53-year-old man sentenced to 7 years in prison for stabbing someone to death at a wedding

(Baonghean.vn) - On the afternoon of September 14, Nghe An Provincial People's Court opened a first-instance criminal trial against Trinh Van He (born in 1964, residing in Dong Thanh commune, Yen Thanh district) prosecuted for the crime of "Murder".

According to the indictment, at nightOn December 7, 2016, Mr. Nguyen Van Binh, residing in Hamlet 5, Dong Thanh Commune, Yen Thanh District, organized a wedding for his daughter. Present to celebrate with Mr. Binh's family were Nguyen Van Sau (born in 1987), Nguyen Van Manh (born in 1986), both residing in Hamlet 13, Dong Tro, Dong Thanh Commune; Hoang Danh Thang (born in 1986), residing in Hamlet 11, Xuan Thanh Commune, and Mr. Trinh Van He (born in 1964), residing in Dong Hoa Hamlet, Dong Thanh Commune, both in Yen Thanh District, and a number of neighbors and friends.

While drinking, Mr. He asked some people sitting at the same table: "Whose son is that tall, handsome young man dancing on stage?", and one person answered: "Mr. Khang's son from Dong Tro hamlet". Mr. He continued to ask: "Is he the son of Mr. Khang who is crippled?". Thinking that Mr. He had insulted his father, Nguyen Van Hung (Sau's older brother), Mr. Khang's biological son, who was sitting at the next table, spoke up: "What do you like?". Mr. He replied: "I asked that to know, I didn't mean anything by it. My father was also crippled and people often called him Loc crippled".

The incident seemed to end there, but a while later, Mr. He went out, then returned to the wedding party and met Manh, Hung, and Sau. Because Sau cursed, Mr. He challenged: "Today is a happy day for Mr. Binh's family, if anyone disrupts the harmony, go out." At about 11 p.m. the same day, Mr. He stood up, went to the gate, got on his motorbike and went home. When Mr. He walked about 100 meters away from the wedding hall, Sau got on his motorbike and chased after him. When Mr. He reached the pile of sand in front of Mr. Can's house in Dong Hoa hamlet, Dong Thanh commune, Sau caught up with him and the two sides started fighting.

Later, Thang and Manh ran over. Thang tried to stop them, but Manh rushed at Mr. He. There, Mr. He picked up a fruit knife and stabbed Manh, Sau, and Thang repeatedly. The three were taken to the hospital by locals. However, due to the severity of their injuries, Sau died on the way to the hospital, while Thang and Manh were seriously injured. Hearing that Sau had died, knowing that he could not escape, Nguyen Van He went to the police station to surrender.

After considering the aggravating and mitigating circumstances, the panel sentenced Trinh Van He to 7 years in prison, ordered him to compensate Nguyen Van Sau’s family more than 182 million VND and provide for Sau’s two young children, each 1 million VND/month until they reach adulthood. The defendant must compensate Nguyen Van Manh more than 15 million VND and Hoang Danh Thang’s family more than 35 million VND.

However, the first instance verdict of the provincial People's Court did not receive the consent of the victim's relatives and family. At the end of the trial, the victim's family said they would continue to file an appeal to reclaim their rights./.
