Review the land price approval process in the province.
(Baonghean.vn) - Recently, voters in some localities have suggested reviewing the land price approval process in the province. In reality, when wards and communes propose land prices for land development or compensation for land clearance, they have to wait a very long time, sometimes up to 6 months, which is very time-consuming.
The relevant authorities have responded to this issue as follows:
According to Clause 3, Article 114 of the 2013 Land Law, the Provincial People's Committee decides on specific land prices. The provincial land management agency is responsible for assisting the Provincial People's Committee in organizing the determination of specific land prices.
Determining specific land prices must be based on investigation and collection of information about the land parcel, market land prices, and land price information in the land database; applying appropriate land valuation methods. Based on the results of the land valuation consultation, the provincial land management agency submits the results to the Land Valuation Council for consideration before submitting them to the People's Committee of the same level for decision.

In the past, despite the large volume of work involved in land valuation across the province, upon receiving requests for land valuation from the People's Committees of districts, cities, and towns, as well as from investors, the Department of Natural Resources and Environment promptly hired a consulting unit to determine the valuation and submit it to the Valuation Council for appraisal before the Provincial People's Committee approved the specific valuation decision, thus promptly resolving administrative issues related to land.

To meet the requirements of administrative reform, after the Law on Organization of Local Government came into effect, the Department of Natural Resources and Environment advised the Provincial People's Committee to issue Decision No. 31/2016/QD-UBND dated March 29, 2016, on the authorization to approve specific land prices for calculating land compensation when the State recovers land and specific land prices for determining the starting price for auctioning land use rights in Nghe An province. Accordingly, it authorized the People's Committees at the district level to determine specific land prices for the following cases:
- Specific land prices to be used as a basis for determining the starting price in auctions for residential land use rights for households and individuals;
- Specific land prices for calculating compensation when the state acquires land in the following cases:
+ The specific land price used to calculate compensation when the state reclaims agricultural land shall not exceed the price in the Land Price Table multiplied by the coefficient k issued annually by the Provincial People's Committee;
+ The specific land price used to calculate compensation when the state reclaims residential land shall not exceed 10% of the price in the Land Price Table multiplied by the coefficient k issued annually by the Provincial People's Committee.
