(Baonghean.vn)- Priest Nguyen Duc Nhan, parish priest of Ke Gai, incited a number of parishioners to illegally occupy land and resist law enforcement officers, causing injuries to many people.

Less than a week to Christmas, while people and families are happily preparing to welcome the new Christmas season and wishing each other the best, on the morning of December 17, 2017, priest Nguyen Duc Nhan, the parish priest of Ke Gai, used a loudspeaker to incite parishioners to bring excavators and shovels to dig up the fields and destroy irrigation ditches to make a road about 2.5-3m wide and about 80m long. The total area of ​​encroached land is 9,000m2 - this is a 2-crop rice field assigned to households for cultivation according to Decree 64 of the Government.

Faced with the illegal acts of priest Nguyen Duc Nhan and some people, the authorities were present to ask these people to leave and collect their tools, but priest Nhan continued to incite some people to attack the authorities and government officials, causing injuries to some people on duty and some citizens.

It is worth mentioning that this is not the first time this priest has incited and incited some parishioners to violate the law. Since taking over the Ke Gai parish (January 31, 2015), priest Nguyen Duc Nhan has directed the construction of facilities, illegal use, encroachment and occupation of land.

We can review some systematic violations of priest Nguyen Duc Nhan in the recent past such as: Directing not to carry out procedures to build a catechism school on the land of the kindergarten on plot number 101, map sheet number 16, area 1017.1m2, cadastral map of Hung Tay commune measured in 2000 (the location of the parish land had been proposed to carry out procedures to build a catechism school and had been approved by the Provincial People's Committee in writing).

In October 2016, he directed the purchase of 5,000 cajuput trees and mobilized nearly 100 parishioners to illegally plant trees in the old brick kiln area (in Hung Thinh 1 hamlet, Hung Tay commune) to occupy the land. This is the land area managed by the People's Committee of Hung Tay commune, which signed a land lease contract with a household in accordance with the law in June 2016.

In February 2017, priest Nguyen Duc Nhan directed the purchase of construction materials to illegally build a dike (about 1 meter high) around the land area in front of the parish church (plot number 207, cadastral map 2000, area 508 m2 managed by the People's Committee of Hung Tay commune) for the purpose of occupying land.

Priest Nguyen Duc Nhan has repeatedly organized illegal ceremonies outside the church grounds in Dai Dong hamlet, Hung Tay commune, violating the provisions of Articles 11 and 12 of Decree No. 21/2004/PL-UBTVQH dated June 18, 2004 of the National Assembly Standing Committee on religious beliefs.

Regarding the compensation for land acquisition for the 72m road project, Father Nhan directed some parishioners of Phuc Long parish to put pressure on the government in resolving the issue of granting land for the construction of the chapel; incited some parishioners not to sign the documents to receive compensation for land acquisition, thereby affecting the progress of the project.

In February 2017, he directed the encroachment, occupation, and illegal construction of works on the Trung Ke Gai hamlet stadium land under the management of the local government (the land had been granted a certificate of land use rights by the People's Committee of Nghe An province and assigned to the People's Committee of Hung Tay commune for management).

From 2012 to 2017, Nghe An province approved the establishment of 37 parishes, sub-parishes and religious establishments; organized land allocation, land recognition, and granted land use right certificates to 42 parishes and sub-parishes with a total area of ​​181,540 m2 of land...

Faced with Father Nhan's illegal actions, authorities at all levels have worked with Father Nguyen Duc Nhan many times in a spirit of goodwill in resolving and handling cases at Ke Gai parish, requesting Father Nguyen Duc Nhan to comply with the State's legal regulations, however, Father Nguyen Duc Nhan has had an uncooperative attitude.

Returning to the incident that occurred on the morning of December 17, we noted that the situation in Hung Tay commune (Hung Nguyen) has stabilized. The local Party Committee and government have been making every effort to ensure that people can have a peaceful and happy Christmas. The law-breaking and disregard for discipline and law by priest Nguyen Duc Nhan and a number of others are being clarified and strictly handled by the authorities to ensure the rule of law.

According to lawyer Nguyen Trong Hai - Head of Trong Hai and Associates Law Office, hThe actions of priest Nguyen Duc Nhan and some others violated the 2013 Land Law. Such actions can be handled as administrative violations when changing the land use purpose without permission from a competent state agency according to Point a, Clause 3, Article 6 of Decree 102/2014/ND-CP on administrative sanctions for land violations, and will be forced to restore the land to its previous state before the violation.

In addition to the above acts, there are also signs of constituting the crime of disturbing public order and the crime of resisting people on official duty as prescribed in Article 245 of the Penal Code on the crime of disturbing public order and Article 257 on the crime of resisting people on official duty.
