(Baonghean) -On September 24, 2013, Nghe An Newspaper issued Official Dispatch No. 478/PC.BD/BNA transferring the petition of the families of 10 defendants; residing in Chai village, Chi Khe commune, Con Cuong district with the following content: The conclusion of the investigation of the criminal case: "Intentionally causing injury" that occurred on December 30, 2012 in Chai village, Chi Khe commune, Con Cuong district by the Investigation Police Agency of Con Cuong district police is not objective, does not reflect the truth, during the investigation process, the Investigation Police Agency of Con Cuong district police forced the defendants to confess.

Summary of the case:

At around 8:00 p.m. on December 30, 2012, Mr. Pham Huu Tien - born in 1992; residence: Bai Oi village, Chi Khe commune, Con Cuong district, Nghe An province, together with Mr. Nguyen Duy Nho, a fellow villager, were driving a motorbike to Chai village, Chi Khe commune, Con Cuong district to play when they were stopped and beaten by some young men from Chai village. Mr. Tien called his cousin, Mr. Pham Huu Giang - born in 1988, a fellow villager, to inform him: "I asked someone to go to Chai village, Chi Khe commune to take me home, but I was stopped and beaten by young men from Chai village". After receiving Mr. Tien's call, Mr. Giang called his uncle, Mr. Pham Huu Tam, born in 1962; Residence: Thuy Khe village, Chi Khe commune, Con Cuong district with the content: "Go take Mr. Tien home, Mr. Tien was beaten up in Chai village", then Mr. Tam agreed to drive the motorbike and hold a wooden stick about 1.5m long and go alone to Chai village. When they reached Chai village bridge, Mr. Giang and Mr. Tam met each other. After meeting, Mr. Giang called Mr. Tien and asked: "Where are you?", Mr. Tien replied: "In the village" (Mr. Tien meant to tell Mr. Giang that Tien was in Chai village). So Mr. Giang parked his motorbike and rode the motorbike with Mr. Tam to Chai village. When they arrived at Chai village, Mr. Tam called Mr. Tien to tell him to go home. A while later, Mr. Tien and Mr. Nho rode their motorbikes from the direction of Chai village and met Mr. Tam and Mr. Giang. Then, Mr. Tien drove the motorbike carrying Mr. Nho in front, while Mr. Giang carried Mr. Tam behind. When he arrived at the Chai village hall, some young men from the Chai village who were participating in the art festival at the hall threw rocks at Mr. Tam, Mr. Giang, Mr. Tien, and Mr. Nho. Because he was thrown, Mr. Tien took Mr. Nho and ran towards National Highway 7A, while Mr. Giang left his motorbike and ran away. When Mr. Tam stopped, Lao Cam Huy, Lao Van Bao, Vi Van Linh, Lao Cam Mong, Lo Van Dong, Vy Van Thuy, Vi Van Dinh, and Lo Van Tuan rushed in and punched and kicked Mr. Tam, seriously injuring him with sticks. At that time, Mr. Pham Huu Quyet - born in 1991, Mr. Tam's son, was singing karaoke at the "Xua va Nay" cafe in Thuy Khe village, Chi Khe commune, Con Cuong district, along with Mr. Bui Anh Tuan - born in 1994; Residence: Thuy Khe village, Chi Khe commune and Mr. Bach Sy Hiep from Thanh Nam village, Bong Khe commune, Con Cuong district received a phone call (it is unclear who called Mr. Quyet) saying to Mr. Quyet: "You go to the Chai village hall, I beat your father in here", receiving the phone call, Mr. Quyet said to Mr. Tuan, Mr. Hiep: "Now, Mr. Tam and Tien were beaten in Chai village, go and drag Mr. Tam back, he was beaten almost to death there". Hearing Quyet say that, Mr. Tuan immediately drove a Sirius motorbike with license plate 37Cl-01044 carrying Quyet and Hiep into Chai village. On the way to Chai village, he met Mr. Tien and Mr. Nho coming out of Chai village. Meeting Mr. Tien and Mr. Nho, Mr. Quyet asked: "Where is dad?" (Mr. Quyet meant to ask Mr. Tien where is Mr. Tam). Mr. Tien replied: "Dad was probably beaten in there", then Mr. Tien, Mr. Nho turned the motorbike and went with Mr. Quyet, Mr. Tuan, and Mr. Hiep into Chai village. Mr. Tien, Mr. Nho, Mr. Tuan, Quyet, and Hiep rode their motorbikes about 20 meters from the Chai village hall and stopped when some Chai village youths threw rocks from the direction of the hall. Seeing that, Hiep said: "He's going to die, turn around" (Hiep meant that they were just about to die when they threw them like that), so Mr. Tien drove Mr. Nho, Mr. Tuan drove Quyet, and Hiep turned the motorbike and ran towards National Highway 7A. While Mr. Tuan was turning the motorbike to run away, the motorbike slipped and fell to the side of the road. While Mr. Tuan was continuing to turn the motorbike, Lo Van Tien, Lo Van Tuyen, Vi Van Linh, Lo Van Phuc, Lao Cam Mong, and Lao Van Bao, all of whom were Chai village youths, rushed over. Seeing that, Quyet and Hiep ran away, while Mr. Tuan was thrown rocks at by Lo Van Tien, Lo Van Tuyen, Vi Van Linh, Lo Van Phuc, Lao Cam Mong, and Lao Van Bao, who were all Chai village youths. Seeing that, Quyet and Hiep ran away, while Mr. Tuan was beaten with sticks, hands, and feet, causing him to be seriously injured. After the incident, Mr. Tam and Mr. Tuan were taken by their family to the Southwest Nghe An Regional General Hospital for emergency treatment; then Mr. Tuan was transferred by his family to Nghe An 115 Hospital, and Mr. Tam was transferred by his family to Nghe An General Friendship Hospital for emergency treatment and treatment from December 31, 2012 to January 10, 2013, when Mr. Tam and Mr. Tuan were discharged from the hospital.

