Minister Dinh La Thang: Uber will have to bear joint responsibility

The Ministry of Transport will inspect transport businesses using Uber software. If they do not ensure compliance, they will be held responsible before the law. Uber Company must be jointly responsible.

Minister of Transport Dinh La Thang has just sent an official dispatch to the Ho Chi Minh City Taxi Transport Association and the Hanoi Transport Association regarding the operation of Uber software in Vietnam.

Accordingly, Uber Company is a technology business unit under the Business License granted by the People's Committee of Ho Chi Minh City and does not operate in the transportation business. Therefore, Uber Company is not subject to the management of the Ministry of Transport. However, Uber Company's activities are related to the transportation business sector. Therefore, to ensure that Uber software operates in Vietnam in accordance with the law and competes fairly and equally, the Ministry of Transport has requested Uber Company and its partners to implement a number of contents.

Specifically, the Ministry of Transport requires Uber to only sign service contracts with transport businesses that meet the business conditions regarding licenses, vehicles, labor, etc. in accordance with the provisions of the Road Traffic Law and Decree No. 86/2014/ND-CP of the Government regulating business and conditions for doing business in automobile transport.

The Ministry of Transport also requires transport businesses that have signed or will sign contracts with Uber to comply with the law when providing vehicles and drivers using the Uber application software; especially to fully perform the responsibilities of a transport business unit.

Minister Dinh La Thang affirmed that he will direct agencies and units to conduct surprise and periodic inspections of the activities of transportation service providers using Uber software. If they fail to ensure compliance, they will be held responsible before the law; Uber Company must be jointly responsible.

In addition, the Ministry of Transport has also sent a document requesting the Prime Minister to direct ministries and local branches to pay attention to performing the State management task for Uber Company regarding tax obligations, finance, e-commerce, international payments, etc.

Meanwhile, according to a representative of Uber Company: “On the occasion of the new year 2015, Uber is committed to providing passengers with a means of transportation and high-quality experiences. Uber has also just launched Uber EXEC, a new, more premium option in Ho Chi Minh City, whereby passengers can request a luxury car for a special evening or a formal meeting.
