Vinh City People's Committee responds to the letter.
(Baonghean) - The People's Committee of Vinh City has received a petition regarding the rotation of accounting staff in schools within the city from 2006 to the present.
After consideration, the Vinh City People's Committee provides the following explanation: Firstly, regarding the petition, it is stated that in January 2006, the City People's Committee issued a decision to rotate school accountants before Decree 158/2007/ND-CP was promulgated and came into effect. Regarding this matter, the City People's Committee has the following opinion: During the inspection of financial management at the People's Committees of wards and communes, and affiliated schools, the Vinh City People's Committee discovered several units violating financial management principles. Consequently, the City People's Committee considered and decided to discipline several accounting and land administration officials of the ward and commune People's Committees, and accounting staff of public service units, in accordance with regulations. To strengthen and ensure effective financial management at the units, based on Decision No. 84/2004/QD.UB dated August 9, 2004, on the promulgation of regulations on the assignment and decentralization of management of organizational structure and cadres, civil servants, and public employees, the Chairman of the People's Committee of Vinh City decided to rotate and transfer 37 out of 78 school accountants, 11 accountants, and 9 land administration officials at the ward and commune levels. Therefore, the rotation of school accountants in January 2006 was within the proper authority.
Second point: The petition states that the implementation of personnel rotation according to Government Decree No. 158/2007/ND-CP dated October 27, 2007, and the Nghe An Provincial People's Committee Decree dated October 6, 2010, is incorrect. Regarding this matter, the City People's Committee has the following opinion:
In accordance with Decree 158/2007/ND-CP and Decision No. 75/2010/QD-UBND, and based on the requirements of task implementation, the City People's Committee has issued a Decision on job rotation for professional civil servants in the specialized departments of the City People's Committee, civil servants of ward and commune People's Committees, and public employees of public service units as follows:
In September 2009, the People's Committee of Vinh City issued a decision to transfer 40 school accountants, 16 finance and accounting officials, and 25 land and construction officials of the People's Committees of wards and communes in the city.
+ In November 2011, the People's Committee of the city sent a document to the heads of public service units and specialized departments of the People's Committee of the city to implement job rotation according to Decree 158/2007/ND-CP.
In December 2011, the People's Committee of Vinh City issued a decision to transfer 3 finance and accounting officials from the People's Committees of wards and communes.
In December 2012, the City People's Committee issued a decision to transfer 9 accounting officials at affiliated public service units and reassign 36 civil servants from specialized departments of the City People's Committee such as: Finance - Planning, Natural Resources and Environment, Urban Management, Internal Affairs, Justice, and the City Inspectorate. Annually, the City People's Committee submits a report to the Nghe An Department of Internal Affairs on the results of implementing Decree 158/2007/ND-CP.
Thus, the City People's Committee has correctly implemented the rotation as stipulated in Decree 158/2007/ND-CP regarding the subjects, principles, and authority for deciding on job position transfers. The rotation was carried out openly, transparently, and democratically; the transfer process was implemented through the specialized departments of the City People's Committee, with their participation, consensus, and notification to the heads of the units.
However, the time limit for transferring civil servants and public employees to different positions, as stipulated in Government Decree No. 158/2007/ND.CP dated October 27, 2007, is 3 years (36 months). In practice, implementation has shown that this timeframe is too short, leading to many shortcomings and negatively impacting the work efficiency of civil servants and public employees.
