Only seminars and product introductions?

On the morning of August 29, we had a meeting with the Deputy Head of the Department of Industry and Trade of Hung Nguyen District, Mr. Tran Van Lan, who signed Official Letter No. 44 on the approval of Phuong Nam International Household Appliances Joint Stock Company to organize seminars and introduce products in the district. Presenting Official Letter No. 44, clearly stating each item, Mr. Lan said: Based on the Official Letter of the Department of Industry and Trade, the profile of Phuong Nam International Household Appliances Joint Stock Company, the Department of Industry and Trade agrees to allow this company to organize seminars and introduce products. At the same time, he emphasized: Only seminars and product introductions are allowed. Selling products at the seminar is wrong. Whoever is wrong must be responsible before the law.

According to Article 118 of the Commercial Law, it is correct to allow businesses to organize seminars and introduce products. However, here we need to talk about the responsibility of inspection and supervision. In our opinion, in this case, the Department of Industry and Trade and the Department of Industry and Trade have not shown responsibility? Mr. Lan replied: In Official Dispatch 44, we requested this company to report the results of organizing the seminar. In addition, the official dispatch also clearly stated that Phuong Nam International Household Appliances Joint Stock Company must ask for permission from the local authorities; at the same time, it must comply with the contents stated in the official dispatch. Here, the primary responsibility belongs to the local authorities. If they are found to be doing it incorrectly, measures must be taken to prevent it. In addition, it is the responsibility of the market management force. Hung Nguyen district does not have a market management team, but there is an inter-district market management team of the Market Management Department (Team 3) that regularly visits. If there is anything, please contact Team 3 for more information. How will the Department of Industry and Trade handle the matter? "They are doing something wrong in the department's content, so they have to stop. We will report to the department..." - Mr. Lan affirmed.

Also according to Mr. Tran Van Lan, when Phuong Nam International Household Appliances Joint Stock Company came to discuss organizing the seminar, they only brought documents, without the "multi-purpose vacuum cooker" product. Meanwhile, according to an officer of the department: "The goods have unknown origin...".

Regarding the Department of Industry and Trade's registration for work, an officer of the department said that the leaders were holding a meeting; the department knew about the incident of Phuong Nam International Household Appliances Joint Stock Company taking advantage of the seminar to sell products. And at the meeting, the department's leaders assigned the Chief Inspector to go to Hung Nguyen on the afternoon of August 29 to inspect. As citizens, we gave all the documents of Phuong Nam International Household Appliances Joint Stock Company to the inspector of this department, Mr. Nguyen Thanh Hung, for inspection. Regarding the test results of the Technical Center for Standards and Quality Measurement 1; the code certificate of the General Department of Measurement and Quality; the "multi-purpose vacuum" pot model..., according to Mr. Hung, there were many unclear and opaque signs. Mr. Hung analyzed: "There are no product labels or tags on the product; no barcodes were stamped or affixed. The test results only state the customer's name, not the manufacturer's name, and are only valid for the test sample, not the entire shipment...". An officer in the same department as Mr. Nguyen Thanh Hung also said that the test result sheet is not reliable; and using this sheet for products sold to consumers is illegal.

Regarding Official Dispatch No. 838/SCT-QLTM agreeing to allow Phuong Nam International Household Appliances Joint Stock Company to organize seminars and introduce products, according to Mr. Hung, the Department's leaders implemented it in accordance with the spirit of Article 118 of the Commercial Law. The fact that Phuong Nam International Household Appliances Joint Stock Company took advantage of organizing seminars and introducing products to sell products is contrary to the content of Official Dispatch No. 838. Pot "Not fake but poor quality"

Not "fake", but poor quality!

Citizen NTS (Hung Phuc commune, Hung Nguyen) is the person who bought a "multi-purpose vacuum" pot from Phuong Nam International Household Appliances Joint Stock Company on the afternoon of August 28. After bringing it home to check and use, according to him, because this cooking pot does not show any signs of "imitation" of a certain brand's product, it cannot be said that this is a "fake" or counterfeit product. However, with thin stainless steel material, bolts, buttons, and accessories made roughly by hand, the product has no stamps or barcodes, only the "Masami" label, and after heating, it peeled off, showing that this is a poor quality product. Mr. NTS said: "Last night my wife cooked a duck and used the pot to cook porridge. When it was on the stove, it was boiling. When I put it in the thermos, the metal ring at the bottom of the pot collided with the thermos, causing the porridge to squirt out, so it couldn't be locked. I had to run down to lock the pot, check it very carefully and found it was really bad. The label was carelessly pasted, it came off after just heating, and the pot lock was very handmade. It might not be fake, but it was of poor quality. We were too careless.

On the morning of August 28, in front of about 400-500 people, they said that they had to go serve people in remote and mountainous areas at around 3 pm. Then at 1 pm they distributed pots to people, quickly packed up and left. The way they sold for only 1 hour, and at a time close to noon, was like they were trying to run away. They were so careless. Well, counting the knife set, each person who bought the pot suffered a loss of several hundred thousand...

Article 10 of the Law on Consumer Protection strictly prohibits organizations and individuals trading in goods and services from deceiving or misleading consumers through advertising activities or concealing or providing incomplete, false, or inaccurate information about the goods and services that organizations and individuals trading in goods and services provide. At the same time, Article 20 of this law also clearly states: Organizations and individuals trading in goods and services are responsible for providing consumers with invoices or vouchers and documents related to transactions in accordance with the provisions of law or at the request of consumers.

On August 28, 2014, in Hung Phuc and Hung Thinh communes (Hung Nguyen), Phuong Nam International Household Appliances Joint Stock Company took advantage of the seminar trick, calling for "Saving energy, reducing emissions and protecting the environment"; "Multi-function cookers protect health"... along with promotional tricks to sell poor quality products; in addition, when buying and selling goods, they did not provide invoices and transaction documents. Obviously, Phuong Nam International Household Appliances Joint Stock Company violated Articles 10 and 20 of the Law on Consumer Protection. Therefore, the authorities and local governments need to learn from experience and immediately stop the "organizing seminars and introducing products" of this company; in addition, measures need to be taken to inspect and handle violations. And, consumers need to raise their vigilance to avoid being deceived.
