requested Party committees, Party organizations, authorities, the Fatherland Front and socio-political organizations from the province to the grassroots level to effectively carry out the following tasks:
1. Continue to effectively direct the implementation of Conclusion No. 21-KL/TU dated May 25, 2012 of the Central Executive Committee (11th tenure) "on strengthening the Party's leadership in the work of preventing and combating corruption and waste"; Directive No. 33-CT/TU dated January 3, 2014 of the Politburo "on strengthening the Party's leadership in the declaration and control of asset declaration"; Resolution No. 63/2013/QH13 dated November 27, 2013 of the National Assembly "on strengthening measures to combat and prevent crime"; provisions of the Law amending and supplementing a number of articles of the Law on Prevention and Combating Corruption in 2012; Decree No. 78/2013/ND-CP dated July 17, 2013 of the Government on transparency of assets and income; Decision No. 5355/QD-UBND dated October 20, 2009 of the Provincial People's Committee on "plan to implement the national strategy on corruption prevention and control to 2020 of Nghe An province"; Plan No. 264/KH-UBND dated May 21, 2012 of the Provincial People's Committee on implementing phase II (2012 - 2016) of the national strategy on corruption prevention and control; promptly deploy and effectively implement the contents of Decision No. 217-QD/TU dated December 12, 2013 of the Politburo "on promulgating the regulations on supervision and social criticism of the Vietnam Fatherland Front and socio-political organizations"; Decision No. 218-QD/TU dated December 12, 2013 of the Politburo "Regulations on the participation of the Vietnam Fatherland Front, socio-political organizations and people in giving opinions on Party building and government building".
2. Promote and diversify forms of propaganda, dissemination and education on corruption prevention and control in conjunction with the implementation of Resolution No. 4 of the Central Committee (11th tenure) on "some urgent issues on Party building at present", Directive No. 03-CT/TU dated May 14, 2011 of the Politburo "on continuing to promote the Study and follow the moral example of Ho Chi Minh" to raise awareness, consciousness and responsibility of all levels, sectors, cadres, party members and people on corruption prevention and control, creating unity, self-awareness and high determination in action. Implement Directive No. 10/CT-TTg dated June 12, 2013 of the Prime Minister on including corruption prevention and control content in teaching at educational institutions (high school level and above) in the province. Continue to deploy and replicate models of propaganda, dissemination and legal education on corruption prevention and control according to Plan No. 1886-KH/UBND-NC dated May 31, 2012 of the Provincial People's Committee.
Media agencies need to publish news and articles that properly orient public opinion to clearly see the positive results as well as the limitations, weaknesses, difficulties and complexities of corruption prevention and control work; condemn and fight against those who commit corrupt acts, commend the spirit and positive actions in corruption prevention and control; and clearly affirm the determination of the Party, the State and the entire political system in preventing and repelling corruption.
3. Leadership and direction in corruption prevention and control is the responsibility of Party committees at all levels. Therefore, Party committee secretaries must identify this as a key task to include in the review and assessment of Party committee activities in conjunction with the annual review of Party members, thereby providing specific and effective direction in corruption prevention and control.
In leadership and direction, it is necessary to promote the combined strength of the entire political system and the entire population in the work of preventing and combating corruption, improving the quality and effectiveness of the supervision activities of the People's Council, the inspection work of the Party Committee, the inspection work of the State; the supervision and criticism work of the Fatherland Front Committee and mass organizations.
4. Promote the responsibility of leaders (party committees, party organizations, state agencies...); consider the effectiveness of anti-corruption work as one of the important criteria to evaluate capacity and work results.
Heads of agencies and units must directly lead, direct and be responsible for the corruption situation within their respective areas and fields. All levels and sectors must promote administrative reform, especially administrative procedures, and make public and transparent State regulations and the process of resolving requests from people and businesses. Implement well the requirements on publicity and democracy in financial management; recruitment, promotion and assignment of personnel work; resolve policies and regimes and perfect internal management regulations, creating conditions for officials and people to closely monitor the work of the collective and of the head.
5. Focus on leading and directing the promotion of inspection and supervision by the Party and State inspection in sensitive areas prone to corruption such as: planning and management, land use; management of resources and minerals; basic construction investment projects funded by the State budget; compliance with tax laws; State budget allocation, asset procurement, personnel work, reception and recruitment of civil servants and public employees, implementation of social policies, investigation, prosecution and trial.
Strengthen inspection and examination of the responsibilities of leaders at all levels and sectors in complying with the law on corruption prevention and control, associated with inspection of the performance of public duties by officials and civil servants. Pay attention to directing post-inspection and examination handling, especially the recovery of lost money and assets and handling of violators.
6. State inspection agencies and Party inspection committees at all levels shall strengthen inspection activities and check for signs of violations; advise Party committees and authorities to strictly and synchronously handle both Party discipline and administrative and civil servant discipline for violators related to corruption; promptly transfer files of cases with signs of crime to competent authorities for prosecution and investigation; prevent and eliminate the phenomenon of "running the case".
The police, the procuracy, and the people's courts at all levels must coordinate to effectively handle difficulties and obstacles in the process of resolving cases; improve the effectiveness of investigation, prosecution, and trial of corruption cases, not allowing them to drag on; trials must be strict, especially those that are of public concern; limit the application of suspended sentences to defendants in corruption cases according to the provisions of law; and increase mobile trials to deter and prevent corruption.
Through inspection, examination, investigation, prosecution and trial, competent authorities need to detect loopholes in management and mechanisms and policies to make recommendations to competent authorities to promptly amend and supplement legal provisions and regulations on direction and administration of all levels and sectors in order to effectively prevent corruption.
7. Implementation.
- On the basis of this Directive, district, city and town Party Committees, affiliated Party Committees, Party Executive Committees and Party Delegations shall develop and supplement action programs and effectively implement them.
- People's Councils at all levels develop plans for specialized supervision of the implementation of anti-corruption work at departments, branches and sectors from the provincial to grassroots levels.
- The Fatherland Front Committee and mass organizations effectively implement the Party's regulations on supervising cadres and party members; supervise and provide social criticism to prevent corruption; mobilize people to actively participate in detecting and denouncing negativity and corruption.
- Annually, the Provincial Party Committee's Internal Affairs Committee shall preside over and coordinate with the Provincial Party Committee's Inspection Committee to advise the Provincial Party Committee's Standing Committee to develop a program and plan for inspection and supervision of anti-corruption work; monitor, inspect, and urge the implementation of this Directive and synthesize and report the implementation results to the Provincial Party Committee's Standing Committee.
