3 subjects were brought to trial by the authorities, including Tho Nhenh Thong, also known as Tho Ba Dia (born in 1978, residing in Tham Hin village, Nam Can commune, Ky Son).
With the purpose of exploiting forest products for use, Nhenh Thong masterminded the hiring of two subjects Vu Ba Do (born in 1984) and Vu Ba Tu (born in 1992), both residing in Hop Thanh village, Xa Luong commune, Tuong Duong district, to enter the Nam Can stream upstream protection forest, Nam Can commune, to illegally exploit two sa mu trees, belonging to group 2A wood, a rare and endangered plant species, protected. Each tree has a diameter of about 120 to 130 cm, length of 25 cm. With a total volume of 56.52 m3.

The volume of wood illegally exploited by Nhen Thong and his accomplices exceeded the administrative penalty level. Therefore, they violated Clause 1, Article 12 of the Law on Forest Protection and Development issued by the National Assembly on December 3, 2004.
With mitigating circumstances for the 3 subjects such as: having a good family history, first-time offender. Although being the mastermind of the case, however, because of many achievements in labor production, being an example receiving many certificates of merit and certificates of merit from all levels in the local economic development movement, defendant Tho Nhenh Thong was sentenced by the People's Court to 2 years in prison, while Vu Ba Do and Vu Ba Tu were also sentenced to 2 years in prison, but were given a suspended sentence.
