Taking advantage of garden renovation to illegally sell land

(Baonghean.vn) - Recently, 3 households in Hamlet 6, Khai Son Commune, Anh Son (Nghe An) took advantage of garden renovations, allowing subjects to use excavators to dig up hill soil and sell it to the market.

At the scene, excavators were operating at full capacity, the hills were dug up and torn apart. According to observations, large trucks were continuously coming in and out to transport soil illegally. Thousands of cubic meters of soil were taken away but not declared, causing loss of tax and State resources. The soil transport vehicles were covered very carelessly, causing soil to fall all over the road, endangering road users and polluting the environment, but were not handled by the authorities.

Local people report: Soil exploitation also causes serious environmental pollution. On sunny days, dust flies everywhere, and on rainy days, the roads are covered with mud, making them slippery. Not to mention the noise of machinery day and night.

The representative of the People's Committee of Khai Son commune explained: The 3 households renovating the mixed gardens above include the households of Mrs. Lai, Mrs. Nhuong, and Mr. Nhung in hamlet 6 of Khai Son commune. The land being renovated of the 3 households above all have land use rights certificates and will go to the site to check.

According to the provisions of Point b, Clause 2, Article 64 of the 2010 Law on Minerals, "People assigned to use residential land and agricultural land (households and individuals)" are allowed to exploit soil (as common construction materials) for use as leveling materials, but only to use for construction of works of households and individuals in that area." Meanwhile, the above households take advantage of converting mixed gardens to illegally exploit and sell land, which is a violation of the provisions of the Law on Minerals on land exploitation.
