Commune-level authorities are authorized to issue legal normative documents.
The law stipulates the authority of district and commune-level levels to issue legal normative documents. Accordingly, the People's Councils at the district and commune levels issue resolutions, and the People's Committees at the district and commune levels issue decisions to regulate matters assigned by law.
The report on the feedback and explanations presented by the Chairman of the Legal Committee, Phan Trung Ly, stated that, in order to ensure that district and commune-level authorities perform their assigned tasks and powers in accordance with local characteristics, it is necessary to grant these levels of government the authority to issue legal normative documents.
However, to overcome the limitations and shortcomings in the issuance of legal documents at the district and commune levels as in the past, the Law clarifies the basis for issuance, scope, authority, and form of the documents.
Regarding the detailed regulations, these are specified more clearly in the Law. According to the Standing Committee of the National Assembly, because the provisions of the law relate to the rights and obligations of citizens, and the administrative procedures that citizens must follow, these regulations directly impact the rights and interests of the people.
If it is necessary to specify this matter in a government document or a document from a Minister or Head of a Ministry-level agency, then the law will provide the regulation.
Issuing unconstitutional documents is grounds for a vote of no confidence.
Regarding the responsibilities of agencies, organizations, and authorized individuals in the drafting and promulgation of legal normative documents, after considering the opinions of National Assembly deputies, the Standing Committee of the National Assembly proposes that the National Assembly add a provision on responsibility as follows: The National Assembly, People's Councils, and other agencies and authorized individuals promulgating legal normative documents are responsible for the quality of the documents they promulgate (Clause 5).
The agency or person with authority is responsible for issuing legal documents that violate the Constitution, laws, resolutions of the National Assembly, ordinances, resolutions of the Standing Committee of the National Assembly, orders, decisions of the President, decrees of the Government, decisions of the Prime Minister, legal documents of superior state agencies, or issuing detailed regulations with content outside the scope of their assigned authority to provide detailed regulations (Clause 7).
The head of the agency or organization responsible for drafting, the appraisal agency, the submitting agency, the verification agency, and the agency issuing the legal normative document, within their respective duties and powers, shall be held responsible for failure to complete their tasks and, depending on the severity, shall be subject to disciplinary action in accordance with the law on cadres and civil servants and other relevant laws in cases where the draft document does not meet quality standards, is behind schedule, or does not ensure the constitutionality, legality, and consistency of the legal normative document assigned for implementation (Clause 8).
At the same time, this is also one of the bases for National Assembly deputies to consider when holding a vote of confidence or no-confidence vote.
