Correcting abuse of certified copy requirements

Pursuant to Decision No. 1949/QD-BTP dated August 20, 2014 of the Ministry of Justice on promulgating the Plan to implement Directive No. 17/CT-TTg dated June 20, 2014 of the Prime Minister on rectifying the abuse of the requirement to submit certified copies of documents and papers when performing administrative procedures (hereinafter referred to as the Directive), the People's Committee of Nghe An province promulgates a Plan to organize the implementation of the Directive with the following basic contents:
1. Organize propaganda and dissemination of the content and meaning of the Directive; thoroughly implement the content of the Directive in the process of drafting legal documents with regulations on administrative procedures.
- Organize dissemination and introduction of the content and meaning of the Directive in the press and mass media.
- Thoroughly and strictly implement the provisions of Article 6 of Decree No. 79/2007/ND-CP dated May 18, 2007 of the Government on issuing copies from originals, certifying copies from originals, and certifying signatures (hereinafter referred to as Decree No. 79/2007/ND-CP) in the process of drafting legal documents with provisions on administrative procedures.
- Implementing agency:
+ The Department of Justice shall preside over and, through the activities of the Provincial Coordination Council for Legal Education, organize propaganda, dissemination, and strict implementation of the contents and meanings of the Directive to cadres, civil servants, and public employees of provincial departments, branches, sectors, and organizations.
+ The Department of Information and Communications coordinates with the Department of Justice, Nghe An Newspaper, Provincial Radio and Television Station and media agencies to regularly and widely disseminate the provisions of the Directive on mass media.
+ People's Committees of districts, cities and towns shall propagate and disseminate the provisions of the Directive to cadres, civil servants, public employees and people in the area.
- Implementation period: From October 2014 to February 2015.
2. Organize the review of legal documents with regulations on administrative procedures.
- Review and make a list of legal documents containing regulations on administrative procedures contrary to Article 6 of Decree No. 79/2007/ND-CP to amend, supplement or propose amendments, supplements or promulgate new documents to replace them according to appropriate authority.
- Implementing agencies and units:
+ The Department of Justice advises the Chairman of the Provincial People's Committee to direct the organization of reviewing and making a list of legal documents issued by the Provincial People's Council and People's Committee.
+ People's Committees of districts, cities and towns direct the organization of reviewing and making a list of legal documents issued by People's Councils and People's Committees at district and commune levels.
- Implementation time: Completed before March 31, 2015.
3. Organize review and catalog administrative documents
- Review and make a list of administrative documents issued by agencies and organizations in the form of decisions, notices, official dispatches and other forms of documents with provisions contrary to Article 6, Decree No. 79/2007/ND-CP to amend, supplement or propose amendments, supplements or issue new replacement documents according to authority for conformity.
- Implementing agencies and units:
+ The Department of Justice advises the Chairman of the Provincial People's Committee to direct the organization of reviewing and making a list of documents issued by provincial departments, branches, agencies, and organizations under the People's Council and the Provincial and Municipal People's Committee.
+ People's Committees of districts, cities and towns direct the organization of reviewing and making a list of documents issued by People's Councils, People's Committees at district level and People's Committees at commune level.
- Implementation time: Completed before March 31, 2015.
4. Improve the quality of legal document appraisal work
- Closely link the work of controlling administrative procedures in the process of appraising legal documents, ensuring that legal documents containing regulations on administrative procedures are issued in accordance with the provisions of Article 6, Decree No. 79/2007/ND-CP.
- Implementing agencies and units: Department of Justice, People's Committees - districts, cities and towns.
- Implementation time: Regular.
5. Strengthen inspection of the organization of receiving dossiers and returning results at the "one-stop-shop" transaction center at local State administrative agencies, promptly correct the situation of abusing the request to submit certified copies of documents and papers contrary to the provisions of Article 6, Decree No. 79/2007/ND-CP.
- Establish interdisciplinary inspection teams to inspect the organization of receiving documents and returning results at "one-stop" and "one-stop-shop" transaction centers at a number of State agencies at the provincial, district and commune levels.
- Implementing agencies and units:
The Department of Justice shall preside over and coordinate with the Department of Home Affairs and relevant units to advise the Provincial People's Committee to establish interdisciplinary inspection teams to conduct inspections of a number of State administrative agencies at the provincial level, district-level People's Committees, and commune-level People's Committees.
- Implementation time: Quarter IV, 2014
6. Conduct a review and enhance training and professional development for staff working in receiving documents at the "one-stop" and "one-stop-shop" transaction centers in units and localities to arrange staff with the capacity and qualities to meet the requirements.
The Department of Home Affairs shall preside over and coordinate with the Department of Justice to organize the review of the staff working in receiving documents at the "one-stop" and "one-stop-shop" departments in units and localities. Annually, training and professional development of the staff working in this field in agencies and units shall be carried out.
7. Summarize and evaluate the implementation status, report to the Ministry of Justice on the results of implementing the Directive locally.
- Summarize, evaluate the situation, and develop a report on the results of implementing the Directive locally.
- Implementing agency:
+ The Department of Justice advises the Provincial People's Committee to direct, organize the summary and assessment of the implementation situation, and prepare a report on the results of the implementation of the Directive throughout the province to send to the Ministry of Justice.
+ Relevant departments, branches, People's Committees of districts, cities and towns direct the organization to summarize and evaluate the implementation situation, and develop reports on the implementation results of the directive in their branches and localities.
Time to complete:
+ Provincial level: Completed before April 15, 2015.
+ District level: Completed before April 1, 2015.
