(Baonghean.vn) - The Ministry of Public Security has just issuedCircular 01/2016/TT-BCAprescribes the duties, powers, forms and contents of road traffic patrol and control by the Traffic Police.

Accordingly, traffic police are only allowed to stop vehicles for inspection in the following cases:

1. Directly detect or through professional technical means and equipment, detect and record violations of road traffic laws.

2. Implement the general control plan and orders of the Director of the Traffic Police Department or the Director of the Provincial Police Department or higher.

3. Implement the plan to organize patrols, control and handle violations, ensure traffic order and safety of the Head of the Highway Traffic Patrol and Control Department under the Traffic Police Department, Head of the Traffic Police Department or Head of the District Police or higher.

4. There is a written request from the Head or Deputy Head of the investigation agency; a written request from a relevant competent authority to stop the vehicle for inspection to serve the work of ensuring security, order, preventing and combating crimes and other violations of the law. The written request specifically states the time, route, vehicle stopped for inspection, handling, and participating forces.

5. Report and denounce violations of the law by people and vehicles participating in traffic.

At the same time, stopping a vehicle must ensure: Safety, compliance with legal regulations; not obstructing traffic activities; when stopping a vehicle, control must be carried out, if violations are detected, they must be handled in accordance with legal regulations.

This Circular takes effect from February 15, 2016 and replacesCircular 65/2012/TT-BCA.
