Any business or organization that evades paying insurance for its employees will be subject to criminal prosecution. The regulation applies from July 1, 2016.

The Office of the President held a press conference to announce the President's order promulgating 16 laws, codes and 7 resolutions passed by the 13th National Assembly (NA), 10th session.

Seven resolutions were announced, including: Resolution on the implementation of the Penal Code; Resolution on the implementation of the Bailiff system; Resolution on the implementation of the Civil Procedure Code; Resolution on the implementation of the Law on Administrative Procedures; Resolution on the implementation of the Criminal Procedure Code; Resolution on promulgating the internal regulations of the National Assembly session, Resolution on the ratification of the Protocol amending the Marrakesh Agreement establishing the World Trade Organization.The 16 laws and codes promulgated include: Law on Network Information Security; Law on Supervisory Activities of the National Assembly and People's Councils; Law on Accounting; Law on Statistics; Law on Hydrometeorology; Vietnam Maritime Code; Law on Fees and Charges; Law on Referendum; Law on Professional Soldiers, Workers and Defense Officials; Civil Procedure Code; Administrative Procedure Law; Law on Temporary Detention and Imprisonment; Law on Organization of Criminal Investigation Agencies; Criminal Procedure Code; Criminal Code and Civil Code.

Introducing the new points of the 2015 Penal Code, Deputy Minister Le Thanh Long said that the code recently announced by the President has many new points. Firstly, the death penalty is abolished for 7 crimes, of which 4 crimes are completely abolished: Crime of robbery (Article 168); Crime of destroying important works, facilities and means related to national security (Article 303); Crime of disobeying orders (Article 394); Crime of surrendering to the enemy (Article 399); 3 crimes that have the death penalty removed on the basis of separating from crimes that previously had the death penalty, including: Crime of producing and trading in counterfeit goods such as food, foodstuffs, food additives (Article 193); Crime of illegal possession of narcotics (Article 249); Crime of appropriating narcotics (Article 252).

Second, add the subject of non-death penalty to be people aged 75 or older when committing the crime or when being tried (Article 49, Clause 2, Point c).

Third, expand two more cases where the death penalty is not enforced, including: People aged 75 or older and people sentenced to death for embezzlement or bribery, who after being sentenced have actively returned at least three-quarters of the embezzled or bribed property and actively cooperated with authorities in detecting, investigating, and handling crimes or making great achievements (points b and c, clause 3, Article 40). Specific regulations in this case will convert the death penalty into life imprisonment (Article 40, clause 4 and Article 63, clause 6) to contribute to limiting the death penalty in practice.

On replacing the crime of intentionally violating State regulations on economic management causing serious consequences with specific crimes in the field of economic management.

In order to concretize the 2013 Constitution, at the same time create a transparent business environment, avoid arbitrariness in application, on the basis of carefully considering the results of summarizing the practical trial of the crime of intentionally violating the State's regulations on economic management causing serious consequences in recent years, and at the same time, reviewing the provisions of specialized laws in the fields of economic management, in addition to amending and supplementing the existing crimes in Chapter XVIII - Crimes of violating economic order (including 38 articles), the Penal Code has replaced Article 165 of the current Penal Code with 9 new crimes in the fields: Competition management, public investment; management and use of state assets; management and use of state capital invested in production and business at enterprises; bidding; property auction; accounting; tax management; construction; land recovery compensation.

Deputy Minister Le Thanh Long also said that the Penal Code stipulates criminal liability of commercial legal entities committing crimes in the economic and environmental fields, such as acts of environmental pollution, smuggling, tax evasion, production, transportation, and trading of counterfeit and prohibited goods, and evasion of insurance payments for workers... The Code takes effect from July 1, 2016./.
