The Deputy Director General of the General Department of Police said that fighting for national security is very diverse and difficult to have specific regulations on shooting.

Giving opinions on the draft Law on Management and Use of Weapons, Explosives and Supporting Tools, opinions in the National Assembly Standing Committee said that it is necessary to promulgate the law because after 4 years of implementing the Ordinance, many shortcomings have been revealed.

"Sometimes strong, sometimes helpless"

Emphasizing that this is an important law affecting people's right to life and health, Chairwoman of the Judiciary Committee Le Thi Nga asked: "What pressing issues have been raised by the use of this law in the past? Is there any abuse of support tools that affects people's health?"

According to Ms. Nga, the summary report only focuses on management summary but there are no results of implementation and no assessment of how weapons are used, especially in cases of shooting. The press and people have recently reported a lot that there are individuals who abuse weapons, explosives and support tools.

Deputy Chairman of the National Assembly's Committee on National Defense and Security, Mr. Nguyen Mai Bo, said that some opinions said that the provisions on shooting cases as in the draft Law are not specific, are still general and difficult to apply in practice; some specific cases cannot be recognized by law enforcement officers. Therefore, it is proposed to stipulate more specific and clear criteria; at the same time, it is proposed to consider expanding the shooting situation (for subjects committing serious and very serious crimes) to regulate in accordance with criminal handling policies.

Explaining this issue, Lieutenant General Nguyen Cong Son, Deputy Director General of the General Department of Police, Ministry of Public Security, said that it is very difficult to specifically regulate gunfire cases in the law because fighting for national security is so diverse that it is impossible to regulate everything.

The representative of the Ministry of Public Security also said: "The limitation in the past was that the regulations were not clear, so there were cases where while performing official duties, the brothers were sometimes strong-handed, sometimes helpless, when it was necessary to shoot, they did not shoot, and when it was not necessary, they shot," said the representative of the Ministry of Public Security.

Proposal to equip weapons for the investigation agency of the Supreme People's Procuracy

According to the draft law, the Investigation Agency of the Supreme People's Procuracy is not eligible to be equipped with or use military weapons, but is only equipped with support tools.

According to the explanation of the representative of the drafting agency, in practice over the years, the structure and organization of the investigation agency of the Supreme People's Procuracy has a small staff; the number of investigated cases is not many; the criminals are people working in the judicial field. On the other hand, during the arrest process, there was close coordination with the police force.

Disagreeing with this regulation, Mr. Nguyen Hai Phong - Deputy Chief Justice of the Supreme People's Procuracy said: "All crimes are the same, whether they are white-collar crimes, especially when the subject of judicial crimes is a district or provincial investigator, prosecutor or judge at the provincial or district level, the way to fight back is more sophisticated."

Mr. Phong also cited statistics from the Supreme People's Procuracy's report at the end of the 13th National Assembly's term, showing that in the past 5 years, there were an average of 141 cases of judicial violations per year with 300 defendants.

“I once reported to the National Assembly Standing Committee that there was a situation of arresting people with ropes. This is very real!” – Mr. Nguyen Hai Phong shared, at the same time expressing that if not equipped with weapons and support tools, it would directly endanger the Investigative force of the Supreme People's Procuracy.

“Like the Investigation Agency of the Ministry of Public Security and the Ministry of National Defense, the Investigation Agency of the Supreme People's Procuracy must also arrest people. If they are not equipped with weapons, it will be very dangerous,” said Mr. Phong./.
