Accordingly, the Government has amended point a and added point c to Clause 2, Article 19 (Violation of prohibitions on cultural activities and public cultural service business) of Decree 158/2013/ND-CP regulating administrative sanctions in the fields of culture, sports, tourism and advertising. Specifically as follows:

A fine of between VND 5,000,000 and VND 10,000,000 shall be imposed for one of the following acts:

“a) Selling or disseminating paintings, photos, or other cultural products with pornographic content, inciting violence, depravity, spreading social evils, inconsistent with Vietnamese customs and traditions, or with content that has been subject to a decision to suspend circulation, prohibit circulation, recall, confiscate, or destroy by a competent authority;

c) Editing or combining photos to distort the content of the image with the aim of distorting history, denying revolutionary achievements; insulting great people, national heroes, leaders, cultural celebrities; slandering and harming the reputation of agencies, organizations, honor and dignity of individuals" (current regulations do not punish this).

Editing photos to insult or distort personal dignity will be fined up to 10 million VND.

Decree 28/2017/ND-CP amending and supplementing a number of articles of Decree 158/2013/ND-CP dated November 12, 2013 of the Government regulating administrative sanctions for violations in the fields of culture, sports, tourism and advertising... takes effect from May 5./.
