Nghe An proposes to temporarily pay mineral exploitation rights fees at the old rate
(Baonghean.vn) - The People's Committee of Nghe An province has just issued an official dispatch requesting the Ministry of Finance and the General Department of Taxation to allow white marble mining and processing units in the province to temporarily pay the 2018 mineral exploitation rights fee at the 2017 collection level.
Accordingly, on March 29, the People's Committee of Nghe An province issued Official Dispatch No. 1878/UBND-KT on fees for granting the right to exploit white marble minerals to the Ministry of Finance and the General Department of Taxation.
Due to the minimum price for calculating resource tax on white marble from 0.4m3or higher as stipulated in Circular 44 of the Ministry of Finance is much higher than the previous one of the province, leading to a sudden increase in the fee for granting mineral exploitation rights for white marble minerals from 2018, increasing more than 3 times compared to 2017. This has led to many difficulties for enterprises operating in exploiting and processing white marble in Nghe An, many enterprises have to stop exploiting.

In order to create conditions for businesses to stabilize production and business, on September 15, 2017, the People's Committee of Nghe An province issued an Official Dispatch requesting the Ministry of Finance to consider amending a number of prices to calculate resource tax stipulated in Circular 44. And it is known that, based on the proposal of Yen Bai province, Nghe An province, on February 23, 2018, the Ministry of Finance issued Official Dispatch No. 2151/BTC-TCT to the National Assembly delegation of Yen Bai province, accordingly, the Ministry of Finance is currently researching, reviewing, amending and supplementing the price framework for calculating resource tax attached to Circular 44.
The official dispatch signed by Vice Chairman of the Provincial People's Committee Le Xuan Dai clearly stated: To solve the difficulties for enterprises exploiting and processing white marble in the area (during the time the Ministry of Finance considers, amends and supplements the price framework for calculating natural resource tax issued with Circular 44), Nghe An Provincial People's Committee respectfully requests the Ministry of Finance and the General Department of Taxation to allow units exploiting and processing white marble in Nghe An province to temporarily pay the mineral exploitation right fee in 2018 (the deadline for payment is before March 31, 2018 according to the provisions of Decree 203/2013/ND-CP) according to the collection level of 2017 and after the adjustment document is issued, if the amount payable increases, the enterprises will pay the remaining amount to the State budget without having to calculate late payment fees, if the amount payable decreases, it will be deducted from the amount payable in the following period.

Previously, Nghe An Newspaper had a series of articles reflecting the shortcomings in Circular No. 44/2017/TT-BTC on the promulgation of unrealistic price frameworks for calculating resource tax, which are causing many businesses to struggle and even go bankrupt.
The issuance of resource tax and the calculation of mineral exploitation right fees much higher than the selling price in Nghe An province has caused many difficulties for mineral exploitation enterprises. Especially for white marble for tiling, white marble for CaCO3 powder, the main products are for export markets. The increase in resource tax (the increase rate from 6% in 2009 to 15% now and the minimum price stipulated in Circular 44 of the Ministry of Finance is many times higher than the transaction price on the market) makes enterprises unable to compete in the world market.

Nghe An mineral enterprises face the risk of closure due to Circular 44
(Baonghean) - For a long time, the management of mining licensing has not been strict, white stone exports are mainly raw, creating a resource drain effect. Therefore, the State's strengthening of management of mineral exploitation activities to increase the value of goods is a correct and necessary policy. However, many policies overlap, especially Circular No. 44/2017/TT-BTC on promulgating the price framework for calculating resource tax, which lacks practicality, causing many enterprises to struggle, even go bankrupt.

(Baonghean) - Due to many shortcomings in the calculation of resource tax within the price range according to Circular 44/2017/TT-BTC, mineral enterprises in Nghe An have sent petitions to relevant ministries and branches, but up to this point, after nearly 9 months, they have not received any response documents.
