Coordinate to sue businesses with outstanding social insurance debts

(Baonghean.vn) - On the afternoon of November 11, the Nghe An Provincial Labor Federation and the Provincial Social Insurance held a conference to sign regulations on coordination, exchange and provision of documents in filing lawsuits in court for violations of the laws on social insurance, health insurance and unemployment insurance.

Also attending were representatives of the People's Court, the Civil Judgment Enforcement Agency and the Department of Labor, War Invalids and Social Affairs of the province.

The signing of the Regulations aims to strengthen coordination in the implementation of lawsuits against violations of the law on social insurance, health insurance and unemployment insurance by employers to ensure the legitimate rights and interests of employees.

Leaders of the Provincial Federation of Labor and Social Insurance signed the coordination regulations.

The content of the Regulation clearly defines the responsibilities of the provincial Social Insurance and the responsibilities of the provincial Labor Federation in providing and exchanging information in preparation for filing a lawsuit and additional information during the lawsuit process, and information on the results of the lawsuit.

Accordingly, the provincial Social Insurance will provide a list of units that owe social insurance money and need to file a lawsuit; a file to determine the debt according to regulations; an update to the month before the time of filing a lawsuit with the court on the debt situation and the status of applying other handling measures to the employers whose list the trade union has sent to the Social Insurance agency before filing a lawsuit; a list of employers whose social insurance agencies have applied administrative sanctions; other information of the employers and employees.

On the part of the Trade Union, the list of employers preparing to file a lawsuit will be provided to the Social Insurance agency for inspection, comparison, and updating of debt situations and the application of other handling measures against employers; the situation and results of lawsuits against employers owing Social Insurance.

The two agencies will exchange and provide information in two forms: written and via the Internet. This is a necessary condition for the Trade Union to initiate lawsuits in court against violations of the law on social insurance, health insurance, and unemployment insurance by employers in the near future./.
