Should a National Election Council be established?

There are currently many conflicting opinions surrounding the establishment of the National Election Council.

During the discussion at the Hall on June 3, many delegates were interested in the issue of establishing a National Election Council.

Delegate Pham Trong Nhan (Binh Duong delegation) contributed his opinion: Regarding Article 121 on the National Election Council, many opinions suggested that it should not be organized because this agency has few activities and is costly in terms of apparatus.

However, in principle, to elect the highest State power body, the National Assembly, to exercise the right to make laws and to have laws made is a reverse process.

According to delegate Pham Trong Nhan, if following the principle of the mechanism of power formation, the National Election Council must be born before the National Assembly by direct democratic restraint from the people. Therefore, the establishment of the National Election Council is necessary when placed in the context of the first time before electing the National Assembly and constituting the constitution. The people must first elect the National Election Council.

Different from the view of delegate Pham Trong Nhan, delegate Nguyen Van Tuyet (Ba Ria - Vung Tau delegation) said that the Constitutional Amendment Drafting Committee explained the issue of establishing the National Election Council. In essence, the constitutionalization of the role and legal position of the Central Election Council is being stipulated in the Election Law.

In order to promote democracy and ensure objectivity in the election process in our country, delegate Nguyen Van Tuyet suggested considering the establishment of a National Election Council. The reason is that the establishment of a National Election Council only takes place once every 5 years. Moreover, we see that, through recent elections, the Central Election Council has fulfilled its tasks well.

The election is still affirmed to be democratic, ensuring objectivity and transparency in the election process. Therefore, whether it is necessary to establish a National Election Council or not needs to be discussed and considered because the Central Election Council in the past has directed all elections democratically and objectively. In that process, we have done this well, so it is not necessary to establish a National Election Council.

Agreeing with the above viewpoint, delegate Tran Van Tu (Dong Nai delegation) expressed his opinion: The arguments in the Draft Amendment to the 1992 Constitution mention the establishment of a National Election Council with the reason to ensure the recognition of election results. However, those arguments are not fully expressed and not convincing, so there is no need to establish a National Election Council./.
