'Hiding in bushes to shoot speed': Ministry of Public Security affirms disguise is necessary

This is one of the petitions sent by voters to the 11th session of the 13th National Assembly that has been forwarded to the Ministry of Public Security for response.

Specifically, voters in An Giang province expressed disagreement with the fact that traffic police often hide in bushes to shoot speeding vehicles.

“The performance of official duties must be public and transparent. It is recommended that the relevant agencies strengthen education on professional ethics and the image of traffic police in performing their duties, especially in handling and penalizing violations in the field of traffic safety” – An Giang voters spoke up.

The Ministry of Public Security’s response argued that speeding is one of the direct causes of traffic accidents. It is essential that traffic police measure the speed of vehicles, promptly detect and handle speeding drivers to limit traffic accidents.

However, in reality, many drivers find ways to deal with public speeding, such as: when driving at high speed, when detecting traffic police stations or checkpoints, they will reduce speed or avoid, the driver being fined will notify other drivers participating in traffic to avoid, causing difficulties in the performance of the traffic police's duties...

Therefore, the Ministry of Public Security affirmed that "the combination of public and secret speed measurement is based on the requirements of the actual situation".

The Ministry of Public Security also said that the unit has issued a circular regulating the duties, powers, forms, and contents of traffic police patrols and road traffic control, which stipulates: "Disguise using professional technical means and equipment to improve the effectiveness of ensuring traffic order and safety."

“Therefore, the combination of public and secret (disguised) measures by the traffic police to measure speed is necessary, based on practical work and in accordance with the law, not as some people think, “traffic police hide in the bushes to shoot speed” – the document responding to voters’ petition emphasized.

Another issue raised by Quang Tri voters with the traffic police is the right to requisition assets of this force as stipulated in Circular 01/2016 dated January 4, 2016 of the Ministry of Public Security. Accordingly, this force is allowed to requisition means of transport; means of communication; other means and technical equipment of agencies, organizations, individuals and drivers, and users of such means and equipment according to the provisions of law.

Quang Tri voters believe that the above regulations are unclear, easily exploited and contrary to the provisions of the Law on Property Requisition and Confiscation. Voters request the Ministry of Public Security to consider and amend and improve them in a clearer and more transparent manner.

With this opinion, the Ministry of Public Security cited Articles 23 and 24 of the Law on Requisition and Confiscation of Property, which stipulates that the Minister of Public Security has the authority to requisition machinery, equipment, means of transport, communications and other technical means.

The provisions in Circular 01, as proposed by voters, are only a reiteration of the requisition authority of the people's police force and regulations on conditions, authority, order, procedures... for requisitioning vehicles as prescribed by current law.

However, the responding agency also explained and accepted the recommendation that in the coming time, the Ministry of Public Security will issue a circular guiding the professional procedures of the traffic police in the direction of specifically and strictly regulating the cases of requisition and mobilization of vehicles, and the requisition of vehicles is carried out according to the decision of the competent person and according to the conditions, order and procedures prescribed by the Law on People's Public Security and the Law on Requisition and Confiscation of Property.
