Civil servants are allowed to extend their retirement age.

The regulations apply to female officials and civil servants holding positions and titles as stipulated in Decree 53/2015/ND-CP.

The government has just issued Decree 53/2015/ND-CP regulating retirement at a higher age for officials and civil servants as stipulated in Clause 3, Article 187 of the Labor Code.

Accordingly, the subjects to whom this Decree applies are female officials and civil servants holding the following positions and titles:

- Deputy Head of the Central Party Committees; Deputy Chief of the Central Party Office; Deputy Chairman of the Central Party Inspection Committee; Deputy Head of the Steering Committee for the Northwest, Central Highlands, and Southwest regions.

- Deputy Head of the Office of the President; Deputy Head of the Office of the National Assembly.

- Vice Chairman in charge of the National Assembly's Ethnic Council; Vice Chairman in charge of the National Assembly's Committees.

- Deputy Minister; deputy head of a ministerial-level agency; head of a government agency.

- Vice Chairman in charge of the Central Committee of the Vietnam Fatherland Front; deputy head of political and social organizations at the central level.

- Deputy Director of the Ho Chi Minh National Political Academy; Deputy Editor-in-Chief of Nhan Dan Newspaper, Deputy Editor-in-Chief of Communist Magazine; Director of the National Political Publishing House - Truth.

- Officers in the armed forces hold the rank of general.

- Deputy Secretary of the Provincial/City Party Committee; Chairman of the People's Council, Chairman of the People's Committee of provinces and centrally-administered cities.

- Vice Chairman of the People's Council, Vice Chairman of the People's Committee of Hanoi and Ho Chi Minh City.

- Member of the Standing Committee and Head of the Party Committees of the Hanoi and Ho Chi Minh City Party Committees.

In addition, those appointed to the positions and titles of Judges of the Supreme People's Court and Prosecutors of the Supreme People's Procuracy are also subject to this Decree.

Conditions for retiring at an older age

Officials and civil servants eligible for retirement at an age higher than stipulated in this Decree must meet two conditions: 1- Have sufficient health to perform their duties and responsibilities; 2- Not currently under disciplinary review, investigation, prosecution, trial, or disciplinary action by the Party or government.

For female officials and civil servants holding the aforementioned positions and titles, the maximum remaining working time before retirement at an older age is 5 years, but not exceeding 60 years of age. These officials, when granted retirement at an older age by the competent authority, may continue to hold leadership and management positions.

For those appointed to the positions of Supreme People's Court Judges and Supreme People's Procuracy Prosecutors, the maximum length of service before retirement is 5 years, but not exceeding 65 years for men and 60 years for women.

During the implementation of the policy on retirement at a higher age, if civil servants wish to retire, they will be granted retirement benefits in accordance with the law.

The Decree takes effect from July 15, 2015. The regulations on retirement at a higher age for those appointed to the position or title of Judge of the Supreme People's Court take effect from June 1, 2015.
