Discussion on the draft Law on Housing (amended)
Many opinions say that the draft law needs to clearly stipulate more incentives and mechanisms to overcome limitations in social housing.
Continuing the 26th session, on the afternoon of March 10, the National Assembly Standing Committee gave opinions on the draft Law on Housing (amended). National Assembly Chairman Nguyen Sinh Hung chaired the meeting.
According to the draft Law on Housing (amended), the responsibility for housing development belongs first and foremost to the State, and the State has policies and plans to allocate resources to proactively invest in national housing programs to support housing improvement for those with housing difficulties. The majority of delegates agreed with this provision, because it clearly demonstrates the socialist orientation in housing development of the Party and the State.
However, the Draft Law needs to clarify the concept of social housing development and provide more specific regulations to ensure that the right subjects with housing difficulties and low incomes enjoy the regime and policies when buying a house. In addition, delegates said that the Draft Law needs to have policies to encourage the development of social housing so that people can have housing, as well as be consistent with the new Constitution on human rights and civil rights.

Chairman of the National Assembly's Petition Committee Nguyen Duc Hien suggested that it is necessary to create a synchronous mechanism and policy to attract more investors in real estate projects and for people to enjoy more social benefits. In addition, it is proposed that the draft law should clearly stipulate more incentives and mechanisms to overcome the limitations of social housing in recent times. In addition, the State needs to have an investment mechanism such as annually allocating the budget for overall housing development, including social housing.
Some opinions agree with the expansion direction to allow Vietnamese people residing abroad, foreign organizations and individuals in Vietnam to own houses. However, the draft law needs to stipulate stricter conditions to ensure national interests, political security, social order and safety, and national defense and security, especially in key areas and regions.
Chairman of the National Assembly's Defense and Security Committee Nguyen Kim Khoa agreed to expand the right for foreigners to own houses in Vietnam. However, for Vietnamese residing abroad as foreigners, there must be different regulations to follow the foreign policy perspective and the new Constitution. For foreigners and stateless people, it is necessary to classify them. Foreigners who are temporarily residing in Vietnam and meet the conditions can be considered for permanent residence and have the right to own a house.
On behalf of the Drafting Committee, Minister of Construction Trinh Dinh Dung fully accepted the opinions of the delegates, including clarifying the concepts of "traditional housing" and "social housing" to facilitate the management of architecture and housing planning. The draft Law will supplement mechanisms and strict regulations for the Social Housing Development Fund, as well as clarify the right to transfer home ownership./.
