9th grade student sentenced to 4 years in prison for stabbing classmate to death

(Baonghean.vn) - On the morning of January 13, the Provincial People's Court opened a first-instance criminal trial of Nguyen Huu Cuong (born in 1999, residing in Thanh Hung commune, Thanh Chuong) for murder.

According to the indictment of the Provincial People's Procuracy, at about 10:30 a.m. on June 5, 2014, on the inter-village road in Thanh Hung commune (Thanh Chuong), Tran Van Minh (born in 1999) used his hand to hit Nguyen Huu Cuong several times in the face (both were 9th grade students at Thanh Hung Secondary School).

Being beaten, Cuong used one hand to block, and with the other hand took a knife from his pocket and stabbed Minh in the right back. As a result, Tran Van Minh died from shock and acute blood loss from the wound that penetrated his back and punctured his right liver lobe. After committing the crime, Cuong went to the authorities to surrender.

At the trial, Nguyen Huu Cuong confessed his crime. Cuong's parents said that since 2005, Cuong had shown signs of abnormality, unable to control his behavior and emotions. The authorities requested a psychiatric evaluation of Nguyen Huu Cuong.

The results of the forensic psychiatric assessment center - Department of Health concluded: Nguyen Huu Cuong was diagnosed with G40.2 (complex partial seizures developing into secondary generalized seizures), and had changed his personality. After the incident, Cuong's parents also bought some items for Minh's funeral, and compensated the victim's family 10 million VND in cash.

Considering that Nguyen Huu Cuong's crime was particularly serious, depriving another person of his life, however, at the time of the crime, Cuong was only 15 years, 4 months and 18 days old, on the other hand, the defendant was concluded to have limited capacity and behavior, and the defendant's parents had partially compensated the victim for the loss, the panel of judges considered Cuong to enjoy mitigating circumstances according to the provisions of the law. Considering the case as a whole, the panel of judges sentenced Nguyen Huu Cuong to 4 years in prison, forcing the defendant's family to compensate 75 million VND to the victim's family in addition to the 16 million VND previously compensated.
