Vinh City People's Committee resolves petitions about karaoke businesses

(Baonghean) - Received Official Dispatch No. 666/PC/BNA dated December 2, 2014 of Nghe An Newspaper regarding the transfer of a citizen's petition reflecting that the karaoke business at No. 271, Nguyen Van Cu Street, Hung Binh Ward, Vinh City operates beyond the prescribed hours, causing disorder, and the soundproofing system is not guaranteed, affecting the lives of surrounding residents.

On February 3, 2015, Vinh City People's Committee issued Official Dispatch No. 15/BC-UBND to resolve the citizen's petition with the following content:

Regarding this issue, the People's Committee of Vinh City has directed the city's interdisciplinary inspection team of Culture - Information based on Decision No. 2146/QD-SVHTTDL dated August 15, 2014 of the Department of Culture - Sports and Tourism on the suspension of 4 karaoke rooms (including rooms: 102, 202, 203, 302) at the karaoke business establishment No. 271, Nguyen Van Cu, Hung Binh Ward and the feedback according to the petition of Mr. Tran Quoc Giang, to conduct an inspection, the specific results are as follows:

- At 11:30 p.m. on November 20, 2014, the city's interdisciplinary inspection team conducted an inspection of the karaoke business establishment No. 271, Nguyen Van Cu. During the inspection, it was discovered that the owner of the business establishment was still using karaoke rooms No. 102 and 302 to conduct business activities. The inspection team made a record, reminded and requested the owner of the establishment to strictly implement Decision No. 2146/QD-SVHTTDL of the Department of Culture, Sports and Tourism.

- At 10:30 p.m. on December 23, 2014, the city's interdisciplinary inspection team continued to conduct noise measurement at Mr. Tran Quoc Giang's house, No. 269, Nguyen Van Cu Street (a house adjacent to the karaoke business), the results were as follows: The loudest noise level MAX was 67 dBA, the quietest noise level MIN was 54 dBA. Thereby, the business violated the noise level allowed according to Circular No. 39/2010/TT-BTNMT dated December 16, 2010 regulating national technical regulations on the environment of the Ministry of Natural Resources and Environment (the allowable noise level between 9:00 p.m. and 6:00 a.m. is 55 dBA).

- Continuing to measure noise levels at Mr. Tran Quoc Giang's house at 11:05 p.m. on January 14, 2015, the specific results were: The loudest noise level MAX was 56 dBA, the quietest noise level MIN was 46 dBA. The business continued to violate noise regulations.

Thus, through the inspection process, although the owner of karaoke business No. 271 Nguyen Van Cu, Hung Binh Ward, has not discovered that the business has exceeded the prescribed time, the owner of the business has not seriously implemented the requirements in Decision No. 2146/QD-SVHTTDL dated August 15, 2014 of the Department of Culture, Sports and Tourism. The owner of the business still uses rooms No. 102 and 302 for business. On the other hand, during the implementation of the decision, the business has not been able to overcome the soundproofing conditions, the karaoke room continues to make noise, affecting the daily life of Mr. Tran Quoc Giang's household (household adjacent to No. 269, Nguyen Van Cu Street, Hung Binh Ward).

Based on the content assigned in Decision No. 2146/QD-SVHTTDL dated August 15, 2014 of the Department of Culture - Sports and Tourism, Vinh City People's Committee directed the Department of Culture - Information to report the inspection and supervision of the implementation of business establishment No. 271 - Nguyen Van Cu Street to the Department of Culture - Sports and Tourism of Nghe An to ask for direction.

Vinh City People's Committee is responsible for using its authority to continue researching measures to handle business activities that affect the lives of households around the karaoke business establishment at 271 Nguyen Van Cu Street.
