Traffic route connecting N5 road: Slow due to local problems

(Baonghean) - The traffic route connecting N5 Road of the Southeast Economic Zone is an important route to serve the transportation of raw materials from industrial parks, factories, etc. in the western districts of Nghe An to the delta districts; after completion, it will create a driving force to promote socio-economic development. The route is being urgently constructed to complete on schedule, but the handover of the site still has a few problems.

Striving for a new path

In early August 2015, the Ministry of Transport and the People's Committee of Nghe An province started construction of the road connecting N5 Road of the Southeast Economic Zone to Hoa Son (Do Luong). Once completed, the road will connect the Southeast Economic Zone, Cua Lo Deepwater Port with the western economic zone of the province.

This is a traffic route that is expected to become a traffic axis to develop the East-West economic corridor and create development momentum, promote socio-economic development, ensure national defense and security for the Western Nghe An region, contribute to improving the capacity of goods circulation, serving the need to transport raw materials and products from industrial parks and factories in the western districts of Nghe An province to the plain districts.

In particular, the project will serve the transportation of cement for Song Lam Cement Plant (Do Luong) with a capacity of 4 million tons/year and Song Lam 2 Cement Plant (Anh Son) with a capacity of 0.6 million tons/year. The completion of N5 Road and its use will also be an opportunity for people in the areas where this road passes through to have more jobs and income...

The contractor is rushing to construct and speed up the project progress.

Recognizing the importance of the project, in recent times, the investor and contractor have focused on speeding up the construction progress to soon put the project into operation; in localities where the project passes through, authorities at all levels, functional agencies and people have also made efforts to be able to hand over the site to the construction unit. Particularly in Do Luong district, the work of compensating for land acquisition and compensation through the district has been 100% completed; the work of compensating for land acquisition and compensation for the entire route has also been basically completed, but the project is still stuck due to a 0.05km section through Dai Son commune, including 2 households who have not agreed to receive compensation funds and have not yet handed over the site to the investor.

Carrying out the site clearance work through the area, the People's Committee of Do Luong district organized the inspection of the origin of land use, statistics, and inventory of the current status of land and assets on land of the affected plots of land. The Compensation, Support, and Resettlement Council of Do Luong district coordinated with the People's Committee of Dai Son commune and the investor to invite households with residential land affected by the project to publicly disclose land data, the volume of assets on affected land that must be recovered, and the compensation and support plan.

Along with that, mobilizing socio-political organizations to coordinate with the People's Committees of communes with affected land and investors to propagate and mobilize households affected by the project to comply with policies on compensation and support for site clearance in accordance with the provisions of law. All recommendations and problems of affected people are examined and considered on the basis of legal provisions to prepare documents in accordance with regulations, ensuring the rights of households; in addition, many policies are applied, for example, for households subject to relocation and resettlement, relocation locations are proposed, prices are discussed on the basis of the correct policy framework, etc.

However, up to now, the route through Do Luong is still stuck at less than 0.05 km because 2 households have not yet handed over the land to the investor as mentioned above; these households have not agreed with the compensation level paid by the Compensation and Support Council for Land Acquisition and Clearance.

Unfounded claims

Two households that have not yet agreed include Mr. Nguyen Van Hai's household in hamlet 6, using plot number 61, measured plot number 02, which is reclaimed land and affected 650 m2. This is a non-agricultural plot of land under Mr. Hai's name, reclaimed before 1993.

Although Mr. Hai's affected land is non-agricultural land, he still requested support as land allocated by the State according to Decree 64 ND/CP and requested support of 200 million VND/sao; accordingly, the total amount of support Mr. Hai requested was 260 million VND. After many dialogues and propaganda campaigns, Mr. Hai did not cooperate with the compensation council, insisting on receiving support at the level he requested before handing over the land.

Because 2 households have not yet handed over the land, the N5 route through Dai Son commune, Do Luong is currently congested.

The second case is Mr. Nguyen Van De's household (the transferee of a part of the land area under the name of Mr. Nguyen Huu Lai and authorized by Mr. Nguyen Huu Lai). In fact, Mr. Nguyen Huu Lai's household uses land plot No. 826, cadastral map sheet No. 02, Dai Son commune with a total area of ​​315m2. In 2012, Mr. Nguyen Huu Lai transferred 175m2 of land to Mr. Tran Duy Cuong's household, hamlet 3, Dai Son commune.

In 2016, Mr. Nguyen Huu Lai continued to transfer the remaining 200m2 to Mr. Nguyen Van De in Hamlet 6, Dai Son Commune. The two people received the transfer on the same plot of land. Mr. Tran Duy Cuong's household received a support fund of 700,000,000 VND for an area of ​​175m2, with a support level of 4,000,000 VND/m2; but Mr. Nguyen Van De's household did not agree with the support level according to the council's plan, but requested support of 1,304,000,000 VND for an area of ​​200m2.

