The current situation of land management and use of agricultural and forestry companies since the 2004 - 2013 reorganization has been summarized, evaluated and concluded by the People's Committee of Nghe An province in the summary report of Resolution 28-NQ/TW, which clearly pointed out the limitations and weaknesses such as: Not completing the determination of boundaries, setting up field markers, granting land use right certificates and switching to land lease; The area of ​​unused or fallow land is still large; Slow and indecisive handling of cases of illegal land use; The management responsibilities of the government and enterprises have not been clarified; In some companies, there is a situation of lax land management, contracting, using land for the wrong purpose, and illegal transfer of forest land; Most companies have small capital and assets and still have many financial difficulties; Low land use efficiency and production and business results are not commensurate with the allocated forest and land resources; employment and income of workers and people in the region are slowly improved...

To overcome the above-mentioned weaknesses and limitations, recently the Provincial People's Committee has directed the Departments and branches to implement Resolution No. 30-NQ/TW dated March 12, 2014 of the Politburo on continuing to arrange, innovate and develop, and improve the operational efficiency of agricultural and forestry companies. Specifically:

* Department of Agriculture and Rural Development:

+ Review and advise on additional functions and tasks of agricultural and forestry LLCs, on that basis classify the companies to carry out the arrangement and innovation in the direction of: Continuing to maintain and consolidate the development of 100% state-owned enterprises; Implementing equitization; Establishing LLCs with 2 or more members.

+ Implement forest management, protection and exploitation mechanisms in accordance with the spirit of the Resolution.

+ Preside and coordinate with the Department of Natural Resources and Environment, People's Committees of related districts and towns, and agricultural and forestry LLCs to review and adjust land use planning in accordance with the production and business tasks of agricultural and forestry LLCs.

* Department of Natural Resources and Environment:

Preside over and coordinate with the People's Committees of relevant districts and towns, and agricultural and forestry LLCs to conduct surveying, make cadastral maps, issue land use right certificates, and lease or allocate land to agricultural and forestry LLCs in accordance with the provisions of the law on land.

* Department of Finance:

+ Based on specific policies of the state, advise the Provincial People's Committee to reorganize and innovate the development of agricultural and forestry LLCs in the area; Ensure sufficient charter capital for 100% state-owned enterprises and controlling capital in state-owned enterprises holding controlling shares; Ensure budget for forest protection.

+ Review and advise the Provincial People's Committee to assign socio-economic projects of agricultural and forestry companies that do not directly serve production and business to local management.

+ Completely handle capital, assets and outstanding debts of agricultural and forestry LLCs.

* Department of Labor, War Invalids and Social Affairs:

Inspect the implementation of policies for surplus labor in the restructuring of agricultural and forestry LLCs; Advise the Provincial People's Committee to effectively implement vocational training policies for cadres, workers, and employees of agricultural and forestry LLCs after the transformation.

* Agricultural and forestry limited liability companies:

+ Issue and implement programs and plans to transfer and apply scientific and technical advances to improve the efficiency of forest and land resource use.

+ Correctly and fully implement policies and regimes for cadres, workers and laborers.

In 2015, the Department of Agriculture and Rural Development consulted on the development of a Master Plan for the arrangement and renovation of agricultural and forestry companies, submitted it to the Provincial People's Committee for appraisal from the Ministry of Agriculture and Rural Development, on that basis the Prime Minister issued Official Dispatch No. 312/TTg-DMDN dated February 26, 2016 approving the Master Plan for the arrangement and renovation of agricultural and forestry companies under the People's Committee of Nghe An province.

Currently, Nghe An Provincial People's Committee has issued Official Dispatch No. 1430/UBND-TM dated March 15, 2016 and Notice No. 188/TB-UBND dated March 31, 2016 on the implementation of Official Dispatch No. 312/TTg-DMDN dated February 26, 2016 of the Prime Minister, in which specific tasks have been assigned to relevant units.

In the coming time, the Department of Agriculture and Rural Development will continue to coordinate with the Departments, branches, People's Committees of districts and Agricultural and Forestry Companies to implement according to the schedule assigned by the Provincial People's Committee.
