Escape from prison for 1 day, get 1 year in prison

(Baonghean.vn)- On November 27, Tan Ky District People's Court tried the criminal case against Nguyen Sy Linh (born in 1994), Trung Thanh Commune, Yen Thanh District (a prisoner currently serving a sentence at Team 3, Len Roi Stone Production Area, Prison No. 3, General Department VIII, Ministry of Public Security) for the crime of escaping from prison.

According to the indictment, at around 6:15 a.m. on October 17, 2017, Nguyen Sy Linh and 11 other inmates in the team were taken by prison officers to the brick production area of ​​Prison No. 3 to work. Nguyen Sy Linh was assigned by the officers to cook breakfast for the inmates in the team.

At about 8:15 a.m., the prison officer called the team up for breakfast, checked the number of people, and gave them a break. At 8:30 a.m., after breakfast, the officer let the team continue working. At this time, Nguyen Sy Linh was assigned to work with the team.

At 9:15 a.m. the same day, while working, Nguyen Sy Linh asked the officer to go to the restroom with the intention of escaping (at that time Linh was wearing a pair of blue and white striped camp pants and a black T-shirt). Taking advantage of the gap when the prison officer was managing another prisoner, Nguyen Sy Linh sneaked out of the restroom, crossed the high hill, ran into the sugarcane field near the riverbank, took off his camp pants, put on shorts and a black T-shirt, and then found his way towards Yen Thanh.

At 4:00 a.m. on October 18, 2017, Nguyen Sy Linh returned to his grandfather's house in Trung Thanh commune, Yen Thanh district (this house is currently unoccupied) to look for food but there was none. Nguyen Sy Linh went to his uncle's house to call but no one answered, so Linh opened the kitchen door to get 2 packs of instant noodles and then returned to his grandfather's house to eat and sleep there.

At around 6:15 a.m. the same day, Nguyen Sy Linh was discovered and arrested by the working group of Prison No. 3 according to wanted decision No. 02 dated October 17, 2017 of Prison No. 3, General Department VIII, Ministry of Public Security in Trung Thanh commune, Yen Thanh district. The search did not find any objects or documents seized.

After the incident, prison officer Phan Duc Huu fired an alarm gun and promptly reported to the leadership of Prison No. 3 to jointly pursue the subject and captured Nguyen Sy Linh in a short time. During the escape, Nguyen Sy Linh did not commit any illegal acts and did not cause any serious consequences. Therefore, prison officer Phan Duc Huu's act of letting the prisoner escape did not constitute a crime.

Previously, on August 25, 2015, Linh was sentenced by the People's Court of Yen Thanh district to 05 years and 06 months in prison for the crime of "Theft of property" (Prison term calculated from April 2, 2015). By the date of prosecution and detention for the crime of "Escape from detention" on October 31, 2017, Nguyen Sy Linh had served 02 years and 06 months and 29 days in prison. The defendant had his prison sentence reduced once = 05 months. Now he must serve 02 years and 06 months and 01 day in prison.

At the end of the trial, the panel sentenced Nguyen Sy Linh to 1 year in prison, plus the previous sentence of 3 years and 6 months in prison.
