Death sentence for recklessly buying and selling more than 4.5 kg of drugs

On July 31, the Hanoi People's Court held first-instance trials of two drug cases and imposed the most severe sentences to deter, warn and prevent similar violations.

Defendant Phan Van Hung (born in 1981, residing in Bac Son district, Lang Son) was sentenced to death by the Court for the crime of "Illegal drug trafficking" under Article 194, Clause 4 - Penal Code.

According to the indictment, at about 5:50 p.m. on December 29, 2016, at the Nam Duong gas station (in Phuc Loi ward, Long Bien district), the Ha Dong district police force coordinated with Department 5 - Drug Investigation Police Department (C47) - Ministry of Public Security while on duty and caught Phan Van Hung driving a 5-seat car, inside the plastic compartment near the driver's seat were 2 nylon bags containing 1,756.94 grams of drugs.

Searching Hung's car, the investigation agency seized a black nylon bag in the back seat armrest box, inside were 2 white nylon bags containing white crystals that were carefully hidden. Through examination, the conclusion was that it was Methamphetamine, with a total weight of 1,854.52 grams.

At the investigation agency, Hung stated that at around 7:00 p.m. on December 28, 2016, a Chinese man called and hired Hung to carry 5 bags of crystal meth from Lang Son to Bac Giang and Hanoi to sell to customers for 10 million VND/bag. Hung agreed and took the recipient's phone number.

Right before being arrested by the police, Hung had delivered more than 900 grams of drugs and essence to a stranger in Bac Giang. Authorities determined that the total amount of drugs Hung had bought and sold was up to 4,514.325 grams of synthetic drug Methamphetamine.

Regarding the Chinese person who hired Hung to sell drugs, Hung said he did not know their name, specific address, or phone number, so there was no basis to verify and clarify.

On the same day, the Hanoi People's Court sentenced defendant Chu Van Phi (born in 1971, residing in Thai Hoa commune, Ba Vi district, Hanoi) to life in prison for "Illegal drug trafficking", and Nguyen Quang Uoc (born in 1984, residing in Nga Tu So ward, Dong Da, Hanoi) to 18 years in prison for "Illegal drug transportation".

At the trial, it was clarified: At about 9:00 p.m. on October 15, 2016, while on duty at the Time City urban area (Minh Khai area, Hanoi), the Y15-141 working group of Hanoi City Police discovered Nguyen Quang Uoc driving a motorbike in violation of traffic laws (without a license plate), so they asked him to stop the vehicle for inspection and discovered and seized 3 plastic bags containing white crystalline particles. According to the assessment of the Criminal Techniques Department - Hanoi City Police, the 3 plastic bags above were Ketamine, weighing more than 145 grams.

Nguyen Quang Uoc confessed that while serving his sentence at T16 Detention Center - BCA, Uoc met a man named Chu Van Phi. On the afternoon of October 15, 2016, Uoc went to Phi's house to visit. There, Phi gave Uoc a cardboard box containing 3 packages of drugs to bring back to Hanoi to deliver the "goods." When Uoc went to Chua Boc area (Hanoi), he received a phone call requesting him to deliver the "goods" on Minh Khai street, but when he arrived at Time City urban area, Uoc was checked and arrested on the spot.

Based on Uoc’s testimony, on October 20, 2016, the Hai Ba Trung District Police Investigation Agency (Hanoi) issued an arrest warrant and conducted an emergency search of Chu Van Phi. There, the police seized 1,150 grams of drugs from Phi.

Authorities determined that Phi must bear criminal responsibility for more than 1,295 grams of drugs, and Uoc must bear criminal responsibility for 145 grams of drugs.

At the trial, both defendants Phi and Uoc sincerely confessed their crimes, showed remorse and asked the Trial Council to grant leniency so that they could soon have a chance to start their lives over./.
