Vinh City People's Committee directs handling of illegal land encroachment

(Baonghean) - Nghe An Newspaper issue dated July 21, 2014 had an article "Illegal land encroachment in Vinh City". On September 26, 2014, Vinh City People's Committee issued Official Dispatch No. 4682/UBND-VP on handling construction works violating construction order, with the following content: On July 29, 2014, the City People's Committee issued Official Dispatch No. 3597/UBND-VP directing the Urban Management Department and related departments and units to conduct inspections and take strict measures to handle violations. Based on the report of the Urban Management Department, Vinh City People's Committee responded as follows:

- Regarding construction licensing and construction order management:

From 2009 to present, on average, the City People's Committee has issued individual housing construction permits to about 1,500 households and individuals each year. Basically, households and individuals have complied with the granted construction permits. However, there are still some households and individuals who violate urban construction order such as illegal construction, illegal construction, encroachment on public land... In the process of performing their duties, the functional forces of wards (communes) and cities have promptly detected and prevented cases with signs of violations to guide construction in accordance with the granted construction permits and the majority of people have followed the direction of the government.

In addition, there are still some cases of intentional violations of illegal or improper construction. The City People's Committee has issued decisions on administrative violations and decisions on compulsory demolition in construction activities in nearly 600 cases. Currently, there are still some cases where decisions on compulsory enforcement of administrative penalty decisions have been issued but have not been implemented, mainly due to the verification of land use origin and housing areas in new urban areas that have not been handed over to local authorities (18 cases).

- Regarding the issue of households building their own fences and iron gates for the row of townhouses on Xo Viet Nghe Tinh Avenue:

On August 9, 2012, the Chairman of Vinh City People's Committee issued Decision No. 4821/QD-UBND on applying remedial measures for administrative violations in construction activities against the Nghi Phu New Urban Area Construction Investment Project Management Board regarding the construction of works on the 9m setback land of the row of townhouses adjacent to Xo Viet Nghe Tinh Street.

On August 18, 2012, the collective households of the townhouses - Vinaconex 9 Urban Area submitted a petition to the People's Committee of Nghe An province and the People's Committee of Vinh city to protest the demolition of the construction on the land under the land use rights of these households for the reason that the fence and roof are only for the purpose of demarcating the land boundary, providing shelter from the rain and sun, and preserving property.

On August 30, 2012, the Provincial People's Committee issued Official Dispatch No. 6054/UBND-CN assigning Vinh City People's Committee to preside over and coordinate with the Department of Construction to resolve the petitions of the above households.

After Vinh City People's Committee worked with the Department of Construction, on October 15, 2012, the Department of Construction issued Official Dispatch No. 1685/SXD-QHKT regarding the architectural plan of the fence and gate of the row of adjacent houses in the New Urban Area Project in Hamlet 19, Nghi Phu Commune, Vinh City.

On December 14, 2012, Vinh City People's Committee issued Official Dispatch No. 4815/UBND-QLDT requesting the Nghi Phu New Urban Area Construction Investment Project Management Board to promptly implement and strictly comply with the regulations of the Department of Construction in Official Dispatch No. 1685/SXD-QHKT dated October 15, 2012. The Nghi Phu New Urban Area Construction Investment Project Management Board and a number of households have strictly complied, however, there are still a number of households that have not voluntarily complied. Therefore, Vinh City People's Committee issued Decision No. 2122/QD-UBND dated May 30, 2013 on the forced demolition of the above-mentioned construction, in which, the City Urban Inspectorate is assigned to preside over and coordinate with Nghi Phu Commune People's Committee, Vinh City Police and other relevant agencies to organize the implementation. Currently, Nghi Phu Commune People's Committee is making a plan to enforce the construction of fences and iron gates of the row of townhouses on Xo Viet Nghe Tinh Avenue.
