This new penalty decree is to implement the amendment and supplement of Decree 171 and Decree 107, which after a period of implementation have shown some inappropriate regulations that do not meet the practical requirements of ensuring traffic order and safety.

Accordingly, for the group of alcohol concentration violations, the draft proposes to increase the fine for all acts of car drivers. Accordingly, the fine will be increased from 2-3 million VND to 3-5 million VND for people with alcohol concentration below 50mg in blood or below 0.25mg/1 liter of breath (level 1).

Increased from 7-8 million VND to 8-12 million VND for people with alcohol concentration exceeding 50mg to 80 mg/100ml of blood or exceeding 0.25mg to 0.4mg/liter of breath (level 2).

In particular, those with an alcohol concentration exceeding 80 mg/100 ml of blood or exceeding 0.4 mg/liter of breath (level 3) will be fined from 14-16 million VND instead of 10-15 million VND as before. Level 2 and 3 violations will also result in a three-month suspension of the driver's license instead of the current two months.

For motorcyclists, the fine has also doubled. Level 2 violations will result in a fine of 1-2 million VND and level 3 violations will result in a fine of 5-7 million VND. In addition, the driver's license will be revoked for 2-3 months.

Explaining the increase in fines, Mr. Vu Do Anh Dung, Deputy Director General of the Vietnam Road Administration, said that according to statistics from the National Traffic Safety Committee, the number of traffic accidents caused by drivers using alcohol nationwide accounts for an average of 16-20% each year.

It is worth noting that this rate has tended to increase in recent years. Moreover, accidents caused by drivers using alcohol are often very serious in both nature and level of damage to people and property, threatening traffic safety for others and the entire traffic system. This is a red alert number for the problem of traffic accidents caused by alcohol.

“Therefore, it is necessary to adjust regulations on penalties for driving on the road with alcohol concentration in blood or breath exceeding the prescribed level to increase deterrence and prevent sources of danger to society,” affirmed Mr. Vu Do Anh Dung.

For the act of overloading by 150%, the fine is also doubled.

Accordingly, drivers who violate the law will be fined from 14-16 million VND, while individual vehicle owners will be fined from 18-22 million VND (the old level was 16-18 million VND). Organizations that violate the law will be fined from 36-44 million VND compared to the old level of 32-36 million VND. The fine for not complying with the weight check will also increase from 3-5 million VND to 14-16 million VND to prevent resistance when being checked for weight on the road.

Regarding this issue, the Deputy Director General of the General Department of Roads expressed his opinion that although synchronous solutions have been implemented, the situation of overloaded trucks is still common and extremely serious, many trucks are overloaded by 100-300% of the permitted load, many trucks are fined but still re-offend. Therefore, to ensure deterrence, prevention, and avoid danger to society, in addition to continuing to promote law enforcement solutions, it is necessary to study and adjust the fine levels accordingly.

In the Draft, the penalty for riding a motorbike on the highway will increase 10 times. Specifically, motorcyclists will be fined from 2-4 million VND instead of the current 200-400,000 VND. For cars parked illegally on the highway, the fine will also increase from 800,000-1.2 million VND to 2-3 million VND.

According to the representative of the Drafting Committee, riding a motorbike on the highway is a very dangerous behavior, with the potential risk of traffic accidents because cars are traveling on the highway at very high speeds while the current penalty level is not enough to prevent and deter.

For speeding violations, the penalty level also increases depending on the violation and the level of danger. The highest level is for cars traveling at a speed exceeding 35km/h compared to the regulation, which will be fined from 8-12 million VND and have their driving license revoked for 3 months...

In addition, the Draft also increases the penalty level for violations related to passenger transport business (excessive number of people, wrong route, no badge, etc.); groups of acts of not obeying orders, obstructing priority vehicles./.
