Que Phong: 13 years of not issuing forestry land certificates

On the morning of August 7, the National Assembly Delegation of Nghe An province supervised the settlement of voters' petitions before and after the session at the People's Committee of Que Phong district.

Mr. Tran Van Mao – Deputy Head of the National Assembly Delegation of Nghe An presided over the supervision. Attending were National Assembly deputies of the 14th tenure: Nguyen Thi Thao, Mong Van Tinh; leaders of Que Phong district, representatives of relevant departments, agencies and sectors.

Before and after the 1st and 2nd sessions of the National Assembly, Que Phong district received many opinions and recommendations from voters on issues related to areas that directly affect the rights and interests of people related to the issue of land allocation for people to produce.

These are: reviewing the unreasonable planning of rubber plantations in the area, upstream planting affects the domestic water source; speeding up the progress of allocating land from the Forestry Department to the people; reviewing the allocation of land to Thanh Thanh Dat Company that has been abandoned for many years; constructing Sao Va irrigation works to ensure irrigation water sources; completing the project of relocating people out of flash flood and landslide areas in Chieng village...

Through the supervision of the Provincial National Assembly Delegation, regarding the voters' request to review and speed up the progress of granting red books to people, Ms. Truong Thi Tuyet Mai - Vice Chairman of the District People's Committee said that as of July 31, 2017, 22,353 certificates had been granted.

Regarding the low results of granting land certificates, not meeting the needs of the people, the number of applications for certificates is still pending, currently there are more than 2,000 applications that have not been resolved, according to the explanation of the leaders of Que Phong district, it is because many households have incomplete documents and procedures, and the source of land use is unclear. Moreover, there are still disputes over land use rights, overlapping of land planned for protective forests... As for the granting of forestry land ownership certificates according to Decree No. 163, for the past 13 years, it has not been implemented due to lack of funds for surveying.

Regarding the review of rubber planting planning in the area, the reality of rubber planting is unreasonable, encroaching deeply into people's forest land, the District People's Committee said that it has organized many working sessions to handle the recommendations and has requested the Department of Planning and Investment, Department of Agriculture and Rural Development, Department of Natural Resources and Environment to direct Nghe An Rubber Development Company to coordinate with the locality to review, separate, mark and complete the documents to be allocated land, lease land according to regulations, seriously implement the recommendations of the locality.

However, the Company has not yet coordinated with the District People's Committee to implement this. Explaining the reason, a representative of the District Department of Natural Resources and Environment said that the Company received land from the 7th Youth Volunteer Team and was permitted by the Provincial People's Committee to plant forests, while the District People's Committee has not yet decided to allocate land, leading to overlap.

"Regarding the "hot" issue of requesting to reconsider the allocation of land to Thanh Thanh Dat Company that has been abandoned for many years without implementation, the District People's Committee has inspected, reviewed, and coordinated with relevant Departments and branches to coordinate the review and separation. The Department of Natural Resources and Environment has put this project on the inspection list in 2017. The representative of the District People's Council also clearly stated the view that it is necessary to seriously inspect, if this company is not operating, it should be quickly recovered and handed over to the people for production.

Regarding the voters' recommendation to continue investing in the construction and completion of the project to relocate people from the flash flood and landslide areas in Chieng village, Quang Phong commune, the District People's Committee said that after the investment decision of the Provincial People's Committee, the District People's Committee established a Project Management Board to urgently relocate people from the flash flood and landslide areas to organize the implementation of the project according to the assigned plan, ensuring quality, savings and efficiency. At the same time, it organized propaganda and mobilized people who had encroached on the project to self-clear the land, as well as urging contractors to construct the project items to ensure quality and progress.

However, the land acquisition and land division work is currently facing many difficulties and obstacles. The reason is that currently in the project planning area, some people arbitrarily build houses and auxiliary works on the land that has been planned for the project, the situation of land buying and selling is happening freely with lax management by the commune government.

The monitoring delegation requested that localities clarify, provide a roadmap, direction and specific solutions, and not let issues that voters and people are still concerned about remain pending.

Specifically, it is recommended that Que Phong district pay attention to the issue of granting land use right certificates; allocating forestry land; clarifying the reasons why Nghe An Rubber Company did not cooperate in planning rubber plantation in the area... Handle more drastic measures, proactively coordinate closely with relevant departments and branches to promptly review the projects being implemented in the area to have directions for implementation to achieve the highest efficiency.
