15 months in prison for wife who used pestle to kill husband
(Baonghean.vn) - On the morning of January 6, 2017, the Provincial People's Court opened a first-instance criminal trial of Moong Me Phia (born in 1971), residing in Bao Thang commune, Ky Son district, for the crime of "Murder in a state of extreme emotional agitation".
According to the indictment, during their time together, Mr. Moong Van Tinh (Ms. Phia's husband) often got drunk, came home to curse, threaten and beat his wife and children. On September 11, 2016, Mr. Tinh got drunk, cursed and threatened to kill his wife, but was stopped by neighbors so he went to bed. When he woke up, Tinh took an axe and a hammer and approached his wife who was cooking and threatened to kill her.

Mrs. Phia was scared and ran to the door, but it was locked by her husband, so she turned around and pushed her husband hard, causing Mr. Tinh to fall onto the bed. Mrs. Phia used a wooden stick to repeatedly hit her husband's lower body and head, causing him to lose consciousness. After neatly arranging her husband's legs on the bed, Mrs. Phia ran to the neighbor's house to inform him that her husband had taken rat poison and was dead.
However, realizing her actions, on September 12, Ms. Phia went to Ky Son District Police to surrender and confessed her crime.
At the trial, the defendant Moong Me Phia confessed her crime and hoped to receive leniency from the law. Considering that in the case, the victim was at fault, and that the defendant's actions stemmed from the frustration of being continuously abused by her husband for a long time, the panel sentenced Moong Me Phia to 15 months in prison. Regarding civil matters, because the victim's children and parents had not reached an agreement, the court decided to separate the case into another case and try it later.
