The parties in the case are Mrs. S, who is over 80 years old this year, and her only son, Mr. NQB...

That trial caused much thought for those present in the courtroom. For nearly 3 years (since April 2012), the old mother has been tirelessly going to the doors of government agencies to sue for the return of 303.84 square meters of land. The defendant is none other than her only son, Mr. NQB. According to Mrs. S, her husband participated in the resistance war against the US and died in 1967. Since then, she has been single and raised 3 children. The situation of a widowed mother and orphaned children is extremely miserable. In 1979, the State had a policy to reclaim the land plot where she and her children were living to build a construction company. Her family was granted a new plot of land in Duc Vinh hamlet (now hamlet 7, Hung Loc commune, Vinh city). After being granted the land for 1 month, Mrs. S asked to move to another plot of land and was approved by the People's Committee of Hung Loc commune. Sympathizing with the difficult situation of her family, the Commune People's Committee built a three-room house of gratitude. Mrs. S's two daughters got married one after another. Since then, she has lived with her son and his wife. In 2004, Vinh City People's Committee issued a land use right certificate in Mrs. S's name. After being granted the land use right certificate, Mrs. S transferred part of the land to her daughter and her husband. Conflicts arose from there. The mother-daughter relationship between Mrs. S and Mr. B and his wife broke down. Then one day, during an argument, Mr. B destroyed the property and kicked Mrs. S out of the house. Currently, due to old age and poor health, the State has a policy of building a house of gratitude for Mrs. S on the land in her name, but Mr. B does not agree. The conflict is getting more and more intense.

At the trial, Mr. B stated that: Previously, his family lived on the land left by his father. In 1979, the Aquatic Construction Company took this land and the State compensated Ms. S with another land plot. Ms. S only lived on the compensated land plot for a short time, then sold the entire plot to someone else and returned to live alone at the kiosk on the old land that had been recovered. Because he had no place to live, Mr. B applied for land and was granted the land plot that is currently in dispute by the State. According to Mr. B, it has been nearly 10 years since he was granted the land, his family has built a solid house and lived stably and continuously. All land records and applications for a Land Use Rights Certificate such as: inventory book, land register, land plot technical records, minutes determining land plot boundaries and all documents on financial contribution obligations are under his name. Thus, the origin of the land plot belongs to Mr. B. Mr. B was completely unaware of the Vinh City People's Committee issuing a land use right certificate under the name of Ms. S. Until Ms. S completed the procedures to cut off his family's land to sell to someone else and continuously chased Mr. B's family out of the house, because she thought this was her land plot. Ms. S's accusation that Mr. B destroyed her property and chased her out of the house was completely fabricated.

After reviewing the documents and evidence, the Vinh City People's Court issued the First Instance Judgment No. 09/2014/DSST. Accordingly, the request to cancel the Land Use Rights Certificate under the name of Mrs. S of Mr. and Mrs. B was rejected. Mr. and Mrs. B were forced to return to Mrs. S the land area of ​​303.84 m2. Disagreeing with the judgment of the Vinh City People's Court, Mr. and Mrs. B filed an appeal. In the appeal hearing on September 29, 2014, the Nghe An Provincial People's Court agreed with the opinion of the Vinh City People's Court, upholding the first instance judgment. At the end of the hearing, the son left the auditorium with a resentful look, without once looking at his mother. Although the mother won the lawsuit, her haggard face still bore a sorrow that could not be filled...

The verdict has been announced, but the greatest loss that both of them have to endure is the damage to their family relationship. The mother worked hard all her life, sacrificed her personal happiness to raise her child, and at the end of her life, sued her own child. As for the child, just because of more than 300 square meters of land, he turned his back on his mother. Although we know that in the market economy, "every inch of land is worth an inch of gold", is it necessary to trade everything, including the sacred motherly love, to fight for it? I think that, along with the development of society, the worry about food and money is inevitable. But the good moral values ​​that have existed for generations, especially the filial piety of the family, need to be preserved.