The reason Mr. De gave was: “It was very difficult for us to borrow money to buy a piece of land for our son. If we hand over the land to the project, the project's Compensation and Site Clearance Board must support us with both principal and interest. The land I bought from Mr. Nguyen Huu Lai has an area of ​​200m2 for 800 million VND, and my family had to borrow money with daily interest at U market, hamlet 6, Dai Son commune, which is 800,000 VND/day. So each month our family has to pay 24 million VND. Up to now, after 21 months of buying the land, we have paid 504 million VND, the total principal and interest is 1.304 billion VND” (!?)

Need consensus for common goals

According to the policy framework applied in Decision 58 on Support for compensation for land acquisition and resettlement; based on Article 25 of Decision No. 58/2015/QD-UBND dated October 13, 2015 of the Provincial People's Committee on compensation for land acquisition and resettlement support, regulations on support for land and assets on recovered land - for rural residential land, the price will be applied according to the price issued by the Ministry of Finance in 2015, and accordingly, the location of the residential land plot affected by Mr. Nguyen Van De's project will be supported with 600,000 VND/m2.

However, according to the wishes of the households (this project has 5 households whose residential land was recovered), the Compensation and Support Board of the District People's Committee has proposed to the competent authorities to request approval of the price of 4,000,000 VND/m2, and this is considered a "huge" compensation level after many proposals and adjustments within the framework of regulations on land price frames.

Accordingly, on October 7, 2016, the People's Committee of Do Luong district issued a Decision approving the compensation plan to support the N5 Road Project with a compensation value of VND 800,000,000 million for Mr. Nguyen Van De's household with an area of ​​200 m2.

However, while Mr. Tran Duy Cuong's household (the household that received the transfer of the plot of land with Mr. De from the owner, Mr. Nguyen Huu Lai, with an area of ​​175 m2) agreed to receive compensation of 700,000,000 VND and hand over the site, Mr. Nguyen Van De "continued to set a price" with a total compensation and support amount of 1,304,000,000 VND for the reason mentioned above.

For Mr. Nguyen Van Hai's household, according to the regulations on compensation and support for land acquisition and resettlement of the Provincial People's Committee, there cannot be a policy to support reclaimed land as support for agricultural land. Because, according to Articles 22 and 23 - Regulation 58/2015/QD-UBND dated October 13, 2015 of the Provincial People's Committee on compensation for land acquisition and resettlement support, the scope of compensation support for land and assets on land when the land is affected is households directly producing on agricultural land divided according to Decree 64 ND/CP. As for households directly producing on reclaimed land and not under local management, they will only be regulated to support 50% of the value of agricultural land.

Accordingly, the land plot in the name of Mr. Nguyen Van Hai's household (in fact, this is cropland not owned by any owner - PV) will be priced according to the price list of the Provincial People's Committee on support and compensation for land acquisition and clearance, which is 40,000 VND/m2 x 650m2 = 26,000,000 + annual land profits of 2 million VND. So the total amount of land that Mr. Hai still cultivates every year will be supported and compensated for is 28,000,000 VND. Thus, with the amount he requested to be compensated 200 million VND/sao (1 sao = 500 m2) a total of 260,000,000 VND is completely baseless.

It can be seen that, based on the regulations of the State and the province, the compensation and support plan that the Compensation, Support and Resettlement Council of Do Luong district has established is in accordance with regulations, ensuring maximum benefits for households whose land area is affected. However, there are still 2 households that intentionally cause difficulties, have unfounded demands to be resolved, and take advantage of the State's key project to deliberately not comply. The two households need to note that this is a key project to develop the regional economy, bringing benefits to the people themselves, so there is no reason for them to deliberately delay.

Recently, at the meeting on November 3 of the Provincial People's Committee on ensuring the progress of the N5 route, the Provincial People's Committee requested that the N5 route must be handed over with clean land by November 15. After reviewing the application of policies, inventory work, and implementation of compensation support in accordance with the law, if any household does not agree and comply with the handover of land, there will be a drastic plan to protect the construction.

A key project of great socio-economic significance, but just because of the problems of two households, Mr. Nguyen Van Hai and Mr. Nguyen Van De, the entire road was blocked. A new road with many expectations of the people of Do Luong and 227 pioneer households handing over clean land for the project, as well as millions of people, investors and tourists inside and outside the province, cannot be delayed by the demands of these two men. It is impossible to delay an entire project just because of the unreasonable, baseless demands, and non-compliance with the law of a few individuals, affecting the production of many factories and discouraging investors.

To ensure the project's construction progress, and avoid precedents for current and future projects in the area, while ensuring fairness and strictness of the law, households that are not yet informed need to understand and comply with the State's regulations, and make the right decisions for themselves, their families and society.
