Tan Ky publicly tried two cases of theft and gambling

(Baonghean.vn)- On September 28, Tan Ky District People's Court opened a public trial for two criminal cases of property theft and gambling.

* About the property theft caseAccording to the indictment, between June 1 and June 10, 2016, Nguyen Van Tam (born in 1987) and Cao Hung Cuong (born in 1986), both residing in Dong Tam hamlet, Nghia Hoan commune, Tan Ky district, together committed 5 acts of theft of 5 motorbikes, causing a total loss of nearly 70 million VND.

The jury sentenced Nguyen Van Tam to 4 years in prison and Cao Hung Cuong to 3 years and 6 months in prison.

The criminal acts of the defendants violated the crime of "Theft of property" as prescribed in Point e, Clause 2, Article 138 of the Penal Code; Both defendants above had previous convictions, in which, Tam was sentenced to 12 months in prison by the People's Court of Ba Thuoc district, Thanh Hoa province for the crime of "Theft of property"; Cuong was sentenced to 16 months in prison by the People's Court of Tuong Duong district and 21 months in prison by the People's Court of Quy Chau district, both for the crime of "theft of property".

Based on the level of crime and collected evidence, the Trial Council sentenced Nguyen Van Tam to 4 years in prison and Cao Hung Cuong to 3 years and 6 months in prison.

*According to the gambling case, at 5:40 p.m. on July 11, 2016, at the barber shop of Phan Van Huu (born in 1980), in Van Long hamlet, Giai Xuan commune, Tan Ky district, Tan Ky district police caught Phan Van Huu gambling in the form of recording lottery numbers with 10 subjects in the same commune and neighboring areas with a total amount of money Phan Van Huu gambled of 9,710,000 VND. Phan Van Huu's behavior violated the crime of "Gambling", the penalty is stipulated in Clause 1, Article 248, Penal Code.

Defendant Phan Van Huu was sentenced to 9 months in prison with a suspended sentence and 18 months probation.

As for the subjects who gambled with the defendant Phan Van Huu, the subjects had no criminal record, the amount of gambling was not large, so it was not necessary to handle criminally. The Tan Ky district police agency imposed administrative penalties.

Based on the severity of the crime and the collected evidence, the Trial Panel sentenced Nguyen Van Tam to 4 years in prison, Cao Hung Cuong to 3 years and 6 months in prison, and defendant Phan Van Huu to 9 months in prison, suspended for 18 months.
