On November 29, the Provincial People's Court opened a first-instance criminal trial of defendant Phan Tien Duc (born 1997), residing in Hung Chinh commune, Vinh city, for murder.

According to the indictment of the Provincial People's Procuracy, at around 9:00 p.m. on July 11, 2016, Phan Huu Kien (born in 1997, residing in Hung Tay commune, Hung Nguyen district, Nghe An) and a group of friends drove a motorbike from Vinh city to Hung Nguyen. When they reached the front of the People's Committee of Cua Nam ward (Vinh city), Kien pulled his motorbike over to the side of the road to urinate.

At the same time, Phan Tien Duc was standing talking with two girlfriends. Seeing that, Duc cursed Kien for driving “badly” and swung his arm to hit Kien but missed. Kien got out of the car and hit Duc.

During the fight, Duc pulled out a switchblade from his pocket and stabbed Kien in the right thigh. Suddenly stabbed, Kien ran away and was taken to the hospital by his friend. Due to the severity of his injuries, Kien died on July 12, 2016.

Hearing the news of Kien's death, Duc went to the police station to confess and report his crime.

According to the forensic examination report of the Criminal Techniques Department of Nghe An Provincial Police, the cause of Mr. Kien's death was shock due to blood loss and circulatory failure due to a wound that severed the right femoral artery.

Based on the process of questioning and public debate, the representative of the People's Procuracy of Nghe An province said that the defendant's actions did not constitute murder and proposed to change the charge against defendant Phan Tien Duc from "murder" to "intentionally causing injury leading to death".

Considering that the defendant's actions were particularly dangerous, taking the life of another person, but after the incident, he turned himself in, confessed honestly, repented, and compensated the victim for mental damage, the panel sentenced Phan Tien Duc to 6 years in prison for the crime of "Intentionally causing injury leading to death".
