Progress in suing businesses for social insurance arrears is still slow and has many problems.

(Baonghean.vn) - That is the information stated at the Conference to evaluate the 2016 work coordination program and sign the 2017 work coordination program between the provincial Social Insurance and the Nghe An Provincial Labor Federation on the afternoon of April 24.

The report at the conference stated that in 2016, the joint inspection team of Social Insurance - Provincial Labor Federation inspected the payment of Social Insurance, Health Insurance, and Unemployment Insurance at 20 units with social insurance debts in the first quarter. After inspection and supervision, only 4,466 million VND/ 40,582 million VND (11%) was recovered from 7 units with outstanding social insurance, health insurance, and unemployment insurance debts.

Many units with large debts and long debt periods have not paid their debts according to the schedule committed to the delegation, such as: Construction and Trade Joint Stock Company 423, Investment and Construction Joint Stock Company 24, Irrigation Construction Joint Stock Company I...

2016 is the first year of implementing the Law on Social Insurance, amending and supplementing a number of articles of the Law on Social Insurance, which stipulates that suing enterprises with outstanding social insurance and health insurance payments is the responsibility of the Trade Union. However, the results of lawsuits are not high, the progress of suing enterprises with outstanding social insurance payments is still slow and has many problems.

The reason is that the legal regulations on Trade Unions initiating lawsuits and participating in civil proceedings are stipulated in many different legal documents, causing difficulties for Trade Union officials.

On the other hand, some enterprises with long-term social insurance arrears have grassroots trade unions that do not initiate lawsuits, nor authorize the provincial Labor Federation to initiate lawsuits. The work of developing compulsory social insurance participants at foreign-invested enterprises in 2016 decreased by 1,697 people compared to 2015.

Based on the achievements and limitations in the implementation of tasks in 2016, the two units agreed and signed a number of coordination contents in 2017, aiming to improve the effectiveness of coordination in the implementation of legal policies on social insurance and health insurance.
