Agencies, organizations and enterprises equipped with and using weapons, explosives and supporting tools must keep records and books for monitoring; when using, they must be permitted by the head of the agency, organization or enterprise and recorded in records and books for monitoring; after use, they must be handed over to the person assigned to manage the warehouse.

The Ministry of Justice is appraising the draft Decree detailing a number of articles and measures to implement the Law on Management and Use of Weapons, Explosives and Support Tools (hereinafter referred to as weapons).

According to the draft, agencies, organizations and enterprises, after being equipped with weapons, must manage and preserve them in warehouses and storage places and carry out procedures to request competent authorities to issue licenses to use them and certificates of registration according to regulations and can only use them when they have licenses to use them or certificates of registration.

Warehouses and places for storing weapons must be arranged in locations that ensure safety, security, order, fire and explosion prevention and control; develop protection plans; and have internal regulations approved by the heads of agencies, organizations, and enterprises equipped with weapons.

Weapons depots under the management of the Ministry of National Defense are designed and built according to national standards in the military field. Weapons depots not under the management of the Ministry of National Defense are designed and built according to national standards in the security field.

Weapons stored in warehouses and storage areas must be arranged neatly and tidily by type and brand. In case weapons, explosives and supporting tools are stored in the same warehouse or storage area, they must be arranged independently and not together.

Agencies, organizations and enterprises that are equipped with and use weapons must keep records and books for monitoring; when using them, they must be permitted by the head of the agency, organization or enterprise and recorded in records and books for monitoring; after use, they must be handed over to the person assigned to manage the warehouse.

In case of loss of weapons, military explosives, support tools or incidents occurring in warehouses or storage places, a written report must be immediately sent to the competent authority for handling according to regulations.

The person assigned to manage the warehouse and weapons storage place must keep statistics and fully record in the logbook the issuance, receipt, recall, transfer, assignment, upgrade, damage, loss, and repair of weapons, military explosives, and support tools; regularly inspect, maintain, and take measures to prevent rust, termites, mold, loss, fire, explosion, and other dangerous situations.

Commenting on the draft decree, the Government Office and the Ministry of Justice jointly proposed not to stipulate the organization of a specialized apparatus to monitor the management of weapons, explosives, and support tools to ensure compliance with the Prime Minister's direction.

The Ministry of Public Security said it has accepted and revised the draft, ensuring compliance with the Prime Minister's direction on not regulating the apparatus organization in legal documents that are not documents on apparatus organization.

The draft decree also proposes assigning the Ministry of Culture, Sports and Tourism, the Ministry of Transport, the Ministry of Agriculture and Rural Development, the Ministry of Labor, War Invalids and Social Affairs, the Supreme People's Procuracy, the Ministry of Home Affairs, the Ministry of Justice, the Ministry of Finance, and the Ministry of Industry and Trade to coordinate with the Ministry of Public Security in equipping, managing, using, repairing, transporting, classifying, liquidating, and destroying weapons, explosives, and support tools; and inspecting the management and use of weapons and support tools that have been equipped for subjects under their management.

The Ministry of Science and Technology is responsible for coordinating with the Ministry of Public Security to perform the function of state management of explosives used in scientific and technological research. The Ministry of Finance is responsible for presiding over and coordinating with the Ministry of National Defense and the Ministry of Public Security to prescribe the collection levels, collection, payment, and management regimes for fees and charges for granting licenses for the management and use of weapons, explosives, support tools, etc.
