Truck driver prosecuted for crashing into motorbike, killing 3 people at Ro bridge

On the morning of February 7, Lieutenant Colonel Cao Anh Hong - Deputy Head of the Department of Investigation of Crimes on Social Order (PC45 - Provincial Police) said that the unit had issued a decision to prosecute and temporarily detain Pham Van Lai (42 years old, residing in Hung Loc commune, Vinh city) for 4 months for violating regulations on driving road vehicles, according to Article 202 of the Penal Code.

Previously, at around 1:00 p.m. on February 1, on Ro Bridge (Thanh Chuong District), a particularly serious accident occurred between a truck with license plate 37C - 062.02 driven by Mr. Pham Van Lai and a motorbike driven by Mr. Vo Van Tinh (32 years old, residing in Thanh Duong Commune, Thanh Chuong District).
Accordingly, at the above time, Mr. Vo Van Tinh (32 years old, residing in Thanh Duong commune, Thanh Chuong) drove an Atila motorbike carrying Mrs. Nguyen Thi Xuan (60 years old, biological mother) with his wife Vi Thi Hue (30 years old) and son Vo Van Huy (3 years old) from Ro bridge to National Highway 46. While the motorbike was running on the bridge, it was suddenly hit head-on by a 1.5-ton truck driven by Pham Van Lai going in the opposite direction and encroaching on the lane.
The strong crash caused 3/4 of the victims on the motorbike to fly over the bridge railing and fall to the ground below the bridge at a height of more than 15 meters. Ms. Xuan and Ms. Hue died on the spot. Mr. Tinh and his son were seriously injured and were taken to the emergency room. However, the injuries were so severe that Huy also died that day. Mr. Tinh had to have part of his leg amputated.
The police recorded that driver Lai had an alcohol concentration exceeding the permitted limit (0.37 milligrams/liter of breath). After the accident, driver Lai presented himself at Thanh Chuong District Police.
The crime of violating regulations on road traffic control is stipulated in Article 202 of the 1999 Penal Code, as follows: “1. Anyone who drives a road vehicle and violates road traffic safety regulations, causing loss of life or serious damage to the health or property of others, shall be subject to a fine of between five million and fifty million VND, non-custodial reform for up to three years, or imprisonment from six months to five years. 2. Committing a crime in one of the following cases shall be punishable by imprisonment from three to ten years: a) No license or driving license as prescribed; b) While drunk or under the influence of other strong stimulants; c) Causing an accident and then fleeing to avoid responsibility or intentionally failing to help the victim; d) Failure to comply with the orders of the person on duty controlling or directing traffic d) Causing very serious consequences. 3. Crimes causing particularly serious consequences shall be punished by imprisonment from seven to fifteen years. 4. Violations of road traffic safety regulations that are likely to lead to particularly serious consequences if not prevented in time shall be subject to non-custodial reform for up to one year or imprisonment from three months to two years. 5. The offender may also be banned from holding a position, practicing a profession or doing certain work from one to five years.” |
