Strengthening management of conditional business activities in the province

On September 3, 2009, the Government issued Decree No. 72/2009/ND-CP "Regulating security and order conditions for a number of conditional business lines and occupations" to unify State management of activities of a number of conditional business lines and occupations on security and order.


To continue to effectively implement Decree No. 72/2009/ND-CP of the Government; Circular No. 33/2010/TT-BCA, dated October 5, 2007 of the Minister
The Ministry of Public Security stipulates security and order conditions for a number of conditional business sectors and occupations to prevent and combat violations of the law in conditional business sectors, contributing to ensuring security and order, creating favorable conditions for socio-economic development in the province. The Provincial People's Committee requests:


1. Nghe An Provincial Police


a) Strengthen the dissemination of regulations on security and order conditions for conditional business lines so that everyone clearly understands the regulations on conditions to ensure security and order for conditional business lines, ensuring that organizations and individuals conduct legal business activities.


b) Organize training on Decree No. 72/2009/ND-CP of the Government, Circular No. 33/2010/TT-BCA dated October 5, 2010 of the Ministry of Public Security and relevant legal provisions for the Public Security forces at all levels.


c) Improve the quality of appraisal and issuance of certificates of eligibility for security and order for conditional business lines.


d) Regularly inspect, guide and urge agencies, enterprises, organizations and individuals to implement the Government's Decree and the Ministry of Public Security's Circular; promptly detect and strictly handle violations of the law on conditions to ensure security and order.


e) Preside and coordinate with the Department of Finance to prepare a budget to submit to the Provincial People's Committee for financial support for training, propaganda organization and State management of industries and business lines with conditions on security and order in the province.


2. The Department of Planning & Investment, People's Committees of districts, cities and towns, in the process of reviewing and approving business registration, are responsible for guiding organizations and individuals applying for business registration in industries and professions with conditions on security and order in accordance with the provisions of law; coordinate with the Provincial Police in managing and inspecting the activities of organizations and individuals doing business in industries and professions with conditions on security and order in the area.


3. The Department of Justice, the Department of Information and Communications, newspapers and radio stations in Nghe An province; departments, branches and sectors; People's Committees of districts, cities and towns shall promote propaganda work on mass media, loudspeaker systems, and incorporate propaganda content on conditional business on security and order into activities in residential groups, residential areas, villages, hamlets... with practical content and diverse forms to help cadres and people understand and participate in monitoring the implementation.


4. Department of Industry and Trade


a) Direct and guide organizations and individuals to properly implement legal regulations on the use of industrial explosives and liquefied petroleum gas (LPG) trading according to Decree No. 107/2009/ND-CP, dated November 26, 2009 of the Government.


b) Coordinate with the Provincial Police, the Department of Labor, War Invalids and Social Affairs, and the People's Committees at district and commune levels to strictly manage the storage, transportation, and use of industrial explosives, and fire and explosion prevention and control; assess procedures according to the provisions of law on permitting the use and transportation of industrial explosives; organize training and issue certificates of eligibility to employers at units using industrial explosives.


5. Directors of departments, heads of provincial-level departments, branches, and organizations, People's Committees of districts, cities, and towns, and related organizations and individuals, based on their functions and tasks, shall develop a very specific and detailed Plan to implement Decree No. 72/2009/ND-CP of the Government; Circular No. 33/2010/TT-BCA of the Minister of Public Security and other legal provisions stipulating security and order conditions for a number of conditional business lines and occupations.


6. The Provincial Police Department shall preside over and coordinate with relevant units to monitor, inspect and urge the implementation of this Directive. Every quarter and every 6 months, units and localities shall report the implementation results to the Provincial People's Committee (through the Provincial Police Department) for guidance and direction.