On January 25, 2013, the Investigation Police Agency of Con Cuong District issued Decision No. 08 and 09 requesting the Nghe An Province Forensic Center to assess the rate of injury and health damage to Mr. Bui Anh Tuan and Mr. Pham Huu Tam. In the forensic assessment conclusion on injuries No. 49/TTPY dated January 29, 2013 of the Nghe An Province Forensic Center, it was concluded that: The total health loss due to injuries caused by injuries at the time of assessment of Mr. Pham Huu Tam was: 14% (fourteen percent) and the forensic assessment conclusion on injuries No. 50/TTPY dated January 29, 2013 of the Nghe An Province Forensic Center concluded: The total health loss due to injuries caused by injuries at the time of assessment of Mr. Bui Anh Tuan was: 25% (twenty-five percent).

After the incident, the Con Cuong District Police Investigation Agency summoned the following subjects: Lao Cam Huy, Lao Van Bao, Vi Van Linh, Lao Cam Mong, Lo Van Dong, Vi Van Thuy, Vi Van Dinh, Lo Van Tuan, Lo Van Tien, Lo Van Tuyen, Lo Van Phuc. At the investigation agency, these subjects admitted their violations as stated above. The Con Cuong District Police Investigation Agency issued a decision to prosecute the case and prosecute the following defendants: Lao Cam Huy, Lao Van Bao, Vi Van Linh, Lo Van Dong, Vi Van Thuy, Vi Van Dinh, Lo Van Tuan, Lo Van Tien, Lo Van Tuyen, Lo Van Phuc for the crime of "Intentionally causing injury" to be handled according to the provisions of law. At the same time, an order was issued prohibiting the defendants Lao Cam Huy, Lao Van Bao, Vi Van Linh, Lo Van Dong, Vi Van Thuy, Vi Van Dinh, Lo Van Tuan, Lo Van Tien, Lo Van Tuyen, and Lo Van Phuc from leaving their place of residence. As for Lao Cam Mong, because he is not old enough to be held criminally responsible for less serious crimes and serious crimes, the Con Cuong District Police Investigation Agency assigned the local authorities to manage and educate him. On August 26, 2013, the Con Cuong District Police Investigation Agency issued a conclusion on the investigation of case No. 34 and transferred the entire file to the Con Cuong District People's Procuracy, proposing to prosecute the defendants Lao Cam Huy, Lao Van Bao, Vi Van Linh, Lo Van Dong, Vi Van Thuy, Vi Van Dinh, Lo Van Tuan, Lo Van Tien, Lo Van Tuyen, and Lo Van Phuc for the crime of "Intentionally causing injury" as prescribed in Clause 2, Article 104 of the Penal Code of the Socialist Republic of Vietnam.

According to the petition of the defendants' families, we would like to respond as follows:

1- The petition of the defendants' families stating that during the working process at the Con Cuong District Police Investigation Agency, they were beaten and forced to confess is unfounded. The defendants' statements at the investigation agency were voluntary after the working sessions, when the officers directly read the minutes of their statements or the defendants themselves read the minutes of their statements and swore before the law about the contents of their statements.

2- The defendants: Lao Cam Huy, Lao Van Bao, Vi Van Linh, Lo Van Dong, Vi Van Thuy, Vi Van Dinh, Lo Van Tuan, Lo Van Tien, Lo Van Tuyen, Lo Van Phuc are those who intentionally committed crimes, have full criminal capacity and must bear full responsibility for their actions. The process of investigation, prosecution of the case, and prosecution of the defendants by the Con Cuong District Police Department was conducted objectively, with the right people, and in accordance with the law.

3- Through the collected investigation documents, there is sufficient basis to conclude that Mr. Pham Huu Tam and Mr. Pham Huu Giang went to Chai village to pick up Mr. Pham Huu Tien and Nguyen Duy Nho and did not cause trouble as stated in the petition. Furthermore, among the 10 defendants prosecuted in the case, who participated in the proceedings, none of the defendants made any petitions or accusations, only their relatives made petitions. However, on October 9, 2013, the Investigation Police Agency of Con Cuong District Police responded to the petitions of the above families.
