Vinh City People's Committee responds to the issue raised by the newspaper

(Baonghean) - On July 28, 2014, the "Hotline Information" section of Nghe An Newspaper reported the opinions of Vinh City residents: In early 2014, Radar Station T45 (located in Hamlet 12, Hung Loc Commune, Vinh City) built 3 rows of level 4 houses with more than 30 households to arrange housing for the station's staff. Most of these apartments were built in the style of collective housing including one room and a closed structure. The construction of collective housing during this time went against the province's policy in implementing the project to eliminate old collective housing in Vinh City.

Upon receiving the above information, on August 5, 2014, the City People's Committee organized an inspection team chaired by the Urban Management Department in coordination with the City Urban Inspectorate and the People's Committee of Hung Loc commune to inspect the above construction incident.After checking the current status and related documents, on August 13, 2014, the City People's Committee issued Official Dispatch No. 3854/UBND-QLDT on resolving the construction of a house at Radar Station T45 in Hamlet 12, Hung Loc Commune.

1. Regarding the project's legal documents:

- On February 17, 2014, the People's Committee of Nghe An province allowed the 363rd Division of the Air Defense - Air Force to survey and select a location, and make a detailed plan for the construction of residential land adjacent to the military family area of ​​Radar Station 45 - Regiment 295 - Division 363 of the Air Defense - Air Force in Hung Loc commune, Vinh city.

- On March 26, 2014, Nghe An Provincial People's Committee approved the detailed construction planning at a scale of 1/500 to divide the land plots adjacent to the military family area of ​​Radar Station 45 - Regiment 295 - Division 363 of the Air Defense - Air Force Service in Hung Loc Commune, Vinh City, with Decision No. 1121/QD. UBND-XD. Accordingly, the nature is: Land planned and used for residential purposes.

2. About the current status:The current status of the project has completed the rough construction of 3 rows of level 4 houses and surrounding gate and fence; construction area is about 2,000m2.

3. Problems in construction implementation:Through checking the documents and the field, the investor, Division 363 - Air Defense - Air Force, has not complied with the direction of the People's Committee of Nghe An province in Decision No. 1121/QD. UBND-XD dated March 26, 2014 and the provisions of law on construction and urban management. Specifically:

- Construction of 3 rows of 1-storey houses and surrounding gates and fences without a construction permit issued by a competent authority;

- The investor has not announced the planning according to current regulations;

- Not yet implemented and completed procedures to convert land use purpose from military land to residential land, not yet fulfilled financial obligations on land.

* From the above inspection results, the City People's Committee assigns:

- Radar Station 45, Division 363 of the Air Defense - Air Force immediately stopped construction at Hamlet 12, Hung Loc Commune. The Head of the Urban Management Department issued a decision to suspend construction of the construction project that violated urban construction order at Radar Station 45, in Hamlet 12, Hung Loc Commune (according to the provisions of Clause 3, Article 20, Decree No. 180/2007/ND-CP dated December 7, 2007 of the Government on detailed regulations and instructions for the implementation of a number of articles of the Construction Law on handling violations of urban construction order).

- Hung Loc Commune People's Committee and the City Urban Inspectorate supervise the implementation of the decision to suspend construction issued by the Head of the Urban Management Department.

- Division 363 of the Air Defense - Air Force is responsible for completing the procedures for investment and construction; implementing the instructions of the Provincial People's Committee in Decision No. 1121/QD.UBND-XD dated March 26, 2014; providing documents to the City People's Committee on the construction procedures of the above project. The implementation process is reported to the City People's Committee so that the City People's Committee knows and has further handling directions.
